Baycal Financial Inc Reviews (156)

Hi [redacted], We are equally frustrated and disappointed when a project is heavily delayed or doesn't come to fruition. Allowing creators to take risks and attempt to bring something new to life is the backbone of what we do. However, we also understand that there is an inherent level of risk in any creation process. Kickstarter is built around minimizing that risk through all-or-nothing funding, which allows the collective voice of the people to decide which projects reach their goal. On our end, we review projects, uphold our rules ([redacted]), practice careful governance, and use anti-fraud filtering. Still, despite a creator's best efforts, some projects won't always come together as planned. In these situations we make ourselves available to creators to help however we can, and we encourage them to be as open as possible with their backers about the obstacles they face. While we can't facilitate refunds (because funds are disbursed directly to the creator once the project ends successfully), we do everything we can to guide creators through difficult challenges. But no matter our efforts, projects will sometimes fail to come together as planned and backers will sometimes be disappointed in outcomes. We strive to constantly learn from this, and to make sure that expectations are appropriately set for backers (like on our Trust & Safety page at [redacted]). It’s our mission to make sure that Kickstarter is a place where folks can launch and support projects with confidence and excitement. Best,Kickstarter

Hi there, Thank you for following up with us about the status of this project. It's important to keep in mind that when creators experience unanticipated popularity, it can inadvertently lead to delays and more issues with shipping out rewards, as more backers means more rewards (and complicated combinations of rewards) to fulfill. These are also likely the first times creators have undertaken a project of this size, so they're likely to be learning a lot from this experience. For more information about backing a project on Kickstarter, see our Trust page: [redacted]We understand that this is a frustrating situation, but if you’ve heard from the creator regarding the delay (it looks like they’ve been active in updating backers and you can check that out on their project page), then they’re doing what we ask of them. In this case, I’d say patience, and more importantly support, are what a creator needs to fulfill. Often, the best thing to do as a backer is to cheer a creator on despite bad news or delays. If you have questions or concerns regarding the status of this project, you can communicate with the creator by either posting in the comments section, or messaging the creator directly. They have also provided a direct email address to reach their customer service. You can find this address in their latest project Update.   We hope that helps to answer your question, and please let me know if we can help with anything else in the meantime. Best,Kickstarter

In these situations we make ourselves available to creators to help however we can, and we encourage them to be as open as possible with their backers about the obstacles they face. To that end, we’ve reached out to this creator and offered our assistance. In our note we encouraged them to provide an update on their project for backers, as well as respond to any messages sent through Kickstarter. Our goal is to open the lines of communication, encourage them to update more openly moving forward, and further address the fulfillment delays. You should continue reaching out to them on your end as well. Through this joint effort, we’ll be reminding the creator to check in. But no matter our efforts, projects will sometimes fail to come together as planned and backers will sometimes be disappointed in outcomes. We strive to constantly learn from these instances, and to make sure that expectations are appropriately set for backers (like on our Trust & Safety page at [redacted]). Since funds are disbursed directly to a creator once their project ends successfully, we are unable to facilitate refunds. The decision to issue refunds is solely up to the creator. We do appreciate your follow up on this project and bringing your experience to our attention. We don't take these matters lightly, and we are constantly reviewing feedback like yours to help us improve the experience of using our platform. It’s our mission to make sure that Kickstarter is a place where folks can launch and support projects with confidence and excitement. Best,Kickstarter

Hi there,Thanks for following up about the status of this project. We expect creators to fulfill rewards, offer refunds if they’re unable to complete their project, and communicate with backers at every step along the way. While Kickstarter is the platform for this agreement, we are not a part of...

it. We do not investigate a project creator’s ability to complete their project, nor do we facilitate refunds or the fulfillment of rewards. While in most cases you’ll find that rewards are delivered as promised, it’s also important to realize that some projects might not fulfill as planned. It's important to keep in mind that any number of obstacles can occur during the creation process, which means that projects can be delayed well beyond their estimated delivery dates. That said, we've reached out again to this creator to remind them of their obligations to backers like you and to strongly encourage them to focus on communication through updates and direct messages. When you back a project on Kickstarter you enter into an agreement with the project creator, as described in our Terms of Use: [redacted]These terms outline the responsibilities of backers and creators. This information can serve as a basis for legal recourse if a creator doesn’t fulfill their obligations under the agreement. We hope that backers will consider using this provision only in cases where they feel that a creator has not made a good faith effort to complete the project and fulfill.Best,Kickstarter

Tell us why here.. This is directly from the kickstarter website:Reward > Creator accountability When you back a project on Kickstarter you enter into an agreement with the project creator as described in our Terms of Use. This agreement requires creators to fulfill all rewards of their project or refund any backer whose reward they do not or cannot fulfill. We hope that backers will consider using this provision only in cases where they feel that a creator has not made a good faith effort to complete the project and fulfill.  Aso kickstarter created this message they are responsible for ensuring the creator is held accountable. I also took time stamped screenshots of this message on your website and emailed them to myself and other in case it was taken down.

