Timeshares Direct Inc. d/b/a/ Timeshares by Owner has made misrepresentations and we feel we have been defrauded by their sales practices.
We contracted with them to sell our two time shares. We paid them $2000 in reliance on reps they made regarding how they would advertise and what efforts they would make for the $2000. They were untruthful to us about their Revdex.com rating, the services we would receive. They have failed to communicate. They have failed to provide requested documentation. They have engaged in misrepresentation and, in our opinion, bad faith.

Desired Outcome

We want them to respond to our requests for information and fulfill their obligations under the contract. We contracted with them in March and, contrary to all the representations and promises they made, have received only one viable offer in the last three months. if they fail to do this we want our money back. We want them to correct the misrepresentation on their website - they do not have a rating of A from the Revdex.com according to the phone report I got from Revdex.com.

Dear Ms.,

I am in receipt of the recent complaint filed with your office by ***. Our records do not indicate that *** has ever been a client of Timeshares By Owner; however, after exhaustive research, it was determined that ***, apparently the wife of ***, was the actual client of Timeshares By Owner for which I will respond to the filed complaint by Mr.. Our records indicated that *** has been a client of Timeshares By Owner since March 23, 2017 marketing her Diamond Resorts International and RCI points in two different ads and under two different contracts. When Ms. purchased our marketing, before we could accept her fees, contracts were signed. By signing the contracts, it was a complete acknowledgement of her understanding of our terms and conditions, which included the fact that there was a ten-day timeframe from the start of services for requesting and receiving a full refund. Both purchases were also subject to a Quality Control call within a day after the purchase to ensure that she understood the program that she purchased. If Ms. did not accept the purchase or acknowledge her understanding of the marketing program during the Quality Control call, a refund would have been processed.

In the correspondence prepared by Mr., he indicates that he wants us to respond to his request for information, fulfill our obligations under the contract, and to correct our misrepresentation that we have an "A" rating with the Revdex.com. Mr. insists that Roy L, the representative that sold Ms. our services, had indicated that rental offers would be received within a week and that his record of performance was impeccable. In response, Timeshares By Owner, based on the contracts that were signed in advance and in the Quality Control calls that were conducted, has provided the services that we said we would. Our guarantee is to provide marketing, which is what we have done and continue to do. Obviously, we cannot guarantee a timeframe for selling or renting a client's timeshare, which is spelled out in the contract and in the follow-up Quality Control call that was conducted. We also cannot indicate what price might be offered or received. As for offers on a client's timeshare, it is the Concierge Department that will contact a client with an offer--and thus far we have been generating over $3 million in transmitted offers on a monthly basis. Our records indicate that an offer was provided on June 7, 2017. As for an "A" rating with the Revdex.com, yes indeed we had an "A" rating on March 23, when Ms. purchased our services--and that can certainly be verified with the Revdex.com. We currently have an "A-" rating that is also verifiable just by visiting the Revdex.com website. Based on the fact that we have provided the service as contracted, there is really is no entitlement to any refund. However, to resolve matters and eliminate any further action that may be taken, a full refund in the amount of $1999 (two separate contracts of $1000 and $999) will be issued. In addition, *** and *** are being placed on the "do not solicit" list, so that they are not contacted again to purchase additional marketing.

Unlike other timeshare resale marketing companies, Timeshares By Owner provides the marketing that is contracted and promised. We advertise in the USA Today as well as major city newspapers, billboards, TV (ESPN, A&E, Weather Channel, and Travel Channel), direct mail marketing, internet, and other forms of media. We also attend trade shows on a regular basis in which we display client ads, we distribute the Timeshare Trader publication on a monthly basis to the top vacation areas, and we sponsor our own podcast; "Vacation Time" broadcast every week live from the studios of the Timeshares By Owner corporate office. That is just a little of what we do. We have the tools to rent and/or sell a client's timeshare and have been successful at doing just that since 1998.

Again, to resolve matters, a full refund is being issued and *** and *** will be placed on the internal Timeshares By Owner "do not solicit" list, so that they are not contacted again to purchase more marketing. We accept the refund and being deleted from their call list, but do not agree with their version of events as expressed by Mr. W.

they have been promising me to sale my timeshare and have taken money but never delivering.
I was called by Timeshares by Owners around August 2016. They promised me that if I paid them $900.00 they promise they would sale my timeshare. In December 2016 I get another call from them saying that they had my timeshare sold but I need to give them another $1200.oo so they can move me up to another level of advertising and they would be bringing me to closing by 16 December 2016. I gave them $1200.00 more to sale my timeshare. It didn't sale. They call me in March and said they guarantee my timeshare will sale but I needed to pay another $1200.00 to move me up to another level but by then I was getting frustrated with this and would not give them any money because no matter what they say, my timeshare is not sold. Then in May I was told that for another $599.00 my timeshare will move up to a level that it has to sale. I am still stuck with this timeshare and I have paid them all this money for nothing. This sounds like a scalm to me.

Desired Outcome

Other (requires explanation) I just want my money back. That is money I could have been using to pay my timeshare off. Why do they need my money for a promise they knew they would not keep. I am told that no one can sale a timeshare and no one buys a timeshare from these people and they know that when they first called me. Please give me my money back.

