The billing and service address associated with the account is *** *** *** *** *** *, Chicago, IL 60612. Afni mailed the initial notice of the account on March 27, 2017. On March 31st, the consumer spoke to an Afni representative and stated she would go over her bills and see what she can set up with Afni to resolve the debt. On May 21, 2017, Afni furnished the credit reporting agencies with notice of the account. On June 22nd, the consumer set up a one-time payment arrangement to pay $on June 30th. The consumer stated she would set up a payment arrangement when she called in to make her $payment on June 30th. On August 25th, the consumer called an Afni representative and set up a new payment arrangement to pay $on September 8th and $on September 23rd to pay the account in full. Afni has never received payment from this consumerOn September 12, 2017, Afni received this complaint. In response, Afni ceased communication and initiated an investigation. Afni has provided bill copies for the consumer's reference. To address the consumer’s concern, the account has been updated as potential fraud as the consumer stated she had never had service with *** Afni encourages the consumer to visit ***'s fraud website at https://www.***, which discusses the process and documentation needed for the fraud investigation. Additionally, the consumer should contact ***'s Identity Theft Department at *** if she believes the account is not hers or feels this is a case of identity theft. Afni will send a request to the credit reporting agencies to remove the account from the consumer’s credit report. Please be aware that it can take the credit reporting agencies anywhere from to days to update consumer credit reports. collections on the balance of $216.60. The account is for satellite service established on July 16, 2011, until DirecTV considered the balance delinquent on August 16, 2015. The billing address associated with the account is *** *** ***, CT 06457, which is also the service address. Afni mailed the initial notice of the account to the consumer on March 18, 2016. On April 17, Afni began furnishing the credit reporting agencies with notice of the account. On September 20, DirecTV requested Afni to cease collections and return the account. On September 25, Afni requested all credit reporting be removed from the consumer’s accountOn April 14, 2017, DirecTV forwarded the subject account, DirecTV account #: ***, Afni, Incaccount #: 064708066-01, with Afni for collections on the balance of $216.60. The account is for satellite service established on July 16, 2011, until DirecTV considered the balance delinquent on August 16, 2015. The billing address associated with the account is *** *** ***, CT 06457, which is also the service address. Afni mailed the initial notice of the account to the consumer on April 15, 2017. An Afni representative called the consumer on April to discuss the account. The consumer disputed the account during the phone call. In response, Afni ceased communication and initiated an investigation. As a result of the investigation, Afni reached out to DirecTVAfni mailed a verification letter to ** *** *** ***, Bristol, CT on April On May 21, Afni furnished the credit reporting agencies on the disputed status of the account. On May 24, the consumer spoke to an Afni representative and again disputed the account. In response to the consumer's dispute, Afni reached out to DirecTV to confirm the charges on the account, and to provide validation documents for the account. On June 1, DirecTV informed the consumer via email that a refund was sent to the consumer, and a payment or any payments that were applied to the account were returned; therefore the amount was charged back to the account. On June 5, Afni received a dispute from the credit reporting agencies, reviewed all relevant information, and responded appropriately. On June 9, Afni mailed a validation letter to the consumerAdditionally, that same day, Afni mailed the account billing statements to the consumer as validation on the account. On June 20, 2017, Afni received this complaint. In response, Afni ceased communication and initiated another investigation. Afni has attached a copy of the account billing ledger previously sent to the consumer to this response; this are provided as validation of the account. To address the consumer’s concern, the subject account has not been purchased by AfniAfni received the account from DirecTV and acts as an agent on behalf of DirecTV, therefore the consumer would not have a contract with Afni. As a courtesy to the consumer, Afni will send a request to the credit reporting agencies to remove DirecTV account #: ***, Afni, Incaccount #: 064708066-from the consumer’s credit report. However, this does not mean that the account is not due and owing, simply that Afni will no longer furnish the account to the credit reporting agencies. Between May 25th and May 30th, Afni received two disputes from the credit reporting agencies, reviewed