I am rejecting this response because: on may 1st the dues (29.98)were not covered by the 119 they were pulled out of my account I have them on my banking statement and I just looked so that's 29 on top of the 119.

I am rejecting this response because: CFF did not locate my correct membership contract. The contract CFF referred to in their response (the attachment) was, 1) for a package of 40 personal trainer sessions, 2) was paid in full and, 3) had nothing to do with the original gym membership contract I signed 10+ years prior stating that my membership fees would not increase.

I will not be satisfied with just a refund & cancellation of my contract but if that is the only resolution I can get, that's what I have to do.

Hello, I have attached the contract for your review. It is a month to month agreement that could have been cancelled at any time with a 30 day notice. I am rejecting this response because: we emailed you telling you guys not to touch our account because we want to fight the early termination fee in court based off of the fact that we were misrepresented. We were never told anything about the change in billing dates nor given a chance to read the contract because your sales rep said he would fully explain each section while we  signed on a small electronic pad that only allows for a signature. After talking to several of my co workers, I heard your sales guys do this to a lot to your clients. Niether Ms [redacted] nor Mr [redacted] ever signed to have 126$ taken from our account and we even informed your corporate office that we put a block on your company from our bank account that only was able to last 30 days. Yet you guys still took the money. My bank is already aware of everything and we have been credited our money back. Please also tell your employees to not give us anymore sales calls.

I am rejecting the response because:Many reasons-it was not a Refund. It was a fraudulent transaction by your corpor. investigated by my bank who found the 7/30/15 a fraudulent transaction.This you left out in your letter. Ms.[redacted], you need to cancel my membership for your employee lying, continuous fraudulent activity,&all other violations that I could not&have included in my complaint;but someone else or other entity is happy to review.I reject your letter for:1-Rescission for Fraud, Mistake, Undue Influence, Breach, Illegality,2-No real consent, Failure of anticipated exchange through fault of seller (CA Family Fitness),3-Promised exchange to buyer (me)void for any reason,4-Failure of bargained exchange before being rendered,5-Contract unlawful. I, [redacted]-the buyer has a right to rescind a contract when the contract "is unlawful for causes which do not appear in its terms or conditions".6-Public interest prejudiced.7- CA Family Fitness is in Violation of my right to Procedure for rescinding.8-CA Family Fitness is in Violation of Other rescission rights that my right to rescind is conferred by other reasons.9-Fraudulently Executed Contract Must be voided immediately.10-Unconscionable Contract Unenforceable.11-Cancellation for Breach is Warranted &being denied.12-I am revocating acceptance of membership for more reasons that CA Family Fitness substantially fails to conform to the contract&my seller's warranties/rights,13-Your fraudulent membership product cannot be repaired after a reasonable number of my repair attempts,there4 you must either replace the fraudulent product or cancel its price.Furthermore, Ms. [redacted] you& your corporation&itsemployees are not above the law. I am rejecting this response because:Your first sentence is incomplete; I am not sure what you were trying to say.  If I was joining Cal Fit as a club member, I would understand the need for a photo copy of the Driver's License and assume that this requirement is disclosed in the contract that is signed by the prospective gym member. I am not a Cal Fit member. I simply asked for a five minute tour because I wanted to see the locker rooms. My objective was to determine if they are sanitary enoughwhere I would feel comfortable taking a shower at Cal Fit and getting ready for work in the morning. I read the 'fine print' on the Liability Waiver before signing it. The waiver DOES NOT state that a copy of the Driver’s License of the prospective member is required to tour the facility. When the front-desk employee asked to SEE my license, I told her up front that I was very hesitant to share it and said that she could SEE it. It was my understanding that she was verifying that the name on the Liability Waiver matches the name on the license.  Instead, she ran over to the scanner and took a permanent image. I told her that she did not have my permission to do that and demanded that the image be immediately deleted.  She then said, "It's too late; I have already sent it to my manager."  This employee sent a permanent image of my personal identity document to the Cal Fit sales manager without my consent. In speaking with the manager, [redacted], he said that it’s Cal Fit’s business practice to take a permanent image of someone’s ID and that they do not have to obtain permission for this.  So, please go back to my original Revdex.com demand and respond to the four questions that I posed. [redacted], I will tell you up front that I am an easy going person and it takes a lot to get me mad. I am very unhappy with Cal Fit’s handling of this entire situation. I have access to legal counsel and the media and will not hesitate to use it: identity theft can result in serious long-term consequences. Cal Fit does not seem to be concerned with the harm that they may do to the general public. I suggest that you escalate this issue within your organization.

