Hi there,We're sorry to hear that backing this project has become such a frustrating experience. We expect creators to fulfill rewards, offer refunds if they’re unable to complete their project, and communicate with backers at every step along the way. While Kickstarter is the platform for this...

agreement, we are not a part of it. We do not investigate a project creator’s ability to complete their project, nor do we facilitate refunds or the fulfillment of rewards. While in most cases you’ll find that rewards are delivered as promised, it’s also important to realize that some projects might not fulfill as planned. When you back a project on Kickstarter you enter into an agreement with the project creator, as described in our Terms of Use: [redacted] . We do our best to keep backers aware of the risk involved when backing a project, even linking to more information about this in pledge pages, but we do recognize there is still more work to be done, and we will be sure to pass your feedback about this along to the rest of the team here. Our Terms of Use outline the responsibilities of backers and creators. This information can serve as a basis for legal recourse if a creator doesn’t fulfill their obligations under the agreement. We hope that backers will consider using this provision only in cases where they feel that a creator has not made a good faith effort to complete the project and fulfill. Best,Kickstarter

Hi there,We're sorry that backing this project has turned into such a disappointing experience. We've reached out to this creator in the past to remind them of their obligations, as well as our expectations regarding communication. While we're disheartened that they have not yet updated backers on...

the status of their project, we're unable to force them to do so.We know how frustrating this situation is. However, it's also important to remember that supporting creators as they work to bring projects to life isn’t anything like shopping in a store, and it’s anything but failproof. In fact, it’s not intended to be — giving creators room to try out their new ideas is a big part of why we love what we do. Backing a project on Kickstarter is an expression of trust and can help lead to the creation of new and exciting things. This also means that sometimes complications arise that might prevent a project from unfolding as planned — or from happening at all. This certainly isn’t ideal, but our aim is that backers and creators can find constructive ways to communicate with each other through these difficulties. Most of the time, creators both communicate and deliver, and backers have good experiences; we hope you’ll find that what you’ve gone through is the exception, not the rule.Although we are unable to offer refunds, we are constantly working to improve the vetting process for creators and thank you for sharing your experience. We'll be sure to share your feedback with the rest of the team. We're actively listening to our community to figure out how best to improve our product and policies. In the meantime, we hope you’ll find projects that you feel confident about — ideas that really resonate with you and projects where you can look into the creator’s plan, experience, and reputation and find them to be strong.Best,Kickstarter

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Nonsense. You happily accept a fee for the transaction yet you accept no responsibility when things go wrong? That is not how things work. Even [redacted] will step in to make things right when you buy things through a 3rd party using their system. This is not a 'you break it you bought it' situation. All I asked at the beginning was for you to get your project creator to make good. Since they have refused and since the money was processed by you, you have some responsibility. Simply own up to that. Be a good corporate citizen.

As this user mentions in his initial message, he lent his support to the project through the [redacted] website. The only way for a user to be recognized as a backer on Kickstarter is if they pledge through our website while a project is live. If a user decides to send a payment to a project...

creator directly through [redacted] there is no record of the transaction with Kickstarter, and we aren't able to provide support for transactions completed outside of our platform. For specific questions on how off-site contribution will be handled, the user will need to reach out to the creator directly.

If you look at my account you will see that I fully understand how Kickstarter pledges work. I was one of the first people to sign up on your site and have spent thousands on projects. My issue here is that KICKSTARTER was used as a tool against me when I uncovered the FRAUDULENT activity by [redacted]. I further know, that I may never get my product even thoughit sits on the shelves at stores now. (As an FYI, [redacted] defrauded Kickstarter backers to fund the mass production of the product so that it can be shipped to stores for sale.) Theyused Kickstarter to silence me and my freedom of speech so that they would not get called out.  If I do not get a call from someone at Kickstarter about this issue, I will also take my findings to Gizmodo. I'm sure they would love to hear how a project creator defrauded backersand how they used Kickstater as a tool to keep from getting caught. [redacted]###-###-####

This is the same auto-generated response I get with every email from Kickstarter. They have never directly answered any questions I have. I have done all of the things listed in the auto response and I get no results. This has been well over a year and no resolution has been made. Kickstarter needs to have some sort of liability since they collect money from people that pay into this. I wish to leave this as a negative comment since I feel Kickstarter will once again ignore all inquiries.

Hi there,Thanks for following up. When you back a project on Kickstarter you enter into an agreement with the project creator, as described in our Terms of Use: [redacted]. While Kickstarter is the platform for this agreement, we are not a part of it. We can confirm that you should be able to message the project creator from your Kickstarter account. To message a creator, visit the project page and click on the creator's profile image. This will open up their bio page where you can then click the blue "Contact me" button. It also looks like we've been sending emails to the address linked to your Kickstarter account successfully. We would recommend that you try adding [redacted] to your contacts list; that should help our emails get recognized and delivered normally. If you're still having trouble receiving our emails, it may be an issue with your email provider. Please try reaching out to see if anything might be going on on their end.  Best,Kickstarter

So "passing the buck" is your company's stance? Even though they mislead backers into thinking they initially had a working prototype? And here we are TWO YEARS+ later. Still nothing. Don't thank me for "patience" when you know we are LONG past that point. It must be so easy for you to collect money and wash your hands of it when a problem arises. No effort is made on your part to withholdmoney until certain benchmarks are met on projects?! NO protection is even attempted by your company? As long as your get YOURS. That's ok right!? This project received ~$900,000.00 (£731690) in backing. I bet you got YOUR share in May 2014.

