reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges her husband was medically discharged from the military and requested cancellation of the account, but Vivint kept the account active. As a result she was unable to pay and the account was sent to the collections. Ms. [redacted] desires Vivint contact the collection agency and resolve this matter. Vivint’s records show that Ms. [redacted] signed a Purchase and Services Agreement upon installation of her Vivint system, in which she represented that she understood and agreed to the initial term of forty-two (42) months.  She also represented that she would pay a monthly monitoring fee of $[redacted] each month, plus applicable taxes, during that term. Ms. [redacted] contacted Vivint on August 22, 2013, to request cancellation of her account due to a military move. During this conversation with a Vivint representative, Ms. [redacted] was informed on the options she had to either move the system with her or provide documentation she was moving out of Vivint’s service area (this includes on base military housing). Vivint did not receive any documentation to properly review the account, so the account remained active. Vivint’s records further show that Ms. [redacted] stopped making her full monthly payments after June 2013. As such, the account was cancelled for non-payment on October 30, 2013, and was sold to an outside collections agency. However a Vivint representative has recently been in contact with Ms. [redacted] and is in the process of resolving this matter. Ms. [redacted]’s desired resolution is cancelation of the contract.   A representative from Vivint has recently attempted to contact Ms. [redacted] via email in an effort to resolve her concerns. In an effort to help Ms. [redacted] Vivint can cancel the account without any additional charges, if Ms. [redacted] will allow a Vivint technician to come to her home to remove the equipment. After the technician has removed the equipment the account and contract will be canceled. 2010           To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she requested cancellation of her account after her initial term had been fulfilled, and that Vivint continued to bill her for service. Ms. [redacted] alleges that she has now been contacted by a collections agency. She desires for her account to be cancelled without penalty and to receive a copy of her original Agreement. Vivint’s records show that Ms. [redacted] signed an agreement with Vivint on April 24, 2010, in which she agreed that service would continue year to year after the initial term of forty-two (42) months, unless cancelled in writing no less than 30 days before the next renewal term (Alarm System Purchase and Services Agreement, Section 2.4).  A written notice of cancellation was provided by Ms. [redacted] on October 6, 2015, and at that time her account was past due for five (5) months of monitoring service that had not been paid.  A representative from Vivint has attempted to contact Ms. [redacted], in an effort to resolve these concerns.  Ms. [redacted]’s account has been cancelled, and she has no further obligation to Vivint. Vivint has waived the past due balance on Ms. [redacted]’s account, and she will not be contacted further by an outside collections agency.             Vivint Account #: [redacted]              Date of Agreement: December 6, 2013                                                                To Whom It May Concern:   I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond.   In her complaint, she explains that when she moved to her new address and had a new customer take over her previous account at her old address, she cancelled over the phone and failed to send in a notice of cancellation (“NOC”). She further explains that she was being charged for her old account from December 2015 to present.   Vivint has agreed to refund Ms. [redacted] the amount of $373.53 and this will go back into her account within 7-10 business days.   Vivint requires all customers to send in a NOC via email, mail or fax 30 days prior to cancellation as documented in the signed agreement. 2015          To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she has had many complications with her alarm system.  She explains that Vivint sent her the wrong replacement sensor and then tried to charge her for a different one.  Ms. [redacted] further states that she has not received a Vivint yard sign and has had sales representatives come to her home selling Vivint systems. She states that she stopped paying her monthly service fee and then began receiving calls and emails from Vivint, but she does not believe that any of these calls were made in an effort to resolve her complaints. Ms. [redacted] states that she was not aware Vivint would not warrant equipment that was existing in her home before Vivint’s installation, and that Vivint has refused to replace that equipment for free.  She requests that Vivint cancel her System Purchase and Services Agreement (“Agreement”) and refund payments made for service that was not working properly, in the amount of $350.00.In an effort to resolve this matter, Vivint has waived the past due balance owing on Ms. [redacted]’s account in the amount of $253.96, to cover any system downtime.  Vivint has not yet had an opportunity to repair or replace any defective equipment in Ms. [redacted]’s home.  As such, Vivint is also willing to send a technician to Ms. [redacted]’s home to inspect her system, repair as needed and install up to four (4) points of new equipment and a yard sign at no cost.  Ms. [redacted] may schedule this appointment by contacting Vivint’s Customer Care department at ###-###-####.Vivint’s records show that Ms. [redacted] entered into an Agreement on July 3, 2015 with an initial term of sixty (60) months and a monthly services fee of $49.99 plus any applicable taxes.  This Agreement states that Vivint cannot warrant products provided by a third party used in connection with the system (Section 3).  The Agreement also states that it is the customer’s duty to regularly test the system and to notify Vivint if a problem with the system arises (Section 12).  Vivint agrees to repair the system at the customer’s request and at the prevailing visit fee (Section 5), and Vivint has not yet had the opportunity to schedule a service visit to make any necessary repairs. Vivint first offered to send a replacement part to Ms. [redacted] to avoid charging a visit fee.  A representative from Vivint’s Executive Resolutions team attempted to contact Ms. [redacted] on 4/5/16, 4/6/16, and 4/8/16 as a result of a comment Ms. [redacted] posted on Vivint’s CEO Promise page.  The purpose of these attempts to call and email Ms. [redacted] was to assist her in resolving the issues she described in her comment.    Vivint believes that repair, rather than cancellation, is the proper course of action in this case and would like the opportunity to resolve Ms. [redacted]’s concerns with the system.  As such, Vivint agrees to the above resolution and encourages Ms. [redacted] to contact Vivint and schedule a service visit.  If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: ###-###-####, attention Department 160 – Legal. Ms. [redacted] desires for the account to be cancelled, and for Vivint to stop charging her for returned payments. A representative from Vivint has recently been in contact with Ms. [redacted] in an effort to resolve these concerns. At this time, Vivint is willing to remove the payment information to prevent further returned payment fees, however Ms. [redacted] is still responsible for the remainder of her agreement. Vivint did receive Ms. [redacted] request for cancellation, however the account is not eligible for cancellation as of this moment. Vivint’s records show that on June 30, 2014, Ms. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months.  As such, the initial term of the agreement does not end until December 30, 2017. If Ms. [redacted] wishes to cancel the service prematurely, she may payoff the remainder of the agreement. This balance is currently $752.85. Despite the above information, in resolution to this matter, Vivint will remove the payment information from the account to prevent further ‘return payment’ fees from accruing. The account will remain active and Ms. [redacted] is still responsible for the monthly service fee and any past due amount. information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint Mr. [redacted] explains that he feels he was misled by his Vivint representative about the terms of his System Purchase and Service Agreement (“Agreement”). Mr. [redacted] requests cancellation of his Agreement without penalty. Should Mr. [redacted] wish to cancel his agreement prematurely, his payoff amount would be $1781.67; however, in an effort to assist Mr. [redacted], Vivint is willing to reduce his payoff amount by 50%, bringing the total payoff amount to $890.83.  Alternately, Vivint will offer to reduce Mr. [redacted]’s monthly rate by $10.00 for the remainder of his initial term if he wishes to continue with his current Agreement.  If Mr. [redacted] wishes to take advantage of either of these offers, I would advise him to contact a Vivint Legal Assistant at ###-###-####.Vivint’s records indicate that prior to the installation of any equipment, Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an Agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Vivint’s records further indicate that Mr. [redacted] signed a System Purchase and Services Agreement on July 16, 2016.
