Ms. [redacted] requests that Vivint cancel her account.   At this time, Vivint has agreed to cancel Ms. [redacted]’s account without penalty.   However, it should be noted that Vivint spoke with Ms. [redacted] regarding her alarm service on February 26, 2016.  Ms. [redacted] represented that she was satisfied with Vivint’s services and that she was interested in extending the term of her agreement.  Based upon this representation, Vivint offered a sixty (60) month extension to which Ms. [redacted] agreed.  Indeed, Vivint read the following statement, after which Ms. [redacted] responded affirmatively:   You understand that this call is being recorded, and you agree to extend the term of your agreement sixty months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint.   Despite the information mentioned, Ms. [redacted] has no further obligation to Vivint.   If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal.             Sincerely, Nathan *. information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges Vivint was unable to provide both security and internet services to her home. As a result Ms. [redacted] canceled her account with Vivint. Ms. [redacted] further alleges that the Vivint field service professional refused to re-install Ms. [redacted]’s previous alarm system. Ms. [redacted] is now requesting Vivint cover the installation fee of her previous alarm system.Vivint’s records indicate that Ms. [redacted] has a Vivint security system installed on June 1, 2015. Ms. [redacted]’s account was cancelled with Vivint on June 8, 2015. A Vivint field service professional removed Vivint’s equipment from Ms. [redacted]’s home on June 10, 2015. Vivint field service professionals are not licensed to install any other company’s security system, and as such Vivint was unable to re-install Ms. [redacted]’s previous system. A representative of Vivint has recently contacted Mr. Jamie [redacted] in an effort to resolve their concerns. Although Vivint is not responsible for installation fees of other security companies, Vivint has agreed to cover half Ms. [redacted]’s reinstallation fee. Leaving Mr. [redacted] in contract with Vivint. Mr. [redacted] desires cancellation of the Agreement without penalty.  Vivint’s records indicate that the person scheduled to take over Mr. [redacted]’s account canceled the takeover to go with another company with a lower monthly service fee.A representative from Vivint has recently contacted Mr. [redacted], in an effort to resolve these concerns.  Should Mr. [redacted] wish to cancel his agreement prematurely, his payoff amount would be $[redacted]; however, in an effort to assist Mr. [redacted], Vivint is willing to lower his payoff amount by 55%, bringing the total payoff amount to $[redacted]. Mr. [redacted] accepted the discounted buyout amount. September 25, 2017Revdex.com of Utah3703 W 6200 SSalt Lake City, Utah 84129 RE:   Consumer Complaint Case #: [redacted]        Complainant: [redacted]        Vivint Account #: [redacted]        Date of Agreement: May 15, 2017          To Whom It May Concern:In her rebuttal, Ms. [redacted] states that Vivint’s representative did not state verbally that she would have 2 separate charges, and told her that the credit check was just part of getting approved.  Ms. [redacted] claims that she was not aware of the equipment charge and that Vivint’s representative did not sell her the product in the most accurate or understanding manner.  Vivint apologizes for any misunderstanding at the time of sale, and as such has agreed to reduce Ms. [redacted]’s monthly services fee by 25% for the remainder of her Agreement term.  Vivint is unable to rescind the credit check run by Citizen’s Bank for the equipment loan.Vivint maintains its position that, by conducting the pre-installation telephonic survey, it made an effort to confirm the terms and conditions of the Agreement with Ms. [redacted]. During this recorded Pre-Installation Survey on May 15, 2017, Ms. [redacted] represented that she understood that her monthly services fee, payable to Vivint, would be $49.99 and her monthly equipment loan payment, payable to Citizen’s Bank, would be $21.31, for a combined monthly total of $71.30 (plus any applicable taxes).  She represented that she was aware that both her loan and her Vivint Agreement have an initial term of sixty (60) months. the information provided by Ms. [redacted] and appreciate the opportunity to respond. In Ms. [redacted]’s complaint she states that her Vivint Sales representative used unlawful sales tatics and pressured her into signing her System Purchase and Service Agreement (“Agreement”). She states that her Agreement was forged and unaware of the terms of the Agreement. Ms. [redacted] desires cancellation of her Agreement without penalty and an apology from Vivint.Vivint’s records indicate that prior to the installation of any equipment; Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and to confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on July 12, 2016. During the recorded Pre-Installation Survey, Ms. [redacted] represented that she understood and agreed to the initial term of sixty (60) months.  She also represented that she would pay a monthly monitoring fee of $70.99 each month during that term.  Further, Ms. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s Sales representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement.   In an effort to resolve this matter, Vivint will agree to cancel Ms. [redacted]’s Agreement once the Vivint equipment is returned. Vivint apologizes for any inconvenience this may have caused. I am rejecting this response because:It is true that I have been contacted by Vivint and that the situation has been partly resolved.  However, the issue -- which pertains to equipment that needs to be installed -- has not been fully resolved as I have been advised by Vivint that the promised equipment will not be available for at least another month.  Accordingly, I have agreed to follow up again with Vivint in early August to see if the promised equipment is available then.   Until the equipment is delivered or installed, it's inaccurate to say that the situation has been fully resolved.