Hi there,We're sorry about the frustrating experience you've had with this project. Each project on Kickstarter is an independent work by a creator. They receive payment directly at the end of a successful funding period in order to fund their project and fulfill rewards. If you’d like to see if a refund is possible, we recommend that you continue reaching out to the creator directly. As funds are disbursed directly to the project creator, Kickstarter is unable to facilitate refunds. When you back a project on Kickstarter you enter into an agreement with the project creator, as described in our Terms of Use: [redacted]. In these situations, we hope that backers and creators can work together to find the best possible solution. That said, we hope that this matter is resolved soon.Best,Kickstarter

Hi there,Kickstarter's Terms of Use outline the responsibilities of backers and creators. This information can serve as a basis for legal recourse if a creator doesn't fulfill their promises. We hope that backers will consider that option only in cases where they believe that a creator has not made a good faith effort to complete the project and fulfill. If you believe legal action is appropriate here, please talk to an attorney about how to proceed.Best,Kickstarter Support

Hello,Sorry to hear about this issue. To clarify, while these people are getting in touch with the creator through the messaging system on Kickstarter, Kickstarter itself isn't affiliated with any advertising, promotional, or marketing services. These people do not work for Kickstarter, as you can...

see on our team page: [redacted]. Any unsolicited offers you receive should be taken with a grain of salt. While it's ultimately up to creators to research and determine what's best for your project, we take spam behavior very seriously and will take the appropriate action according to our Community Guidelines: [redacted]. Please mark these messages as spam and our Integrity team will look into this as soon as possible. Apologies for any inconvenience.Note that creators do not pay a premium for promotion on Kickstarter. There are many ways you can get your project noticed, and make it as attractive as possible for your own audience. Kickstarter, showing itself to be the epitome of poor customer service, has not taken one step towards any acceptable resolution as outlined in previous emails. They have not contacted the creator, they have not sent the emails they purported to have sent to my personal email account, and they have not initiated a refund. They are quite simply continuing to sit on their hands and pretend to be powerless to assist backers.

Hi [redacted],We certainly understand your concerns, and we have made sure to pass them along to the rest of the team here. The button you are referring to is something that the creator set up and controls through our Spotlight feature. Spotlight allows a creator of a successfully funded project to customize their ended project page, including the ability to post a link to follow along or support the project on the creator's own site. At this time, backers are encouraged to click on the "Report this project" button on a project page if they wish to bring something to our attention, like the fact that a creator may be inappropriately using their Spotlight page. That said, again, we've taken your point to heart, and it is a valid concern that we will be fielding to our colleagues. We know we have more work to do, and we're actively listening to our community to figure out how best to improve our product and policies. In this particular case, we can also assure you that we've reached out to this creator a number of times to encourage them to update their community and follow through on their obligations to backers like you. Beyond this, it’s our policy not to comment on any actions taken by our Integrity team. Apologies for any inconvenience that causes, and thank you for your understanding.Best,Kickstarter

Hi there,On Kickstarter, a backer can only make a single pledge to a project. If you select a new reward after you've already selected a different one as part of your original pledge, your new reward selection will replace the old one. In this case, it looks like there was some confusion about how reward selection works. The creator of this project encouraged backers to add an additional item to their reward request by increasing their pledges, but here it seems that instead of increasing the existing pledge, selecting the new reward (in this case, the blanket at the $30 level) replaced the existing reward selection (of the jacket itself) and decreased the pledge amount. While we understand the frustration of this situation, any issues with messaging about rewards are the creator's responsibility, as are any pledging issues caused by this. Since rewards are being produced, managed, and shipped by the creator, not Kickstarter, you will need to reach out to the creator about this issue. It's possible that you may be able to arrange for additional payment to them, outside of Kickstarter, in order to receive the reward you had hoped for when you originally pledged to this project.Best,Kickstarter

Hi there,When you back a project on Kickstarter you enter into an agreement with the project creator, as described in our Terms of Use: [redacted]. These terms outline the responsibilities of backers and creators. While Kickstarter is the platform for this agreement, we are not a part of it. For privacy reasons, we don't provide a creator's information directly to backers. Creators are responsible for their own behavior — from communication and engagement to fulfillment — and while we can and do enforce our terms of use, we can’t force anyone into action. A big part of Kickstarter’s mission is to support creative freedom and independence; we don’t step into the actual creative process itself or a the fulfillment of a project. We work hard to strike a balance between allowing for creative freedom and taking the best possible care of our community.Best,Kickstarter
