Our insured has failed to cooperate with our investigation per the terms of the auto policy. As a result, we have abated coverage. We spoke to the claimant this morning and explained same. An abatement letter will be issued to him today as well. If our insured cooperates with
our investigation in the future, we will re-open the file/investigation at that time

This claim was denied due to the fact the driver of our insured vehicle is an excluded driver on the policy. On February 23, 2017, our claims department spoke to the claimant and explained the denial. A denial letter was also sent that same day

Thank you for providing the claim number. A review of the file indicates we received a copy of the rental bill in the amount of $554.55. Payment in that amount was issued to *** *** on July 28, and was mailed to *** *** *** *** Houston, TX 77094. The payment is coming from our office in Chicago so it will likely take 5-business days to arrive in Houston

Our investigation reveals the claimant's mother reported the loss at which time she advised her son had changed lanes and was struck by our insured. We advised her we needed to speak with our insured to obtain his version of the accident. Per our insured, the claimant changed lanes and
struck his vehicle. Our final investigation reveals we have found that majority liability rests with the claimant for attempting an improper lane change. We spoke to the claimant today and explained we were denying liability as a result of the claimant attempting an improper lane change. A denial letter will also be mailed out to the claimant today as well

The claim was reported by the lienholder. We still have a duty to confirm the facts of loss with our insured prior to authorizing payment. The phone number we had on file was not the same as the one provided by the lienholder so we did attempt to contact the insured on several
occasions. We were able to obtain his statement on August 23, 2017. Payment less the insured's $deductible was issued today, August 28, and mailed to the lienholder

The claim representative did not offer a car the second timeShe said to deal with the first shop they sent me to so they can find me another shopThe representative said her job was to write checks nothing elseI asked her for a check so I can take it to a shop I picked she laughed and said why would I do that if they already started repairsShe also said they will only pay for repairs if it was the sensor that was brokenShe didnt understand that all mu sensors got hit since my whole bumper was hitI just want the repairs finished the accident was in August.

Our investigation reveals the claim was handled under a Reservation of Rights due to an undisclosed driver operating the insured vehicle at the time of the loss, and our insured has also failed to contact us to provide his recorded statement regarding the undisclosed driver’s use of his
vehicle. Our policy is a “Limited Liability Policy”. In order for any “family member” or resident of the insured’s household to be covered under Part A-Liability, they must be disclosed on the application and listed on the policy. If the vehicle is being driven by a “family member”, resident or non-resident to whom the vehicle is furnished for their regular use and was not disclosed on the application, then coverage will be denied under Part A-Liability. Our claims department attempted to contact our insured by telephone as well as in writing. Unfortunately, our insured has failed to assist with our pending coverage investigation. Per the terms of the policy, we are entitled to our insured’s complete cooperation throughout the handling of the coverage investigation. Therefore, abatement letters were sent to both our insured and the complainant. Should the insured cooperate with our investigation in the future, we will re-evaluate the claim at that time

Since receipt of this notification, we have confirmed our insured's involvement in this accident. We spoke to the claimant on 9/26/at which time payment was issued, and this matter was resolved

I am rejecting this response because: I have the photos to prove your insurer hit me!!! This is ridiculous it took forever just to get a response from your insurer and then for him to just lie about itYou didn't even bother investigating the case, immediately after his statement you all were quick to deny my response but yet when I try to call you all I get send to voicemail with no one contacting me backYou all know your insurer lied and are still continuing to back him upI do not accept your denial because you have no legit justification for it besides the word of your insurerHe knows he hit me and even accepted when we spokeNow he seems to tell y'all a different story and you don't even bother looking at my photos or anything where it clearly shows he hit meAny person in their right mind who sees them will know I was backed out first and almost out of my parking spot when your insurer was not even paying attention and backed into me thus hitting the side of my carIf that wasn't the case and supposedly I hit him then why is my car damaged from the side?? This makes no sense!Believe me I wouldn't be here trying to get a response from you all if I was the one at fault.
This is a terrible insurance company who seems to be doing the same to everyone who gets hit by your insurers.

This is in response to your inquiry on your file number *** and the complainant *** *** Ms*** is a 1st party insured who wants to have her claim resolved. The loss occurred on August 14, and it was reported to American Access Casualty Company on August 15, 2016.
At which time our investigation into the loss was opened. An estimate of repairs was completed for the amount of $594.10. The claim was approved and paid on August 31, for the amount of the estimate of $minus her $deductible for a net settlement of $94.10. She has been advised to contact the repair facility to set up her vehicle to be repaired. The claim has now been concluded. Sincerely yours,American Access Casualty Company *** ***Claims Manager

Our claims department spoke to the consumer today and has agreed to overnight the rental reimbursement check to them due to our delay in getting reimbursement issued in a timely manner

There was a delay in issuing payment due to a lapse in coverage and we needed to confirm that the policy was indeed in force on the date of loss. According to the lienholder, the insured was behind on her payments and on March 1, 2017, they advised us they would be repossessing vehicle.
On March 3, 2017, the lienholder provided a completed Affidavit of Motor Vehicle Repossession and payment was issued to them

We were awaiting our insured's statement before we could proceed with payment of the claimant's property damage claim. WE have accepted liability. Our claims supervisor spoke to the claimant and explained same. The claimant has opted to proceed through his own insurance
company. We have offered to advance his deductible so long as he can provide verification from his insurance company regarding the amount of his deductible. We also agreed to reimburse the claimant for his rental vehicle, and we offered to set up a reservation for him via *** Rental
