She explains that nothing has been done to correct these issues. Ms. [redacted] requests cancellation of her Agreement with no penalty.Vivint agrees to cancel Ms. [redacted]’s Agreement, provided she return the equipment which was installed in her home.Vivint provides a Right of Rescission period immediately following installation of the equipment, during which time Ms. [redacted] would have been able to contact Customer Care to address any concerns from the Pre-Installation Survey and cancel services. Records indicate that Ms. [redacted] made no attempt to cancel services within this Right of Rescission period. Additionally Vivint is able to provide repair services to correct technical issues.Despite this information, Vivint agrees to the above resolution. 25, 2016        To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she recently downgraded her system after multiple issues with the cameras at her home, and was promised a reduced monthly services fee as well as a $10 discount for the next 12 months.  Ms. [redacted] states that Vivint has not yet reduced her monthly fee.  She desires the promised adjustment to her monthly rate, and credit for the overpayment she has made for the past 2 months.  At this time, Ms. [redacted]’s monthly services fee has been adjusted to $59.99, plus any applicable taxes, for the remaining term of her Agreement.  The $10 discount for 12 months was applied, beginning July 2016.  Vivint previously credited Ms. [redacted]’s account for the first 2 months she overpaid.  I have applied a credit in the amount of $92.60 to reimburse the overpayment for the last 2 months.  This credit will cover October’s monthly service fee, and part of November’s.Vivint’s records confirm that Ms. [redacted] agreed to a downgrade of her service in July 2016, so her monthly services fee would be $59.99, plus any applicable taxes, for the remainder of her Agreement term.  Vivint also agreed at that time to give her a $10 credit each month for the next 12 months.  The $10 credit was applied beginning in July 2016; however, the monthly services fee was not updated properly until after September’s payment.  At this time, Ms. [redacted]’s account has been updated to reflect the downgraded and discounted rate, and she has been credited for the overpayment.  I apologize for any undue delay in this process.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal.  July 8, 2016 To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that Vivint’s sales representative agreed to pay off his existing alarm contract with another company and that this has not been fulfilled yet.  Mr. [redacted] also explains that he has had complications with his equipment. He desires $450.00 to pay off his previous security company, an apology from Vivint, and compensation for the delay.  Mr. [redacted] notified Vivint of his concern with the payoff of his previous company on September 30, 2016, and a representative from Vivint has contacted him to resolve this concern.  A payment of $429.50 is being sent directly to the bank account on file to pay off Mr. [redacted]’s previous alarm company.  Mr. [redacted] notified Vivint of his equipment complications via Vivint’s website, and on July 25, 2016 a representative contacted him and scheduled a service visit for July 27, 2016.Vivint would like to apologize for any undue delay in these matters.  A credit of $87.08 has been applied to Mr. [redacted]’s billing account to cover October’s service fee, for any inconvenience this may have caused.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759 attention Department 160 - Legal. reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges her husband was medically discharged from the military and requested cancellation of the account, but Vivint kept the account active. As a result she was unable to pay and the account was sent to the collections. Ms. [redacted] desires Vivint contact the collection agency and resolve this matter. Vivint’s records show that Ms. [redacted] signed a Purchase and Services Agreement upon installation of her Vivint system, in which she represented that she understood and agreed to the initial term of forty-two (42) months.  She also represented that she would pay a monthly monitoring fee of $[redacted] each month, plus applicable taxes, during that term. Ms. [redacted] contacted Vivint on August 22, 2013, to request cancellation of her account due to a military move. During this conversation with a Vivint representative, Ms. [redacted] was informed on the options she had to either move the system with her or provide documentation she was moving out of Vivint’s service area (this includes on base military housing). Vivint did not receive any documentation to properly review the account, so the account remained active. Vivint’s records further show that Ms. [redacted] stopped making her full monthly payments after June 2013. As such, the account was cancelled for non-payment on October 30, 2013, and was sold to an outside collections agency. However a Vivint representative has recently been in contact with Ms. [redacted] and is in the process of resolving this matter. reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that per his Agreement Vivint has charged an additional month of service following his request to cancel services. Mr. [redacted] request a refund for this charge and adjustments to the cancellation policy on Vivint’s website. After further review, Vivint’s records show that Mr. [redacted]’s Agreement with Vivint has been cancelled and he has no further contractual obligation to Vivint.  Additionally Vivint has refunded his final payment in the amount of $57.99 as requested. Vivint’s website directs customers to contact Vivint’s Customer Loyalty department for information on account cancellation. Once Mr. [redacted]’s contacted Vivint’s Customer Loyalty department he was immediately informed of the cancellation clause in question. Ms. [redacted] requests cancellation of her account and a full refund.   