Our records indicate that*** and *** have been clients of Timeshares By Owner since August 10, 2016 with marketing for their Massanutten's Mountainside Villas in Virginia. They purchased marketing on three different occasions, which included website/walk-in office advertising, the Timeshare Trader Magazine, and membership in the Elite Plus program with advertising in the exclusive Trader Elite Plus magazine and another edition of the Timeshare Trader Magazine. Each time Mr. purchased marketing, before we could accept his fees, contracts were signed. By signing the contracts, it was a complete acknowledgement of his understanding of our terms and conditions, which included the fact that there was a ten-day timeframe from the start of services for requesting and receiving a full refund. All purchases were also subject to a Quality Control call within a day after the purchase to ensure that he understood the program that he purchased. If he did not accept the purchase or acknowledge his understanding of the marketing program during the Quality Control call, a refund would have been processed.

In the correspondence prepared by Mr., he indicates that he was promised that his timeshare would sell based on each of the programs that he purchased. There was even an alleged date of sale for one of the purchases. In response, Timeshares By Owner guarantees to market a client's timeshare, which is exactly what we have been doing for Mr.. In our marketing programs, we cannot guarantee a timeframe for selling or renting a client's timeshare, and we cannot indicate what price might be offered or received. As for offers on a client's timeshare, it is the Concierge Department that will contact a client with an offer--and thus far we have been generating over $3 million in transmitted offers on a monthly basis. Our records indicate that Mr. has actually receive two offers on his timeshare with one taking place on November 8, 2016 and the other taking place on January 19, 2017. With those two offers, Mr. was informed to call our Concierge Department at toll-free (888) 364-9212 for any assistance. As stated in the contract that was signed in advance of the marketing purchase, a client is informed to call the Client Services Department with any updates or questions in regard to their marketing. Telephone numbers provided are toll-free (888) 707-8463 and (888) 707-8463. As an "Elite" member, the client is also provided with a membership card and exclusive "Elite" telephone number of (844) 70ELITE or (844) 703-5483. Based on Mr. canceling his marketing within the ten-day timeframe for his last purchase that took place on May 12, 2017, a $599 refund was fully processed on May 31, 2017. To further resolve matters and to eliminate any misunderstanding in regard to the services that we provide, a refund of $1249 will be processed for the marketing purchase that took place on November 2, 2016. There is no entitlement to a refund of the first purchase that took place on August 10, 2016 in the amount of $988. Based on that, we will continue to market*** and ***'s timeshare. Mr. has also been placed on our "do not solicit" list so that he is not contacted again to purchase more marketing. That does not mean that our Concierge Department will not forward offers when received.

I want my first payment refunded since I was told that my timeshare will sale with them when they knew that they could not sale my timeshare with the original payment. In my opinion I should have been told that I would never get my timeshare sold in that program. That within itself is not right. I appreciate their willingness to refund two of those payments back to me. But I was misled from the beginning of this adventure. That $988.00 dollars was a lot of money to me to give someone for something that they knew they would not be able to do. No I will not be satisfied until I get all my money back. Please give me my money back. I paid for a job you knew you would not have been able to deliver. You truly misled me.

Timeshares by Owners led me to believe that they could sale my timeshare. The representative that contact me was such a smooth talker that he convinced me that they would have my timeshare sold in afew months. They did not tell me that the site they would list my timeshare on would not ever sale. I was led to believe that they would sale it gor 988.00. I was not informed that my timeshare had an offer. When I was contacted by Timeshare by Owner I was told that in order for me to get my timeshare sold, I NEED TO GIVE them more money. I was never told that I had an offer that I could act own. Now they are telling me that they will keep me on a site that they know will never expose my timeshare so it can sale. I am so disappointed. I served my country for 33 years in the U.S.Army and then retire and come home to this kind of treatment. I'm so disappointed and hurt that you would take my money like this.

Here are the specific responses to Mr. appeal for money back on his first marketing purchase.

Client says he was told that his timeshare will sell. In response, we never promise that a timeshare will sell within any certain timeframe or for any particular amount. We promise to market a client's timeshare and that's just what we have been doing. We do not know that we cannot sell a client's timeshare as Mr. contends. We receive offers daily. Total May transmitted offers in fact were $3,683,626. Mr. has been provided with at least two offers thus far.
The job that we were paid to do based on contracts signed in advance of purchases was to market Mr. timeshare, which is exactly what we have been doing.
Mr. canceled his last purchase within the ten-day cancellation timeframe and was issued a refund of $599. There was no entitlement to any other refund based on contracts signed; however, just to resolve matters, I agreed to issue a refund for marketing purchased on November 2, 2016 in the amount of $1249. The first marketing purchase of August 10, 2016 in the amount of $988 will not be issued. Mr. is now placed on the "do not solicit" list and he continues to market his timeshare for both sale and rent.

"The Fastest and Easiest Way to Sell or Rent Your Timeshare"

The star review does not allow for a negative star rating which I would offer for this company. The first lady, Rachel, was extremely nice. However, after reading the material and other reviews we decided not to go with this company. Initially we heard nothing from them. Then two weeks afterwards I began receiving phone calls. The first was a man who offered his sales pitch to which I replied, "I am not interested." He persisted. When asked why I was not interested for the second time, "I told him of the negative reviews I had read online." His response was a rude, we have a "A" rating with the Revdex.com then hung up. I tried to call Rachel. She was out. I called the next day. She was on the phone but would call me. I have not heard from her but have heard from three other ladies in a day and a half period, twice within two hours of each other. I have told them take me off the list, to which they stated we will. They have moved from solicitation calls to harassing calls!

My apologies to Ric C being contacted by Timeshares By Owner on so many occasions. Once should have been enough; however, if the client expresses a possible interest, a follow-up phone call may certainly take place. If a client expresses no interest and/or indicates that they are not interested, then that should be the end of it. Obviously, we want to inform people that we provide the service that we say we do, but there is a professional of way of doing just that.

I will go ahead and place Mr. C on our "do not solicit" list, so that he is not contacted again to purchase marketing.