Hi [redacted], Thank you for voicing your concerns. It's clear that this is a disappointing and frustrating experience for you and your fellow backers, and we do not take that information lightly. First and foremost, we will be sure to share your feedback and suggestions with the rest of the team here. However, we are unable to issue refunds to you or other backers at this time. We expect all members of the Kickstarter community to act with honesty and openness. When it comes to preventing fraud and vetting creators, our Community support and Integrity teams monitor Kickstarter's system and regularly review reports received from users. Some actions taken may include: Reaching out to creators and reminding them post project updates as well as respond to backer messagesRevoking account privileges, including the ability to run another campaign on Kickstarter, until rewards have been fulfilled or an update has been posted for backersSuspending or restricting account privileges if there is sufficient evidence of abuse against our system or trust of others. We track creators' fulfillment histories as comprehensively as possible - from snags to more serious complications - to help ensure creator accountability. We may adjust our policies based on feedback from backers and creators, and/or data aggregated across projects.  While we can't speak to the nature of specific projects that have been approved or declined, we're constantly working on improving our vetting process for creators and we are grateful for the feedback that folks like you provide. Best,Kickstarter

I think Kickstarter needs to removed from Internet - this is NOT the first project to take peoples money and they get nothing in return - Kickstarter should be going after this company for all of its fake video of a product they didn't have.  We will NEVER use Kickstarter again and I hope everyone else will follow suit.

Hi there,We're sorry to hear that backing these three projects has turned into a frustrating experience for you. As you already mentioned, backing a project (and receiving a reward for it) on Kickstarter is different from buying something in a store. Often times, a project is in the beginning...

stages, and manufacturing details are not finalized until after the project is successfully funded. This means that delays can occur for any number of reasons, and a creator may be slower to respond, especially if they are tied up working on production and trying to communicate with many backers at once. That said, we do expect creators to be as open and honest about delays with backers as much as possible. In the cases of the projects you mentioned, I see that we have recently reached out to these creators to encourage them to communicate with you and fellow backers more effectively going forward. As you may already know, successfully funded project creators plan their project around the funding they received while it was live on Kickstarter. Because of this, these funds are often tied up in the completion of the project or fulfillment of rewards. As these funds are disbursed directly to the project creator, we are unable to facilitate refunds. If you’d like to see if a refund is possible, we recommend continuing to reach out to the creator directly. If you’ve already tried that through Kickstarter messages and still haven’t received a response there, you might want to consider reaching out to each creator through other channels, such as social media or the creator’s own website, where available.Thank you for all the patience and support you've shown these projects so far. We do hope you hear more from these creators soon.Best,Kickstarter

disbursed directly to the project creator, we're unable to facilitate refunds. We expect creators to fulfill rewards as promised, or issue refunds to backers whose rewards they cannot or do not wish to fulfill. However, in some cases, creators do not have funds on hand to issue refunds, as the money has gone into production. In these situations, we hope that backers and creators can work together to find the best possible solution. If you haven’t received a response through Kickstarter messaging, you might want to consider reaching out through other channels such as social media or the creators' own websites, where available. We hope that this matter is resolved soon. Best,Kickstarter

Hi [redacted], We are sorry to hear about the frustrating experience you've had with this project. Each project on Kickstarter is an independent work by a creator. They receive payment directly at the end of a successful funding period in order to fund their project and fulfill rewards. That...

money never actually passes through our hands — we only receive a small fee. In light of this, the creator is the only entity that is able to issue a refund, and it's up to each creator to determine and follow through with their own refund policies. We understand that you have been reaching out to the creator about receiving a refund. If you haven't heard back from the creator after a bit, feel free to follow up with another message or comment. It's possible the creator is responding to many messages from backers, along with trying to work on their project and fulfilling rewards, so it can take a while to hear back. If you’ve already tried that and haven’t received a response through Kickstarter messaging, you might want to consider reaching out through other channels such as social media or the creator’s own website, where available. In the meantime, we have reached out to the creator to remind them to follow up with backers like you and address any outstanding concerns regarding rewards.  Again, as funds are disbursed directly to the project creator, we're unable to facilitate refunds. That said, we hope that you hear back from the creator and that this matter is resolved soon. Best,Kickstarter

[Your Answer Here]I still have no purchased item and they will not refund my money as requested.  Plus they didn't even give me the name of the person to complain to directly.  However, I have found that complaints to that company go un-acknowledged, as explained in my complaint.

Kickstarter has a responsibility to prevent this creator from starting other projects until this one is satisfied. They must shut down any funding from this creator until we have resolution. Can Kickstarter provide any information on if the creator has replied to them? What does the creator say?

Hi there,Supporting projects on Kickstarter is different from buying a product from a retailer. Projects that launch on Kickstarter are often very early in the development process. This gives backers an opportunity to be a part of the creative process from the beginning, but this aspect also makes backing a project on Kickstarter very different from purchasing an item in a store. Our Terms of Use specify that, "By backing a fundraising campaign on Kickstarter, you as the Backer accept that offer and the contract between Backer and Project Creator is formed. Kickstarter is not a party to that agreement between the Backer and Project Creator. All dealings are solely between Users."In addition, our Terms of Use establish that,"Kickstarter is not liable for any damages or loss incurred related to rewards or any other use of the Service. Kickstarter is under no obligation to become involved in disputes between any Users, or between Users and any third party arising in connection with the use of the Service. This includes, but is not limited to, delivery of goods and services, and any other terms, conditions, warranties, or representations associated with campaigns on the Site. Kickstarter does not oversee the performance or punctuality of projects. The Company does not endorse any User Submissions. You release Kickstarter, its officers, employees, agents, and successors in rights from claims, damages, and demands of every kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and the Service."You can read our full Terms of Use here: [redacted] . While we have reached out to this creator, and while we do realize that this particular situation is frustrating for you, Kickstarter cannot intervene further. Thank you again for your understanding.Best,Kickstarter
