I am rejecting this response because:
No one at the gym notified me that my membership agreement was available on the websiteNo one gave me a physical copy of the agreement because they said it would be e-mailed to meThey sent it to the wrong e-mail, so I never received my agreement, which I am entitled to a copy of after signing (according to their own contract)They were not planning on giving me a copy of the membership contract until I brought up the issue.

I am rejecting this response because:I signed my son up for month only and after month I did cancel it with with Carlos like any other time when I took my private training beforeI also canceled with Richard the manger at the club, which he verified at that time that it was processedif Richard or Carlos did not do their job correctly, how is it my faultLike I said I always canceled my private training classes with instructorWhy this time it was different and no one informed me of a new cancellation processThis is very misleading and unprofessional on Jersey Strong sideWhy should I be punished because of unprofessional staff who can't do their job correctly and misleading the membersAs far as I know I did cancel my membership and you should ask Richard what did he do on his side incorrectly when he process the cancellation on his sideIf he had a problem with cancellation why no one contact me and let me knowi would of canceled it on line my selfI left Richard office in September assuming he took care of it allHow haven sake we are not talking about $a month it's $a monthDo you think I would let it go like thisI have to be out of my mined to do that. In addition: I had a conversation with VP Kenny after Jerseys Strong offered to pay half about my son's medical conditionHe said that I should submit my son's doctors note stating that my son was not able to take private training because of the seizures as of September and he will then approve the refundI did submit letters from my son's Neurologist and primary care doctor and you still denied itWhy did he ask for the letters?

I have thoroughly investigate *** *** inquiry According to our records, on 12/1/*** *** enrolled in a VIP membership agreement, as well as an XLab agreement Since that date *** *** has used the club multiple times In addition multiple payments have been received
for both *** *** membership & Xlab agreements On 2/23/we were in receipt of *** *** request to cancel We explained through our online Support Desk that *** *** is not eligible to cancel at this time, as she is within her initial term On 3/1/*** *** replied, "Thank you, Trey sorry for being a pain that is fine cancel membership 11/1/16."On 3/10/we were in receipt of an additional request to cancel *** *** stated that she would be moving and would no longer be able to attend our Menlo Park club We replied to *** inquiry by requesting proof of her new home address Once the documentation was received, *** *** was advised that her new home address was within miles of our Wall location and she may complete her initial term by utilizing our club located at *** *** *** *** *** Upon review of *** *** billing history, I have determined on 3/1/her account was billed for her March member dues, Xlab & her Annual Membership Fee of $ This fee is stated in *** *** agreement with us *** *** membership agreement is available to her at anytime by visiting our website, www.workoutworld.com. *** *** membership & XLab agreements are set to be cancelled upon completion of her initial term The last bill date for each agreement will be on 11/1/ She will have full access to enjoy the facility up to and including 11/30/ We hope she comes in and enjoys the club today!

I have further reviewed *** ***'s inquiry with one of our owners, *** *** The agreements signed are valid and *** *** is locked in for the full term of both his membership and personal training agreements We obviously hate to see any of our customers leave us- for whatever reason That is why we review every single member inquiry and do our best to help that customer, in whatever way we can, to remain a member (which we felt we did in *** ***'s situation) Unfortunately, we are faced with the realization that WoW may not be the correct fit for certain people We do not normally do this, but Mary has made an exception to cancel *** ***'s agreements with us upon receipt of a 10% cancellation fee for both his membership and training agreements *** *** will be responsible for a payment in the amount of $to cancel his personal training agreement immediately and a payment in the amount of $to cancel his membership immediately If *** *** would like to make this payment and cancel his membership and personal training, he may contact me directly at ***

