Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] alleges that he has done everything in order to have the account closed in January 2016. Mr. [redacted] desires the confirmation of the cancellation date. Mr. [redacted] signed a Purchase and Services Agreement and also participated in a telephonic Pre-Installation Survey upon installation of his Vivint system, in which he represented that he understood and agreed to the initial term of forty-two (42) months. He also represented that he would pay a monthly monitoring fee of $68.99 each month, plus applicable taxes, during that term. In Section 2.4 states:The initial term of this agreement starts on the day this agreement is signed and continues for forty-two (42) months, and will automatically continue from year to year thereafter unless cancelled by either of us in writing no later than thirty (30) day before the end of the original term or any renewal term.Vivint’s records indicate that Mr. [redacted] has not provided Vivint with a written notice of cancellation. In order for Mr. [redacted]’s account to be cancelled in January 2016, Vivint must receive a written notice of cancellation 30 days prior to requested cancellation date. the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] alleges that his equipment is not working and that his System purchase and Services Agreement (“Agreement”) does not notify him of his cancellation fees. After further review, Mr. [redacted]’s Agreement states that he would be responsible to pay the remainder of the Agreement if he chooses to cancel early under Section 13. A copy of his Agreement may be sent to him if he would like. Vivint Inc. (“Vivint”) would also be willing to offer a one (1) month credit for his services not working and is always willing to troubleshoot and schedule technicians for equipment that is not functioning.        To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] alleges to having equipment complications with his security system that have not been resolved, and he believes that the system is not installed correctly.  Mr. [redacted] desires credit for the time he was without service and cancellation of his Agreement without penalty. Vivint’s records show that Mr. [redacted] notified Vivint of his equipment concerns, and Vivint scheduled service appointments to address these issues.  A Vivint Field Service Professional was dispatched to Mr. [redacted]’s home on July 7, 2015, and at this visit the smoke detector was moved to decrease false alarms.  Another service appointment was scheduled for October 9, 2015 to address the panel issues, but nobody was available at the home when Vivint’s technician arrived.  Vivint applied one month downtime credit to Mr. [redacted]’s account in March 2015.Mr. [redacted] signed a Purchase and Services Agreement upon installation of his Vivint system, in which he represented that he understood and agreed to the initial term of forty-two (42) months, and the monthly monitoring fee of $[redacted].  Vivint attempted to resolve Mr. [redacted]’s equipment issues, and cancellation of his Agreement without penalty is not warranted.Vivint’s records show that Mr. [redacted]’s account was cancelled due to non-payment on September 29, 2015, and was transferred to an outside collections agency.  Mr. [redacted] must settle the balance of his account with this outside collections agency at this time.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: ###-###-####, attention Department 160 – Legal. 2015          To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she was misled by a Vivint representative regarding the initial term, and that now she is unable to cancel her Agreement.  She also claims that the equipment is faulty and that there are holes in her door from the installation.  Ms. [redacted] desires cancellation of the Agreement for a reduced payoff amount, or for all of her equipment to work and her door to be repaired.  At this time, Vivint agrees to reduce Ms. [redacted]’s monthly services fee by 50% for the remainder of her initial term.  This will also reduce the payoff amount by 50% should she wish to cancel her Agreement prematurely.  Vivint remains willing to schedule a service visit with Ms. [redacted] to address her issues with the equipment. Vivint provided compensation to Ms. [redacted] on September 10, 2015 for the repair of her door after installation. Vivint’s records indicate that on May 1, 2015 Ms. [redacted] signed an Agreement with an initial term of sixty (60) months and a monthly services fee of $74.99, plus any applicable taxes, during that term. Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint Ms. [redacted] she explains that there was some issues with her billing account. As such she requests a refund of all money paid to Vivint and cancelation of her account.A representative from Vivint has recently attempted to contact Ms. [redacted] in an effort to resolve her concerns. In an effort to help Ms. [redacted] and to resolve this issue. Vivint can cancel the account without any additional charges, if Ms. [redacted] will allow a Vivint technician to come to her home to remove the equipment. After the technician has removed the equipment the account and contract will be canceled and a refund of $170.42 will be issues back to Ms. [redacted].
