As a gesture of good customer service the management of the Colorado Athletic club has decided to waive the balance of $

The only form that we have for Mr*** in a leave of absence form (attached). Mr*** was sent seven letter from 12-7-to 3-14-related to the past due situation. Mr*** did not respond to any of those. Mr*** was sent four e-mails from 1-15-to 3-12-related to
the past due situation. Mr*** finally responded on 4-2-regarding the leave situation and the cancel situation. The corporate office reached out to the facility to have them look for the cancelation form that Mr*** states he signed. None was located. We would like to know if Mr*** has a copy of the cancelation form so we may review that document. At this point in time we cannot comply with Mr***’s request

The December charge was $which was $for a Smoothie and $per the December dues. I have authorized a credit card refund of $for the December dues

We are unable to locate a membership under the name of [redacted].  Could the membership be under a different name?

I am rejecting this response because:I propose we split the difference and I’ll pay $56 and I’ll just drop the complaints lodged with Revdex.com and GA governmental organizations. I think that would be a fair compromise. If agreeable, I’ll pay that amount immediately and we can close this case and all get on with our lives.

A membership agreement / contract was signed by [redacted] on 6-8-15. That membership agreement did state that a 3 month membership is required which was initialed by Mr. [redacted]. The contract also addresses the cancelation policy which...

was initialed by Mr. [redacted] did contact the corporate office for New Mexico Sports and Wellness on 10-15-15. After that conversation the outstanding balance of $80.39 was adjusted off which were the October 2015 membership dues? An exception was made to the cancelation policy and 3 months of membership dues were paid which covered dues for July, August and September 2015 membership dues.

Attached is a copy of the membership agreement that [redacted] signed.  Section 4A addresses the cancelation policy which [redacted] specifically initialed.  The [redacted] cancelled the membership exactly as related to the terms and conditions of the agreement that was...

signed.  By signing the agreement, [redacted] promised to abide by everything in that document.

The membership has been set to terminate on 1-1-17.

Neither the [redacted] nor the corporate office of the Wellbridge Company has any record that any communication was made in January 2016 in regards to cancelling the membership.  A cancelation form was received which was signed on 5-21-16 by [redacted] requesting that the...

membership be cancelled effective 7-1-16 which was done.  The balance of $855.00 is scheduled to be sent to a third party collection agency on 10-15-16 unless the balance is paid by then or some sort of settlement can be agreed to.

[redacted] was angered that the pool was not only adult lap swim at all hours and that she needed to follow a schedule to avoid pre-set and announced programming in the pool.  She was also upset she would have to share the pool in general.  There was one instance when a child threw up in the...

pool and so we closed the pool to shock it.  [redacted] came in a few minutes later and unfortunately could not swim. Her membership was cancelled effective 12-1-16 and currently has a zero balance due.

The membership agreement/contract that was signed by [redacted] does require a written request to terminate/cancel the membership.  None was ever provided.  Attached you will also find documentation of the communication between the facility and [redacted] trying to get the appropriate...

documentation.  At this point in time the balance is due and payable.

I am rejecting this response because: Thank you for canceling the outstanding balance. You can check your records and see that I have not used the gym in over a year. Over $800 in unauthorized charges is a lot to swallow because your employee did not file the paperwork correctly.

I am rejecting this response because:
The cancelation date must be changed to April 1, 2018. In the agreement that was signed nowhere is a month defined, it’s actually quite vague. Therefore, I believe I have provided a months’ notice and expect that to be honored. The cancelation agreement states May 1, 2018 simply because that’s all your rude staff were willing to put, hence why I am trying to get this issue settled in this manner. If this is not corrected I will be forced to pursue this further action with the Attorney General Office of Consumer protection. Do the right thing Wellbridge and Change the date to April 1, 2018, this issue will not go away until the change is made.
