Hi there,At Kickstarter, we're equally frustrated and disappointed when a project doesn't come to fruitionAllowing creators to take risks and attempt to bring something new to life is the backbone of what we doHowever, we also understand that there is an inherent level of risk in any creation process. Kickstarter is built around minimizing that risk through all-or-nothing funding, which allows the collective voice of the people to decide which projects reach their goalOn our end, we review projects, uphold our rules, practice careful governance, and use anti-fraud filtering. Still, despite a creator's best efforts, some projects won't always come together as plannedIn these situations we make ourselves available to creators to help however we can, and we encourage them to be as open as possible with their backers about the obstacles they faceBut no matter our efforts, projects will sometimes fail to come together as planned and backers will sometimes be disappointed in outcomesWe strive to constantly learn from this, and to make sure that expectations are appropriately set for backers (like on our Trust & Safety page). That being said, we expect all members of the Kickstarter community to act with honesty and opennessOur Community support and Integrity teams monitor Kickstarter's system and review reports received from usersSome actions taken may include: Reaching out to creators and reminding them post project updates as well as respond to backer messagesRevoking account privileges, including the ability to run another campaign on Kickstarter, until rewards have been fulfilled or an update has been posted for backersSuspending or restricting account privileges if there is sufficient evidence of abuse against our system or trust of others. We track creators' fulfillment histories as comprehensively as possible - from snags to more serious complications - to help ensure creator accountability While we can't speak to the nature of specific projects that have been approved or declined, we're constantly working on improving our vetting process for creators and we are grateful for the feedback that folks like you provide. It’s our mission to make sure that Kickstarter is a place where folks can launch and support projects with confidence and excitement. Best,Kickstarter

I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
This project in question is Under the DogAfter several months of silence once it was funded, they suddenly changed creators as is evident by the current creator having joined months after the project was funded.Yes, the contract was with the previous creator though but technically, not the current one

Kickstarter should do more in cases like this where the consumer has been defrauded out of his money and the project creator(s) do not even make an offer of refund, they should be held equaly as liableThe terms they like to refer back to were never presented to me nor agreed upon when joining kickstarter, I know of many other backers who feel the same about this matter as they also have been defrauded out of their money(s) There are a total of THREE projects which were never brought to life despite full financial backing and their perspective products never produced, I have left a message for other backers to email me so a class action suit can be brought against Kickstarter and the failed project creatorsA complaint was also sent to New York Attorney General's office

I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
In the response from Kickstarter I received no new information in regards to the status of the product that I payed for and no offer of a refund for said product.Either one of these two requests would have been enough to resolve the issueSince I am still out the $I payed for a product I will never receive, I feel like I have been scammed and will never back another project on Kickstarter and advise everyone I can do the same

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
[The resolution is for Kickstarter to remove our project from the Kickstarter website and they have not done soRemoval from the Kickstarter website is necessary because the negative and disparaging comments on the Kickstarter website will otherwise be seen indefinitely by potential customers, investors and our communityThese comments are the direct result of Kickstarter's irresponsible generation of innuendo via their (literally) incomplete and disparaging email sent to our project's pledgers.Kickstarter continues to take no responsibility what-so-ever to clarify, provide comment or explanation for their actions that have generated this damaging innuendoAfter approving our project, we launched it exactly as we had described it to KickstarterKickstarter then suspended our project without notice or explanation and then sent a disparaging and suggestive email (attached) to pledgers from their "Integrity Team." The text of the email is literally incompleteIt says we have "demonstrated one or more of the following:" but in fact provides no list of the "following." It further states that they "find strong evidence" that we are "misrepresenting" ourselvesThe email generated innuendo and negative comments on the Kickstarter website, which remain accessible to the public and search enginesWe have no ability to defend ourselves or respondThis is wholly unfair and damaging to our companyThey should not be allowed to continue to capriciously, and without consequence, damage our company's reputation by keeping the project and comments on their website. Kickstarter should remove the project and comments form their website ]

Hi there,For each project, we’re presented with the same information that backers are and we hold each project accountable to the same rulesThis is a space where creators are able to test and find support for new ideas, not to present items that already existWe’re unable to vet whether each idea is completely realistic or whether a creator has qualifications to finish their projects; that’s up to backers to decide. For more information about backing a project on Kickstarter, see our Trust page: ***Best,Kickstarter Support

there, We're sorry to hear that you did not receive your reward from the earlier *** projectAs each project on Kickstarter is the responsibility of its creator, Kickstarter does not manage or facilitate the fulfillment of rewards, including tracking deliveries or offering replacementsAdditionally, Kickstarter cannot offer or issue refunds on behalf of creatorsAgain, since funds are transferred directly to a creator following the successful funding of their project, it's up to that creator to determine whether or not to issue a refund. In this case, you'll need to continue reaching out to *** if you still do have questions about your reward or the possibility of receiving a refundKickstarter cannot take action on behalf of a creator, nor can we force this creator or any other to take a specific actionThat said, we have reached out to *** to relay outstanding concerns from you and fellow backers, and we have encouraged them to follow up with more informationWe hope they will offer more insight soonThanks for your understanding. kickstarter is not following its owns rules...creators not held accountable and can have backers accounts locked for daring to question the creator over misleading actions, fraud, lies, etc my account was locked because I kept asking for the creator to respond to legitimate concerns...yet, he would not and said he would not...wanted happy comments only plus he gave me a veiled threat to ship my tstands first...in other words either broken or not at all I still have no tstands..others are complaining again on the sitebut ks sits back and does nothing, ks got its money..so move on backers great business model..no responsibility