As stated in *** *** agreement with us, after the completion of the initial term all memberships will continue on a month-to-month basis until a cancellation request has been received A member's failure to use the facility does not relieve them of their financial obligation
I have thoroughly investigated our records and we were not in receipt of a cancellation request for *** *** account with us *** *** WoW membership account has been billed in accordance with his agreement.I have reviewed the payments received for *** *** account and on 2/3/we were in receipt of a payment in the amount of $ The payment was applied to *** *** 8/1/2015, 9/1/and 10/1/membership dues On 3/2/we were then in receipt of an additional payment in the amount of $ This payment has been applied to the balance of *** *** 11/1/2015, 12/1/and 1/1/membership dues As no additional payments were received, MrHenrikson's membership was cancelled on 6/30/The remaining balance of $was sent to collections The remaining balance included Mr. Henrikson's 2/1/2016, 3/1/2016, 4/1/2016, 5/1/2016, 6/1/membership dues, his Annual Membership Fee of $billed on March 1st and a collections fee We would be happy to have *** *** back as part of the Jersey Strong Family! We do not normally do this but if *** *** would like to reinstate his original WoW membership account, we will make the exception to waive the collections fee applied to the balance on his account with us Upon receipt of a payment in the amount of $*** *** WoW membership account will be reinstated! I am rejecting this response because: First off, the "freeze" situation mentioned in your last responses is really of no relevance to my complaint However you chose to freeze my membership was not my choice- I simply asked to freeze the personal training contract and continue my daily cardio exerciseMy real complaint is twofold First, your customer service is poor It is nice that you have changed your policy regarding returning phone calls, but I would be interested to know when this took effect I have a trail of emails from July to 25, with requests for a phone call back, to which I received none Second, your business practice to not inform your customers of all the fees and penalties associated with early cancellation ( when they sign a contract)is just plain bad business and borderline deceitful At this point, I do not see that there will be a resolution to this issue and therefore would suggest that a compromise be made I am willing to accept a refund of percent (158.50) to resolve this issue and drop my complaint I think that this is the right thing to do in the name of good business practice for a customer who has been in good standing for over years and who has recruited multiple colleagues to join the gym during the years my husband and I were members I am hoping that we all learned a lesson and can prevent this from being an issue with another member in the future

We appreciate your patience while *** *** inquiry was thoroughly reviewed. According to our records, on 10/23/2017 *** *** enrolled under a personal training agreement with an initial term of 12-months. As stated in *** *** agreement with us, her personal
training is not eligible to be canceled until the initial term is complete. Although we do not normally do this, to help *** *** out, we will honor her request to downgrade her personal training to a 6-month initial term. Our current personal training package of sessions per month, for a 6-month initial term is billed at a monthly charge of $529.92. If *** *** would like to take advantage of this offer, she may stop by her local Jersey Strong location. I have noted her account of this exception. I have also notified the General Manager and Personal Training Manager of our Robbinsville club of this exception. At this time, we have reissued the personal training sessions *** *** requested in her inquiry. We hope *** *** comes in to use her sessions today!

I have thoroughly looked into *** *** account with us and on 4/4/he was enrolled under a month VIP membership agreementThis agreement is not eligible to be cancelled until the completion of the initial term We would never not disclose or hide anything from our members
The Annual Membership Fee is clearly stated on the first page of *** *** membership agreement with usAlso stated in his agreement with us, *** ***i was set to be billed a monthly dues rate of $+ sales tax, totaling $per month However, we do understand that *** ***i is currently a student and we have made the exception to cancel his membership prior to the completion of the initial term. We hope this helps! If *** ***i changes his mind and would like to remain a member, we will happily place his account on a $freeze while he is away at school, so he may keep his current dues rate and use the club when he is home from school. If *** ***i would like to remove the cancellation and freeze his membership, he may contact me directly at*** *** ***, during regular business hours I have attached a copy of his signed member agreement for review and to keep for his records

I am rejecting this response because:I did not sign the membership agreement, the reason for me saying fine keep the membership is being that they will not allow me to talk directly to a person and I felt that their customer service employee's are not qualified to help me to which I am aggravated with their responseThey need to provide me with the so called contract with my signature and a copy of the membership where they took additional money out of my bank account with out informing meAlso that I move it is not a gym's decision to tell me where I can work out being that the miles down in Brick is the opposite direction of my address

