            Vivint Account #: [redacted]              Date of Agreement: July 15, 2017                                                   To Whom It May Concern:   I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond.   In her complaint, Ms. [redacted] explains that she attempted to cancel her account within her allotted time period. She explains that she was given 30 days to cancel the account. Ms. [redacted] requests that Vivint cancel her account.   At this time, Vivint is not willing to cancel Ms. [redacted]’s account without penalty.   Vivint’s records indicate that prior to the installation of any equipment, Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Ms. [redacted] completed the required Pre-Installation Survey on July 15, 2017.   During the recorded Pre-Installation Survey, Ms. [redacted] represented that he understood and agreed to the initial term of sixty (60) months.  She also represented that she would pay a monthly monitoring fee of $49.99 each month during that term.  Further, Ms. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement.     Pursuant to the System Purchase and Services Agreement, the customer is required to send a Notice of Cancellation (“NOC”) 30 days prior to cancellation. September 25, 2017Revdex.com of Utah3703 W 6200 SSalt Lake City, Utah 84129 RE:   Consumer Complaint Case #: [redacted]        Complainant: [redacted]        Vivint Account #: [redacted]        Date of Agreement: May 15, 2017          To Whom It May Concern:In her rebuttal, Ms. [redacted] states that Vivint’s representative did not state verbally that she would have 2 separate charges, and told her that the credit check was just part of getting approved.  Ms. [redacted] claims that she was not aware of the equipment charge and that Vivint’s representative did not sell her the product in the most accurate or understanding manner.  Vivint apologizes for any misunderstanding at the time of sale, and as such has agreed to reduce Ms. [redacted]’s monthly services fee by 25% for the remainder of her Agreement term.  Vivint is unable to rescind the credit check run by Citizen’s Bank for the equipment loan.Vivint maintains its position that, by conducting the pre-installation telephonic survey, it made an effort to confirm the terms and conditions of the Agreement with Ms. [redacted]. During this recorded Pre-Installation Survey on May 15, 2017, Ms. [redacted] represented that she understood that her monthly services fee, payable to Vivint, would be $49.99 and her monthly equipment loan payment, payable to Citizen’s Bank, would be $21.31, for a combined monthly total of $71.30 (plus any applicable taxes).  She represented that she was aware that both her loan and her Vivint Agreement have an initial term of sixty (60) months. provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint Ms. [redacted]
alleges that her alarm had gone off numerous times due to a faulty sensor. Ms. [redacted]
desires a credit for the time her sensor was not working correctly. Vivint’s records indicate that
the equipment that was giving Ms. [redacted] issues was preexisting equipment from
another home security system. Vivint does not have a warranty for preexisting
equipment. Ms. [redacted] first made Vivint aware of the system issues on March 14,
2015 a technician was able to replace the preexisting sensors with Vivint
sensors on June 10, 2015. Vivint believes the issue to be resolved. Never the less Vivint will agree
to place a credit to Ms. [redacted]’s account. After calculating the downtime for
two (2) sensors being down the total credit would be $[redacted], Vivint will
however apply a credit for three (3) months of service to Ms. [redacted]’s account
as an act of good will. If Ms. [redacted] is still experiencing issues with her
system I would advise her to call into Vivint to schedule a technician. If you have further questions or

She further alleges that she does not use her appliance adapter, but does not want to spend time and money having Vivint remove it from her home. I am rejecting this response because:It is true that I have been contacted by Vivint and that the situation has been partly resolved.  However, the issue -- which pertains to equipment that needs to be installed -- has not been fully resolved as I have been advised by Vivint that the promised equipment will not be available for at least another month.  Accordingly, I have agreed to follow up again with Vivint in early August to see if the promised equipment is available then.   Until the equipment is delivered or installed, it's inaccurate to say that the situation has been fully resolved.