I am rejecting this response because:I was mislead when I signed the contract.  I clearly could not access the facility for a 12 month term - I was leaving for Spain the first of September then heading back to college in San Luis Obispo.  I was only in Sacramento for 2 weeks - why would I knowingly sign up for 12 months with these cancellation fees for 2 weeks worth of access?  I was told that I could cancel without penalty or cost which is why I signed the contract.[redacted] (sp?) from CA Family Fitness left the following voicemail message on December 16, 2104 - "I have reviewed the account and it was a mistake on our part and we will be refunding all of the drafts that we taken out of John's account ending in 7385.  It will take 5-7 business days for that to happen."I believe they should carry through on this commitment.

Hello Mr. [redacted], I have reviewed your account and did see that you submitted your proof on 10/14. It does take several business days for the proof to be reviewed. At the time the proof was review you had changed your account to a Diamond membership which you were rejected for the discounted. However,...

from the email with [redacted], she did state she would credit the difference when you downgrade back to a gold membership and the difference from the months taking as a gold. I apologize this did not happen in a timely manner. From the notes regarding your downgrade, an employee informed you that we need 7 business days prior to your billing to make any changes as the dues lock in and we are not able to make changes. They did state that they would be able to downgrade and then credit that month of dues that would be taken that month. I am happy to credit you the difference of the 5 months you were paying extra (2 months at $99.99 and 3 months at $209.99) I will credit the difference between those payments and the discounted state rate of $64.00 bringing your total refund to $509.95. However, I am not able to waive any of the terms for cancellation. If you would still like to cancel there will be a cancellation fee that I can take from the refund if you wish. As I do see you have been using the gym, if you wish to stay your dues will be $64.00/month. We sincerely apologize for this membership confusion and hope you stay with the CFF Family. I am rejecting this response because I did not sign up for a 1 year membership. Did you not read properly read the the message I sent you? I clearly stated to the manager the I was on a month to month basis. I had just been harassed out of the yoga studio down the street. So it was only a matter of time until those jealous yoga instructors were going mess with my membership at the gym. I did not sign up for a 1 year membership. He must have checked the boxes after I left because I made it very clear to the manager that I was going on a month to month basis. I will not accept this response. That company ripped me off.

I am rejecting this response because: I was told that I was good this month on bills but was charged and that put me in overdraft with my bank. I was assured that February was paid for but I understand now that it wasn't. I'm angry because they told me different and I wasn't prepared for the finance problem they caused. The person at the desk misspoke about me being okay on payments and that is why I filed a complaint. I paid my dues for this month so I'm fine with that but make sure your people who work for you know what they're talking about and explain things the right way. My understanding was that I didn't have to pay until march. Also I told you my debit card was compromised and I was waiting for a new card to be be issued. You still charged me for $9.99 three times. Someone stole my identity online I was waiting for a new card and you kept charging me. Hire people who know what they're talking about and don't put your consumers through this type of stress. Why did you keep billing me when I told you I was waiting for a new card. That 9.99 kept putting me in overdraft fees with my bank but you charged the card anyways and I had to pay the fees. It's settled now just train your people to explain the fees and how it would affect me. It caught me off guard. I work my as off for UPS and pay union dues don't screw me over by telling me I'm caught up on my bills.