Vivint has agreed to cancel Ms. [redacted]’s account and has submitted a refund of $240.98 that will go back into the account within 7-10 business days.   Vivint requires all customers who desire cancellation within their right of rescission period to send in a notice of cancellation via fax, email or mail. 2015          To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she has had many complications with her alarm system.  She explains that Vivint sent her the wrong replacement sensor and then tried to charge her for a different one.  Ms. [redacted] further states that she has not received a Vivint yard sign and has had sales representatives come to her home selling Vivint systems. She states that she stopped paying her monthly service fee and then began receiving calls and emails from Vivint, but she does not believe that any of these calls were made in an effort to resolve her complaints. Ms. [redacted] states that she was not aware Vivint would not warrant equipment that was existing in her home before Vivint’s installation, and that Vivint has refused to replace that equipment for free.  She requests that Vivint cancel her System Purchase and Services Agreement (“Agreement”) and refund payments made for service that was not working properly, in the amount of $350.00.In an effort to resolve this matter, Vivint has waived the past due balance owing on Ms. [redacted]’s account in the amount of $253.96, to cover any system downtime.  Vivint has not yet had an opportunity to repair or replace any defective equipment in Ms. [redacted]’s home.  As such, Vivint is also willing to send a technician to Ms. [redacted]’s home to inspect her system, repair as needed and install up to four (4) points of new equipment and a yard sign at no cost.  Ms. [redacted] may schedule this appointment by contacting Vivint’s Customer Care department at ###-###-####.Vivint’s records show that Ms. [redacted] entered into an Agreement on July 3, 2015 with an initial term of sixty (60) months and a monthly services fee of $49.99 plus any applicable taxes.  This Agreement states that Vivint cannot warrant products provided by a third party used in connection with the system (Section 3).  The Agreement also states that it is the customer’s duty to regularly test the system and to notify Vivint if a problem with the system arises (Section 12).  Vivint agrees to repair the system at the customer’s request and at the prevailing visit fee (Section 5), and Vivint has not yet had the opportunity to schedule a service visit to make any necessary repairs. Vivint first offered to send a replacement part to Ms. [redacted] to avoid charging a visit fee.  A representative from Vivint’s Executive Resolutions team attempted to contact Ms. [redacted] on 4/5/16, 4/6/16, and 4/8/16 as a result of a comment Ms. [redacted] posted on Vivint’s CEO Promise page.  The purpose of these attempts to call and email Ms. [redacted] was to assist her in resolving the issues she described in her comment.    Vivint believes that repair, rather than cancellation, is the proper course of action in this case and would like the opportunity to resolve Ms. [redacted]’s concerns with the system.  As such, Vivint agrees to the above resolution and encourages Ms. [redacted] to contact Vivint and schedule a service visit.  If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: ###-###-####, attention Department 160 – Legal. reviewed the information provided by Mr. G[redacted] and appreciate the opportunity to respond. In his complaint, Mr. G[redacted] alleges that he was misled regarding the term of his agreement.  Mr. G[redacted] desires to be cancelled without penalty.Vivint’s records indicate that prior to the installation of any equipment, Mr. G[redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. G[redacted] completed the required Pre-Installation Survey on April 17, 2013 During the recorded Pre-Installation Survey, Mr. G[redacted] represented that he understood and agreed to the initial term of forty two (42) months.  He also represented that he would pay a monthly monitoring fee of $[redacted] each month during that term.  Further, Mr. G[redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Mr. G[redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement. Cancelation without penalty is not warranted at this time. Vivint recommends that Mr. [redacted] continue to work with his local police department until they have concluded their investigation and have changed the guilty party. After witch, Mr. [redacted] can seek proper compensation from charged party. the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint Ms. [redacted] states that her original payment came out of her bank account sooner then what was agreed upon when she signed her System Purchase and Services Agreement (“Agreement”) and that when she attempted to change the due date of her monthly payments Vivint would not allow her to do so without paying a fee of $30. Ms. [redacted] explains that she has had multiple issues with her service, and she requests cancellation of her Agreement without penalty.Vivint agrees to cancel Ms. [redacted] Agreement without penalty provided Ms. [redacted] pays her past due balance of $160.29.  Vivint’s records indicate that Ms. [redacted] signed an Agreement on August 15, 2014, indicating that she understood and agreed that she would be charged an activation fee of $198.00 and a monthly service fee upon the installation of the system. Ms. [redacted] was not charged a fee for changing her payment due date. Ms. [redacted] was charged a pro-rated amount for the time that she was receiving service between the due date change. Ms. [redacted] was also granted a $15 credit to go towards this service charge as an effort of goodwill. Although cancellation of the Agreement without penalty is not warranted at this time, Vivint agrees to the above resolution.
