customer. We called out to the customer today, however, she was not able to answer the call. Our representative was able to leave a detailed voicemail advising of her name, position, and the purpose of her call. We advised the customer our sincere desire to follow up with her directly regarding her complaint. We requested for her to follow back up with us, and return our call at her earliest convenienceWe reiterated our strong desire to resolve the expressed concern in full. We reviewed the damage complaint for the customer who requested Roadside Assistance for his *** ExcursionThe customer alleged his vehicle sustained body damage after Roadside ServiceAfter investigating the complaint we were not able to determine that damage to the vehicle was a result of
the Road ServiceAgero provides Roadside Assistance for the customer’s insurance company. The customer called for Roadside Assistance after his vehicle went off an icy road and slid down an embankment. Agero contacted an independent Service Provider (tow company) to extricate/winch the vehicle back up on to the roadThe customer later contacted Agero and submitted a damage complaint stating that his vehicle had damage on the fender and running board. He stated that the vehicle did not have damage before the accident and he was seeking approximately $3,reimbursementThe customer submitted photos of the vehicle taken after the serviceThe customer submitted photos of the road and the embankment where the vehicle came to rest by the tree line. The customer was not able to provide photos of the condition of the vehicle prior to the service. The photos submitted show no evidence of winch cable markings on the vehicle as stated in his complaintThere was no evidence provided that the Service Provider caused the vehicle to come into contact with the trees during the extricationThe customer signed and the Service Provider submitted a copy of a damage waiver signed by the customer prior to the extrication. There is a notation on the damage waiver that the customer hit a tree and a snatch block is required for winch/extricationBased on the evidence provided by the customer and Service Provider, we were not able to determine that the Service Provider did anything negligent to cause damage to the customer’s vehicleThe customer was contacted by phone and email where he was provided with a detailed explanation

Good afternoon, Please be advised that Agero stands firm on the original decision to deny this complaintIf the customer has additional information that can support their complaint, we are more than happy to re-review the fileWith the information we have, we are unable to prove that the Service Provider damaged the customers vehicle

Good morning,We reviewed the customer's complaint. The customer contacted our company and alleged that the towing company damaged his vehicle. In order to review a damage claim, we require photos and evidence in order to hold the service provider responsible. The customer did
not provide any photos of damages or evidence before the repair work was completed. The service provider reported no problems with the tow at the time of service. Without any photos or documentation of alleged damage, we were not able to hold the service provider responsible for repairs to the the customer's vehicle. The customer was advised that photos and an estimate were required in order to make a fair decision

Good afternoon, Our company stands buy the original decision. We are not an insurance company and we cannot hold the service provider liable without additional evidence to support the allegationThe photos provided clearly depict rusted metal and there is no way for our company to know how long this amount of rust has been present. However, metal rusted to this degree did not occur overnight. If the customer believes that the service provider caused damage they can pursue the service providers insurance company directly. We will be glad to provide the customer with the service providers insurance information if they choose to contact us for that information

Good afternoon, We have reviewed the recent damage complaint for *** ***, whorequested a road side service for her *** Ms*** reported damageto her Power Control Module as a result of the roadside serviceThe finalliability decision is that we are denying the customer's
damage complaintThe reasons behind the decision are listed below: • Damage is to the Power Control Module• The vehicle was being serviced due to a no start • The customer states that the date of service was 7/11/at her home.• The customer states that the Service Provider arrived with a jump box• The customer states that the Service Provider connected the jump box and toldher to start the car• The customer states that the lights went "crazy" and the hornsounded immediately • The customer admitted that she had the vehicle jump started by her neighboron 7/8/15, which was prior to this roadside assistance service • The damage notes indicated that the customer previously jump started anothervehicle resulted in additional issues with her vehicle• Our system indicates that the customer had a jump start service on 7/7/and7/8/• The customer’s vehicle was experiencing ongoing issues with the batteryresulting in multiple jump starts• There isn’t any physical evidence that this damage occurred during thejump-start from 7/11/• We are unable to honor the damage complaint as there is no evidence ofnegligence on the part of the provider

Good afternoon,Agero provides Roadside Assistance for Automotive and Insurance companies utilizing independent Service ProvidersWe do not have any employees that provide road service or towing servicesIn this instance the independent Service Provider denies the customer's allegations that
they were responsible for damage or repairs to the customer's vehicle. Agero is not an an insurance company and we cannot take funds from the service provider unless there is clear evidence that they caused damageIn this instance the damage was reported to our company five days after the service was provided to the customer. There is no unbiased witness to the damage claim and the Service Provider denies that they caused any damage. The Service Provider maintains there own insurance carrier to defend against such claims. We will be glad the customer with the Service Provider's insurance carrier if they choose to pursue the damage claim directly with them

