Thereare several factors, such as: network changes, traffic volume, service outages,technical limitations, signal strength, equipment, terrain, structures,foliage, weather, and other conditions that may interfere with actual service,quality, and availability. T-Mobile records indicate that the account is subscribed to our Simple Choice Value rate plan, whichincludes unlimited talk, text, and internet with 4G speeds up to 1GB. T-Mobile reviewed the billing statements fromFebruary 17, through May 16, and over the course of those threemonths, Ms*** used a monthly average of 2,minutes with calls as longas minutes, sent and received an average of 2,messages and used anaverage of 3,megabytes of data. Assuch, it is T-Mobile's position that Ms*** was able to utilize the serviceand considers the charges to be valid T-Mobile records indicate that Ms.*** required down payment for an Apple iPhone 16GB on an EquipmentInstallment Plan, (EIP), is $486.00. EIP is a payment option that allowseligible customers to purchase handsets by making a down payment at the time ofpurchase and agreeing to pay the remaining balance in installments. All customers who choose to use the EIP optionto pay for their equipment are required to enter into a month financingagreement signed at the time of the purchase. Although this month financing agreement is required and theinstallments are added to each monthly billing statement, customers may chooseto pay off their EIP balance at any time by making incremental additionalpayments or a single payment for the total balance. Please note that any additional paymentsreduce the length of time it will take to pay the entire balance, but will notreduce the amount of any future regular monthly EIP payments. While we regret anymisunderstanding about the EIP program and the specifics of the offer to Ms.***, her down payment requested at the time of contracting was determined byseveral factors including handset selected, individual account tenure, paymenthistory, and personal credit information. Based on the above factors, Ms.*** qualifies to purchase an Apple iPhone handset with a retail price of $649.92by making a down payment of $and interest-free monthly installmentpayments in the amount of $6.83. However, in an effort to amicablyresolve this matter, on June 10, 2015, upon speaking with Ms***, sheagreed and accepted the above mentioned EIP agreement for the new Apple iPhone6. As a courtesy to Ms***, T-Mobileapplied a courtesy credit of $to her account for her monthly accesscharges. As of June 10, 2015, Ms.*** account reflects a zero balance. Please note that the down payment of $551.48, including shipping andtaxes will be billed on Ms*** next billing statement As an additional courtesy, T-Mobile placed Ms.*** account on hold for payment until September 1, 2015. Ms*** accepted this as a resolution tothis matter. T-Mobile regrets that Mr*** experienced concerns with the information that he received from our Telesales team and with our Samsung Summer BOGO offer. From July 8, through July 10, 2016, customers who switch to T-Mobile were able to get two Samsung or LG devices for the price of one when they port in two numbers and activate two lines of service on a post-paid account with a minimum of gigabytes (“GB”) of data per line of service for each device. Customers were required purchase the handsets with our Equipment Installment Plan (“EIP”). The qualifying handsets for this offer were the Samsung Galaxy S7, Samsung Galaxy SEDGE, Samsung Galaxy Note 5, LG Gor the LG V10. The Samsung Galaxy Sand the Samsung Galaxy SEDGE were not included in this offer
T-Mobile records indicate that Mr***’s account was activated with a Simple Choice No Credit Check account type, which is not eligible for an EIP option; therefore he was not eligible for this offer. In addition, Mr*** purchased two Samsung Galaxy SEDGE handsets and paid for the handsets in full at the time of purchase, which also did not meet the terms for the offer

Mr***’s account was cancelled on July 21, 2016. When T-Mobile contacted Mr*** regarding this matter, he confirmed that he returned the two Samsung Galaxy SEDGE handsets. T-Mobile advised Mr*** that if he chooses to return to T-Mobile with a post-paid account and purchases the handsets with our EIP option that will close one EIP plan so that he only pays for one handset
T-Mobile appreciates that Mr*** chose to activate an account with us and we regret his recent experience with the BOGO offer. We can extend our current offer to Mr*** for the next 30-days from today

Additionally, at the time of Mr***’s purchase, T-Mobile was offering our @Work Fall Magenta Tablet offer where customer with a total of or more voice lines of service that purchased a Samsung Galaxy Tab E tablet with a new Mobile Internet line of service could receive a promotional monthly credit of $per qualifying purchaseAs Mr***’s account did not meet the eligibility requirements of the offer, his account was not enrolled in the promotional offer
Following a conversation with our Customer Care on May 8, 2017, Mr*** selected our T-Mobile ONE taxes included rate plan his lines of serviceIt is important to note that Mr*** will no longer be enrolled in the Friends & Family promotional creditsAfter speaking with Mr*** on May 13, 2017, in an effort to amicably his concerns, T-Mobile closed the remaining EIP balance of the two Galaxy Tab E tablets, and cancelled the two Mobile Internet lines of serviceAdditionally, T-Mobile issued a credit of $to the account, as resolution in full for Mr***’s concernsAs of the date of this correspondence, Mr***’s account remains active with ten voice lines of service, and the account reflects a zero balanceT-Mobile regrets any inconvenience to Mr***

In Mr***’s letter to your office he outlined concerns regarding a handset on his account that has malfunctioningT-Mobile records reflect that Mr*** purchased an Apple iPhone Plus 64GB handset on December 3, By purchasing T-Mobile equipment, Mr*** received a one-year Limited Warranty provided by the manufacturer of his deviceUpon review of Mr***’s account, this warranty has been extended as he subscribes to the optional JUMP with Premium Handset Protection (“PHP”) feature
During the Limited Warranty period, Mr*** is eligible to receive an advanced replacement of his device via T-Mobile’s Handset Exchange Program or a post-exchange device by contacting the manufacturer directly to discuss repair or replacement optionsUnder the Handset Exchange Program, T-Mobile will provide a replacement handset of the same or equivalent model, with a Service Warranty Processing Fee, provided that the non-working handset is in good physical condition with no modifications or damage, such as broken or cracked plastics, LCD or internal parts, or liquid damage
T-Mobile records confirm that replacements were sent on February 3, 2017, February 7, 2017, March 29, 2017, and May 10, It is important to note that the equipment sent to customers through our Handset Exchange Program may be in like new conditionPrior to sending replacement equipment to our customers, the equipment undergoes a thorough inspection to ensure that the device is functioning correctly and has no physical damage