*** *** is listed in our system under a different name*** *** did not notify us of any changes in her contact information, therefore when we received her Online Support Ticket cancellation request, we could not locate her account with the information she providedWe requested additional
information in order to complete her request and did not receive a response prior to her October 1st bill date.*** ***’s entered a new Online Support Ticket using different contact information and only then were we able to locate her accountWe will honor *** ***’s cancellation request from 9/14/and will refund her October charge

memberships as it is a very limited option, only allowing a member to use one location and strictly equipment*** *** chose to activate a $Membership Credit which, as indicated in the email and on the card itself, applies to the unlimited access membership optionOur unlimited access membership is billed at $+ tax per month and allows members unlimited access to our X-Lab programsCurrently, all WOW memberships allow access to all WOW locationsAll of our current agreement enrollment options are for “VIP” status meaning that the member can access all locations, group classes, babysitting services, and tanning. However, each enrollment option has different access levels to our X-Lab program and is priced accordingly with a discount opportunity availableThe highest discount rate available applies to highest rate available for new enrollmentThere are discounts available for memberships with a lower monthly rate than $+ tax per month*** *** may speak to one of our Training Managers for more details regarding our discount and membership options

As *** *** stated in her inquiry, she is currently enrolled in a personal training agreement with us, and she is responsible for the term of that agreement. At this time, *** *** has completed 4-months of her initial 12-month term. According to our records, *** *** has used
out of the personal training sessions that she has paid for. Although *** *** is responsible for the remaining 8-months of her initial term, we can see that she does not want to continue her personal training with us. We will make an exception for *** *** to release her from her training agreement for an Early Cancellation Fee of $199. We hope this helps! I have noted Ms*** account of this exception

or by Registered/Certified US Mail As a request was not received, their memberships remained active and have been billed accordingly At this time, *** has an outstanding balance of $remaining on his WoW membership account This balance includes his September membership dues and Annual Membership Fee of $ ***' account with us currently has an outstanding balance of $for her September membership dues and Annual Membership Fee *** WoW membership account also has an outstanding balance of $for her September membership dues and Annual Membership Fee. We will make the exception to waive the outstanding balance remaining on each of the accounts ***, *** *** *** WoW membership accounts have been cancelled and will not be billed again

After thoroughly looking into this for *** ***, we see that the exception was made to allow him to pay 10% of his total contract even though our affiliate was located within miles of his new address*** ***'s contract would of remained at $a month until his term was complete in
January if he chose to attend our affiliate*** *** insisted he did not want to go to our affliliate gym, so we made the final expcetion to allow him to pay 10% of his remaining contract priceThis is company policy when you are relocating and are in term with your WOW agreementAs stated in each member's agreement, "This contract is also subject to immediate cancellation by written notice sent by registered or certified mail, return receipt requested to WoW at the address specified above upon the Member's change of permanent residence to a location more than miles from the club or an affiliated health club offering the same or similar services and facilities at no additional expense to the MemberIn the event of cancellation based on change of permanent residence to a location more than miles from the club or an affiliated health club, WOW shall require proof of the new permanent residence and shall retain a prorated share of the total contract price based upon the date the notice was received plus reimbursement for expenses incurred in an amount not to exceed 10% of the total contract price." At this time *** *** owes WOW $for the cancellation of his contract before his initial term was metI have attached his contract to this emailWe wish him well!

We are sorry to hear *** *** feels this wayOur maintenance department works around the
clock to make sure that all of our equipment gets repaired as quickly as
possible and our health clubs remain spotlessWe work very hard to make sure that this is accomplished because we
pride ourselves in our clubs! I have attached *** ***'s membership contract with WoW, we have received her cancellation and have updated her account appropriately to be terminated as of 12/31/after her initial month term is complete

We do not require members to utilize Personal Trainers in order to use our facilities and we would never deny a dues paying member access to the gym because they did not have Personal TrainingIf someone would prefer to work out at our facility without the assistance of a trainer, as dues paying
member, they absolutely may do so*** *** would never be denied entry to any of our locations as long as he was a member in good standingThe Personal Training agreement *** *** had purchased was canceled within operating days of enrollment and he was issued a full refund of the monies paid for that agreement in the form of a checkWe have made an exception for *** ***, to waive the fee associated with cancelling an agreement prior to the completion of the initial term*** ***’s membership will be canceled as of 2/28/with no further payments due