I have been trying to work with both the towing company that damaged my vehicle during the service as well as Agero. I do not get returned phone calls when I leave a message asking to be called backI have evidence showing on 1-8-my vehicle had exhaust work (right where the damage caused by the towing company is on my vehicle) and an oil changeThere was no damage to that area on 1-8-On 1-9-my water pump froze up while driving and I needed to pull over, using my roadside Assistance for the first timeAgero is contracted service through my Insurance CompanyMy vehicle was picked up by the towing company that agero assigned, I did not have a choice in this matterIt was picked up after dark on a side service road and I and my mechanic were there at time of pick upthe gentleman who was driving tow truck(flat bed) stated he was slow due to only being on the job less than day and "I did not get enough training"Mechanic had to assist him in loading my suburban onto the flat bed, as he was unable to get it fully on without helpHe did not even know how to secure the truck onto the flatbed after it was loadedOnce loaded, he needed to put it into his GPS how to get to the shopIt was loaded so I left with my mechanic to meet truck at the shopAt the shop the truck was unloaded on the street with passenger side away from shop (side of damage). The truck was fixed the next day, however no one had any reason to walk to the passenger side, as it was the water pump that was outI picked truck up at shop on 1-10-at dark and drove my daughter to needed placeWe had a snow storm and the roads were full of salt and liquid melt. It was dark when I noticed damageDent, scratches, cracked and tore up paintThere was a twig from a tree embedded in the cracked paint that is identical to the tree that was freshly damaged at the sight of pick up by tow truck. Tow truck had to back into driveway to turn around to get outTow truck driver states he turned around in an open field and there is no open field anywhere around siteI have photos of freshly damaged tree, with twigs exactly like one embed in truck paintThe man who owns driveway states tree was not damaged before this incident and he saw where I was stranded waiting for tow truck for several hoursThis company asked me to get an estimate, the appraiser stated that there was tree scratches and fresh sap on truckI take immaculate care of all of my vehicles and my insurance agent agreesI did have truck fenders and bottom completely redone and replaced when I purchased truck in to get rid of rustI immediately fix every thingI have proof was not damaged prior to this incident, proof the tree involved was at pick up sits. I called my Roadside Assist, something I pay a premium forthey sent a tow truck of their choice and now my truck is smashed upall of the evidence falls into place. I have even asked to have them bring the tow truck to the side, load my truck and the damaged tree will line up with damage on truckHe had to back into the driveway and take a sharp left, swinging the back of my truck into the tree, why else would a piece of the same tree be stuck in the paint? Yes there is underlying rust in pictureI took photos the next day in the light. I talked with a body guy and he states that salt and liquid melt will rust exposed metal within hoursI sent them pictures of hours later with slight under rust and hours later spot was much rustier due to not wanting to was the branch out of the paintProof it rusts fast. this company has not contacted anyone of the phone numbers I have given them, they will not line up my truck on a flatbed to see that the damage matches, they did not call the appraiser who did the estimate. they are soley going on photos sent and the tow truck driver's lie of turning around in a fieldThey have sent no one to even look or give the ide a thought. I have pleaded with them, as all I want is the right thing donebut they refuse to even look any furtherThey should talk to someone about how fast open exposed metal rusts, since that is the only thing they are basing their denial on. I have professional people who state it was not damaged on 1-8-

Good afternoon,We have reviewed the recent damage complaint for Mr*** who requested roadside service on his *** *** ***Mr*** stated that the right side rear view mirror on his vehicle was damaged during the roadside serviceThe final decision is that we are denying the
damage complaint. The reasons behind the denial decision are listed below: • Damage is to the right side rear view mirror• The vehicle was being serviced due to transmission issue • The customer was present during the service but did not observe the damage occur • Customer discovered the damage days after the date of service and after he picked up vehicle from the repair facility. • The provider reported no issues with the tow service and that they towed the vehicle with a flatbed which they loaded the vehicle front first. • Upon reviewing the information submitted, the damage to the right rear view mirror is not consistent with the tow service. The damage is not in the work space of the pro. • The photographs submitted by the customer show the mirror only is damaged there isn't any damage to the case of the rear view mirror. We are unable to honor the claim because there isn’t any evidence that the provider did anything negligent to cause the damage to the customer’s vehicle

This document does clearly date when the damage was documented. The damage is absolutely consistent with tow damageIt is clearly a rock chipLarge truck (such as tow truck) tires throw rocks up of roadsEspecially when traveling mph down the freeway.Regards,