Concern:I have reviewed the information provided by Mr. R[redacted] and appreciate the opportunity to respond. In his complaint, Mr. R[redacted] alleges that he was misled by a Vivint representative regarding the length of his trial period. Mr. R[redacted] now desires the cancellation of his agreement without penalty.Vivint’s records indicate that prior to the installation of any equipment; Mr. R[redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. R[redacted] completed the required Pre-Installation Survey on July 25, 2015.  During the recorded Pre-Installation Survey, Mr. R[redacted] represented that he understood and agreed to the initial term of forty-two (42) months.  He also represented that he would pay a monthly monitoring fee of $[redacted] each month during that term.  Further, Mr. R[redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Mr. R[redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement.    Mr. R[redacted] notified Vivint of his desire to cancel on August 4, 2015. Mr. R[redacted] was informed he was past his Right of Recession period. Vivint’s Right of Rescission is normally 3 day after the installation of the equipment. During this time the customer can cancel the agreement without penalty.  Mr. R[redacted] called into Vivint’s Customer Loyalty department on August 12, 2015, and alleged that his sales rep offered a 30 day Right of Rescission. Vivint’s representative reached out to Mr. R[redacted]’s sales representative to confirm if this was an offer made. Mr. R[redacted]’s sales representative claims to have not made this offer to Mr. R[redacted]. Vivint is unable to offer a 30 day Right of Rescission period. Cancellation of Mr. R[redacted]’s account is not warranted at this time. Should Mr. R[redacted] wish to cancel his Vivint agreement prematurely, he may pay off the remaining balance on his account – currently $[redacted], however Vivint will take 25% off the payoff amount, bringing it to $[redacted]. She further alleges that she does not use her appliance adapter, but does not want to spend time and money having Vivint remove it from her home. 2017        To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she was incorrectly charged $74.90 for a sensor and has been told by Vivint representatives that this money would be refunded or credited to her account, but that this has not happened.  Ms. [redacted] desires for this overcharge to be corrected immediately.  Vivint’s records indicate that credits have been applied to Ms. [redacted]’s Vivint billing account in the amount of $94.15 as of July 14, 2017 to resolve this matter.  There has been a past due balance on Ms. [redacted]’s account as all monthly services fees have not been paid in full.  However, this recent credit reduced the past due balance on the account from $181.60 to $87.45.  I apologize for any undue delay in this process.  If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In Ms. [redacted] complaint she explains that she was told that Vivint could reinstall another security company’s equipment if she was to cancel her Vivint account. Ms. [redacted] explained that she canceled the account and now request that Vivint reactivate her account until the system is removed and once it is removed to reinstall Ms. [redacted]’s old company’s equipment.A representative from Vivint has recently attempted to contact Ms. [redacted] via email in an effort to resolve her concerns. Vivint has no record of any promises made by the sales representative that were not on the contract. Vivint’s records do indicate that Ms. [redacted] canceled her account on September 12, 2016 and all of her money was refunded back to her. In order for Vivint to reactivate the system as or remove the system as Ms. [redacted] requests a Vivint technician would have to be sent to Ms. [redacted]’s house to remove or reactivate the system. Because Ms. [redacted] has canceled the account and is no longer being charged the technician would remove the equipment. Vivint’s technician are only trained and licensed to work on Vivint equipment, therefore Vivint’s technician cannot install equipment associated with other companies. Due to threats of physical harm to the any technician who cannot reinstall her old equipment Vivint will not send a technician to Ms. [redacted]’s home to remove or to reactivate the system. Vivint will send a prepaid box that the equipment can be put in and mailed back to Vivint. For Ms. [redacted] to have her old system reinstalled, Vivint advises Ms. [redacted] to contact her old security company. 21, 2017 To Whom It May Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. After further review, Vivint’s records show that Ms. [redacted]’s agreement with Vivint was cancelled on October 26, 2017.Vivint’s records show that on August 24, 2009, Ms. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of thirty-nine (39) months.  Vivint spoke with Ms. [redacted] regarding her alarm service on August 21, 2017.  Ms. [redacted] represented that she was satisfied with Vivint’s services and that she was interested in extending the term of her agreement.  Based upon this representation, Vivint offered a forty-two (42) month extension in exchange for a Vivint Sky Control Panel free of charge to which Ms. [redacted]. Indeed, Vivint read the following statement, after which Ms. [redacted] responded affirmatively:You understand that this call is being recorded, and you agree to extend the term of your agreement forty-two months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint.  An appointment was scheduled for a Vivint technician to upgrade and install a Vivint Sky Control Panel on August 26, 2017; however due to the weather, this appointment was cancelled. Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In Ms. [redacted]’s complaint she explains that she has had issues with the service. Ms. [redacted] requests that her account be canceled.A representative from Vivint has recently contacted Ms. [redacted] over the phone in an effort to resolve her concerns. Vivint’s records indicate that this matter is being resolved to Ms. [redacted]’s satisfaction.