Concern:I have reviewed the information provided by Mr. R[redacted] and appreciate the opportunity to respond. In his complaint, Mr. R[redacted] alleges that he was misled by a Vivint representative regarding the length of his trial period. Mr. R[redacted] now desires the cancellation of his agreement without penalty.Vivint’s records indicate that prior to the installation of any equipment; Mr. R[redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Mr. R[redacted] was informed he was past his Right of Recession period. Vivint’s Right of Rescission is normally 3 day after the installation of the equipment. During this time the customer can cancel the agreement without penalty.  Mr. R[redacted] called into Vivint’s Customer Loyalty department on August 12, 2015, and alleged that his sales rep offered a 30 day Right of Rescission. Vivint’s representative reached out to Mr. R[redacted]’s sales representative to confirm if this was an offer made. Mr. R[redacted]’s sales representative claims to have not made this offer to Mr. R[redacted]. Vivint is unable to offer a 30 day Right of Rescission period. Cancellation of Mr. R[redacted]’s account is not warranted at this time. Should Mr. R[redacted] wish to cancel his Vivint agreement prematurely, he may pay off the remaining balance on his account – currently $[redacted], however Vivint will take 25% off the payoff amount, bringing it to $[redacted].           To Whom It May Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he requested an upgrade of his service when he was no longer in contract, but had problems with the technician and did not have the new equipment installed. Mr. [redacted] further explains that he requested cancellation of the upgrade, a refund of the $350.00 he had paid for it, and cancellation of his service but Vivint advised that he could not cancel as he was in a contract. Mr. [redacted] desires cancellation of his current service with Vivint. At this time, Vivint agrees to cancel the extended term of Mr. [redacted]’s Agreement which was dependent on the equipment upgrade, and has waived March’s services fee to assist Mr. [redacted] further.  In addition, Vivint will reduce the monthly services fee by $20.00 for the remainder of the initial term of the Agreement.  Vivint refunded Mr. [redacted] the $350.00 he paid for the upgrade by sending a check on February 23, 2018.  Vivint’s records show that Mr. [redacted] signed a System Purchase and Services Agreement on June 26, 2015 with an initial term of forty-eight (48) months and a monthly services fee of $68.99, plus any applicable taxes, during that term.  This initial term will end on June 26, 2019.Vivint agrees to the above resolution and apologizes for any inconvenience experienced in this process.  Mr. [redacted] will not be responsible for the extended term but will remain responsible for the remainder of his initial term. reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she was misled by Vivint’s sales representative regarding the terms of her Agreement.  Ms. [redacted] recently moved from her home and has been unable to cancel her Agreement.  Ms. [redacted] desires cancellation of her Agreement without penalty, a refund of three (3) months of service she was told would be free, and a refund of her payment for service in September 2015.  Vivint’s records show that Ms. [redacted] signed a Purchase and Services Agreement, in which she represented that she understood and agreed to the initial term of forty-two (42) months, and that she would pay a monthly monitoring fee of $[redacted] each month, plus applicable taxes, during that term.  Ms. [redacted] also participated in a telephonic Pre-Installation Survey upon installation of her Vivint system in which she represented that her sales representative had not made any promises to her that were not written on the signed Agreement. Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In Mr. [redacted]’s complaint, he explains that his store was broken into and the Vivint alarm system did not go off and that Vivint has altered his alarm history on that day. As such Mr. [redacted] requests that his account with Vivint be canceled and Vivint reimburse him for the damaged and stolen property.A representative from Vivint has recently attempted to contact Mr. [redacted] via email in an effort to resolve his concerns. Vivint’s records indicate that Ms. [redacted] entered into an agreement with Vivint on August 21, 2015. Mr. [redacted] agreed to an original agreement term of forty-two (42) months and to pay Vivint a monthly service fee is $69.99 plus any taxes each month of that term. By signing the agreement Mr. [redacted] also agreed to section 6: Repair Service which states, “We do not warrant that the System will always detect, or help prevent, any burglary, fire, hold-up or other such event. We do not warrant that the System cannot be defeated or compromised or that it will always operate.” Mr. [redacted] also agreed to section 18: Vivint is not an Insurer; Limitation of Liability which states, “You understand that: (A) we are not an insurer of your premises, property or the personal safety of persons in your premises; (B) you are solely responsible for providing any life, health or disability insurance for yourself and persons who use the System, and insurance on your premises and its contents” Further, Vivint does not allow for any changes to a customer’s alarm history. A customer’s alarm history is recorded on the customer’s panel then sent to data storage. Due to these facts, cancellation of Mr. [redacted]’s account without penalty and reimbursement for damaged or stolen property is not warranted.However, in an effort to assist Mr. [redacted] Vivint is willing to discount Mr. [redacted]’s contractual buyout fee by fifty-five (55) percent if Mr. [redacted] would like to terminate his agreement early. Or give Mr. [redacted] five (5) free months of credit on his account. 2008           To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she fulfilled the initial term of her Agreement and requested cancellation of her account when she moved from her home, but that Vivint would not cancel her account for thirty (30) days.             Vivint Account #: [redacted]              Date of Agreement: July 18, 2009             Date of Addendum: May 15, 2014                                         To Whom It May Concern:                              I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond.   In her complaint, Ms. [redacted] explains that she has been unable to cancel her account. Ms. [redacted] requests cancellation or her account.   At this time, Vivint is willing to remove Ms. [redacted]’s account from collections and it will remain cancelled.   Vivint spoke with Ms. [redacted] regarding her alarm service on May 15, 2014.  Ms. [redacted] represented that she was satisfied with Vivint’s services and that she was interested in extending the term of her agreement.  Based upon this representation, Vivint offered a thirty-six (36) month extension to which Ms. [redacted] agreed.  Indeed, Vivint read the following statement, after which Ms. [redacted] responded affirmatively:   You understand that this call is being recorded, and you agree to extend the term of your agreement thirty-six months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint.   Vivint’s records indicate that Ms. [redacted] stopped making her monthly payments after January of 2016. information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states a sales representative from Vivint are constantly visiting his home attempting to sell him a security system although he has told them to stop. Mr. [redacted] wishes for the sales representatives to cease contacting him.  The sales representative in question is employed by [redacted]. (“[redacted]”).
