With all due respect, I wrote Kickstarter about these solicitations and got the response from the Alex H[redacted] who stated that he was from Kickstarter.  I never got a response from the company. I prepared the project proposal as directed. There is some disconnect here.  Your agency is not clear about this.

 Kickstarter needs to do more than simply reminding them to reach out as they have not reached out despite numerous messages both through kickstarter and directly, even through media. Considering the length of time since funding, lack of reply, kickstarter should be willing to provide direct contact info such as a number or even an email address for each project. As you an see, they do nothing

However, in some cases, we've seen that creators are able to get their product to the public via mass production faster than individually packaging and shipping rewards. In other cases, a creator may be attempting to generate additional funds by selling their product on the mass market so that they can afford to fulfill their obligations to backers. Again, this is not the best outcome, to say the least, but it can be a reality. It's up to each creator to set the tone of their project and determine how best to fulfill rewards. Overall, we expect creators to fulfill rewards, offer refunds if they’re unable to complete their project, and communicate with backers at every step along the way. While Kickstarter is the platform for this agreement, we are not a part of it. We do not investigate a project creator’s ability to complete their project, nor do we facilitate refunds or the fulfillment of rewards. The canned response provided by kickstarter did not answer why kickstarter was not standing behind the policy which I cut and pasted directly from their website.The response they provided was word for word match which other individuals have received from kickstarter for situations which were very different than mine.   The projects creator is unable to fulfill the reward as promised.  The meet and greet did not occur as stated, one speaker arrived damaged and both do not work properly.  I was unable to get this resolved as the company seems to have gone under.  They do not answer emails, corporate or personal and their website is no longer functional.  Per section 4 of Kickstarter's terms of service the creator is supposed to fulfill their promise, however in their absence, if Kickstarter will not refund my money I will be forced to take legal action against Kickstarter.

[Your Answer Here]Kickstarter claims: "we review projects, uphold our rules . . ., practice careful governance, and use anti-fraud filtering."  Here, Kickstarter did not do that correctly, despite customers relying on them to properly vet and screen the Trunkster project.Kickstarter was paid a 5% fee from the funding of the project (here believed to be approximately $75k).  Now that the fraud has occurred, Kickstarter claims that its customers should not even be reimbursed the portion of the fraud that was paid to them -- the 5%.  That is absurd.  Kickstarter participated in the fraud, by not properly vetting the project in accordance with its own rules.  The real reason customers have been harmed is because Kickstarter failed to do their job correctly, yet still has kept the money stemming from their own failure to do their job correctly and participation in the fraud.You cannot affirmatively represent to customers that you are policing your site, etc., get paid to do so, then claim when you fail to do so, that your customers should be the ones left holding the bag.  That is fraud, and improper.  Kickstarter should be held responsible here.

Allowing creators to take risks and attempt to bring something new to life is the backbone of what we do. However, we also understand that there is an inherent level of risk in any creation process.Kickstarter is built around minimizing that risk through all-or-nothing funding, which allows the collective voice of the people to decide which projects reach their goal. [Your Answer Here] The projects in question have already been funded for at least over a year now, some almost two years. Needless to say, this is more than enough time to provide promised product and or secure all funding. Ive reached out to each project directly and also through the media such as [redacted], received no reply.  Given the lengths of time since funding and lack of reply directly or through the media, I believe refunds should be in order. Kickstarter can or will not refund directly or provide contact info for each project such as phone number, its too bad they are not more cooperative. A complaint has also been filed with New York Attorney General's office.