all relevant information, and responded appropriately. On May 30th, Afni received a letter from the consumer disputing the account and requesting Afni cease communication with the consumer. In response, Afni ceased communication and initiated an investigation. As a result of the investigation, Afni reached out to ***Afni mailed a letter confirming the consumer’s request that Afni cease communication in addition to a validation letter to *** *** *** *** ** ***, which is the same address the consumer listed on the complaintAdditionally, that same day, Afni mailed the account billing statements to the consumer as validation on the account. On May 31st, Afni updated the credit reporting agencies on the disputed status of the account. On July 23, 2017, Afni received this complaint. In response, Afni continued to cease communication and initiated another investigationAfni has attached copies of the account billing statements previously sent to the consumer to this response; these are provided as validation of the account. To address the consumer’s concerns, the account has not been purchased by Afni. Afni received the account from *** and acts as an agent on behalf of ***; therefore, the consumer would not have a contract with Afni. Additionally, when a consumer submits a dispute through the credit reporting agencies, Afni responds directly to the credit reporting agencies. As the consumer has requested, Afni will no longer contact the consumer about this account. Afni will send a request to the credit reporting agencies to remove the account from the consumer’s credit report. Afni mailed the initial notice of the account on or about March 29, 2017, to 7* *** ***, Plainview, NY 11803, which is also the same address the consumer listed on her complaint. On May 14, 2017, Afni furnished the credit reporting agencies with notice of the accountOn January 12, 2018, Afni received this complaint. This was Afni’s first contact with the consumer. In response, Afni ceased communication and initiated an investigationAfni has attached copies of the account billing statements to this response; these are provided as validation of the account. To address the consumer’s concern, the subject account has not been purchased by Afni. Afni received the account from *** and acts as an agent on behalf of Sprint. Per the consumer’s complaint, she was living in a mental health facility since 2015. However, the service was opened in December of and remained active until May of 2016. The initial notice was sent to her mailing address she has on file and which she confirmed in her complaint. Afni did not receive any notice of returned mail, and as a result, can infer that the notice of rights was receivedAfni has attached this letter per the consumer’s complaintIn regard to the consumer's concerns about the age of the account, the statute of limitations applies to the legal remedy taken in a court of law. Afni does not file suit on collection accounts. With regard to the consumer’s statement that Afni has re-aged the account. Afni has furnished accurate information to the credit reporting agencies at all times. The credit reporting agencies require Afni to furnish the date Afni received the account as the open date. However, the age of obsolescence for credit reporting is determined by the date of delinquency furnished to the credit reporting agencies. When Afni furnished information on the accounts, it furnished the date of delinquency as March 27, 2017. Therefore, Afni has not re-aged the account. Additionally, the state of New York does require a license to collect on a debt. Afni understands that the consumer is seeking removal of this tradeline from their credit report; however, to remain in good standing with the credit reporting agencies, Afni’s policy is to furnish the accurate status only. So, I will not accept their response saying, I still owe money when I clearly do not. There is nothing due to *** or Afni, Inc. Please remove the inaccurate item from my credit reports. On March 18, 2018, Afni furnished the credit reporting agencies with notice of the accountOn March 22, 2018, Afni received this complaint. In response, Afni ceased communication and initiated an investigation. We have validated the subject account with *** Communications. Per *** Communications, the charges are for unpaid service fees for the *** Digital Telephone Pac, long distance charges, and unreturned equipment fees. *** Communications address is 6205-B Peachtree Dunwoody Road, Atlanta, GA 30328. To address the consumer’s concern, the subject account has not been purchased by Afni. Afni received the account from *** Communications and acts as an agent on behalf of *** Communications. Afni does not have the ability to sell this debt. Additionally, Afni has no business relationship with *** Recovery. There were no attachments included with this complaint and Afni has not received any documents from the consumer showing where *** Communications stated the debt is not owed.