I followed your steps from the last message and copied all the messages and sent it through kickstarter but they still haven't responded but I did get an email from Kickstarter integrity asking why I reversed the transaction so I copied everything again and emailed againI'm not sure how to fix the communication here because it sounded like kickstarter didn't know this was going on even though I'm using the platform to send my messages and I keep asking what next steps I can take since Baubax refuses to contact me back I asked them if they refunded to kickstarter to offset and they just don't answer what is going on

Hi there,We realize how frustrating this experience is for you, and we will be sure to pass your feedback along to the rest of the team hereIn general, we expect creators to fulfill rewards, offer refunds if they’re unable to complete their project, and communicate with backers at every step along the wayWhile Kickstarter is the platform for this agreement, we are not a part of itWe do not investigate a project creator’s ability to complete their project, nor do we facilitate refunds or the fulfillment of rewardsWhile in most cases backers will find that rewards are delivered as promised, it’s also important to realize that some projects might not fulfill as planned. In regards to this project, we've reached out to the creator to encourage them to communicate more effectively going forward and to respond to messages from backers like youAside from this, we cannot force a creator into action, including posting messages or even issuing refundsHowever, in cases where we find that people are abusing the system or the trust of others, we do not hesitate to suspend their account or restrict certain account privileges, like launching another project. When you back a project on Kickstarter you enter into an agreement with the project creator, as described in our Terms of Use: ***These terms outline the responsibilities of backers and creatorsThis information can serve as a basis for legal recourse if a creator doesn’t fulfill their obligations under the agreementWe hope that backers will consider using this provision only in cases where they feel that a creator has not made a good faith effort to complete the project and fulfill.Best,Kickstarter Support

Hi there, We hate more than anything when a project doesn't come to fruitionAllowing creators to take risks and attempt to bring something new to life is the backbone of what we doHowever, we also understand that there is an inherent level of risk in any creation process. Still, despite a creator's best efforts, some projects won't always come together as plannedIn these situations we make ourselves available to creators to help however we can, and we encourage them to be as open as possible with their backers about the obstacles they faceBut no matter our efforts, projects will sometimes fail to come together as planned and backers will sometimes be disappointed in outcomesWe strive to constantly learn from this, and to make sure that expectations are appropriately set for backers (like on our Trust & Safety page at https***). As funds have been disbursed directly to the project creator, Kickstarter is unable to facilitate refundsIt's up to each creator to determine whether or not they will issue refunds, though in some cases it's possible that funds have already gone towards the completion of the project and production of rewardsIn the case of this project, it looks like the creator, though they are delayed, is planning to ship rewards and has posted information on their project page about shipping and production timelinesWe do hope you receive your reward soon. I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
I do not accept this answerIf you can not make a creator refund money, or even finish the project, how does that in any way deter people from using your services to scam peopleAgain I keep getting told that you do what you can to help the creator finish the product, but in my particular case, the creator is NOT REACHABLEIt is clear that they have misused YOUR services which has directly effected MANY peopleI do not accept the excuse that kickstarter does not have any responsibility when it comes to creators and their backers, if that is the case then you are effectively calling yourselves a host and not an actual serviceThat claim diminishes your reputation as a business

Hi there,Each project on Kickstarter is an independent work by a creatorThey receive funding directly at the end of a successful funding period in order to fund their project and fulfill rewardsRefunds of your pledge can only come from the creator. We understand that it can be frustrating when
things are not going as planned, yet the possibility that a project may have delays or may not complete is core to the spirit of the siteEach time you pledge you are not buying a product that already exists, but rather, are helping bring a creative idea closer to being. We also believe strongly in creative freedom and we uphold that philosophy by allowing each creator on Kickstarter to be wholly responsible for their own project and their own workIn the end, if they can’t finish what they promised, it’s their responsibility. When you back a project on Kickstarter you enter into an agreement with the project creator, as described in our Terms of Use: ***. These terms outline the responsibilities of backers and creatorsThis information can serve as a basis for legal recourse if a creator doesn't fulfill their promisesWe hope that backers will consider that option only in cases where they believe that a creator has not made a good faith effort to complete the project and fulfill. Stripe has been emailing me to get my updated credit card information If I could cancel my account with Kickstarter AND my account with Stripe and get this in writing from the Revdex.com that this complete transaction has been cancelled and that I no longer connected to this "Twice-Hooked Belt" project then I'll gladly drop this case and refund the money to *** *** But the problem is that I'm just getting emails about Kickstarter policy.I would like an Official Letter of Cancellation saying that this project is null and void and that *** ***'s account with Kickstarter has been cancelled, that ***'s Stripe account which I hopefully didn't set up is also cancelled And then just in case this person, *** ***, who is supposed to be a friend, IS setting up a future scam, I just need to know how to follow up I just want to cover my bases because Kickstarter does have my credit card account information.Thank you,*** *** ###-###-####

Hi there,We can definitely understand your frustrations regarding delays with the Coolest Cooler projectThe creator's updates indicate that they are also frustrated, and that they are continuing to work hard to find the best solution for backers. A backer's desire to examine the validity of
this creator's claims are understandablePart of what makes our community so special is the vibrant backer community that supports creative endeavors and holds creators to the highest standards for transparency and integrity. That said, I'd also encourage backers of this project to keep in mind that this creator undertook a highly complicated project, has provided a detailed description of the path, has admitted to mistakes, and has committed to pursuing a positive outcome. When you back a project on Kickstarter you enter into an agreement with the project creator, as described in our Terms of Use: ***While Kickstarter is the platform for this agreement, we are not a part of itA big part of Kickstarter’s mission is to support creative freedom and independence; we don’t step into the actual creative process itselfThat said, we hope that this matter is resolved soon and are here to help if you have any other questions or concerns. Sincerely,Kickstarter
