We appreciate the opportunity to respond to the complaint filed with your office by our former student,...

[redacted]. We have completed our review, and the facts do not substantiate Ms. [redacted] allegations against ITT Technical Institute-Baton Rouge, LA.
Ms. [redacted] claims that while enrolled at the Baton Rouge school, she incurred over $35,000.00 in student loans, which she alleges were applied for in her name without her consent. She also alleges she was promised that her loan repayment amount would be $80.00 per month and that she was denied access to her academic and financial records when she requested them. We have reviewed Ms. [redacted] claims and determined the following:
1. Ms. [redacted] began attending courses at ITT Technical Institute-Baton Rouge in the December 2009 quarter and remained enrolled until her administrative withdrawal on December 28, 2010. Ms. [redacted] total charges for her program of study for the time of her enrollment were $23,664.00, and while enrolled, Ms. [redacted] applied for and received funding through the U. S. Department of Education Title IV Pell grant and student loan program as well as private student loan funding through the PEAKS private education loan program. These funds were applied to her charges as follows:

In her signed Enrollment Agreements (EA) dated November 25, 2009 and October 20, 2010, Ms. [redacted] acknowledged the estimated cost of her program. She also signed Cost Summary and Payment Addendums (CSPA) to her EAs on November 25, 2009 and October 20, 2010 that outlined the estimated amount of funds she would receive to apply toward her charges including her Title IV Stafford Unsubsidized and Subsidized loans
 
and her PEAKS private education loan. Additionally, Ms. [redacted] signed and initialed the Entrance Counseling form acknowledging the terms and conditions of her Title IV student loans as well as her Application and Loan Agreement for PEAKS Private Student Loan form. We are unable to substantiate, therefore, that Ms. [redacted] did not receive this loan funding as she claims, or that she was unaware of the amounts of her loans or the terms and conditions of these loans including her responsibility for repayment. Further, we can find no evidence to suggest that the application process for any of these loans was initiated by anyone other than Ms. [redacted], nor were these funds received on her behalf and applied to her charges without her consent.
2. Ms. [redacted] claims that she was promised that her monthly repayment amount would be approximately $80.00. The Federal Stafford Loan Test Document initialed and signed by Ms. [redacted] on August 11, 2010, provides in pertinent part:
1. The Federal Direct Stafford Loan is a FEDERAL LOAN. It is money that must be REPAID.
9. My minimum (our emphasis) monthly payment will be $50.00 per month until the loan is repaid. Multiple loans may result in a higher minimum payment.
Ms. [redacted] signed Student Entrance Counseling Form for her Title IV student loans also includes an estimated repayment chart for federal loans based on the total amount borrowed and the interest rate(s) of the loans. Ms. [redacted] received $9,354.79 in Title IV student loans, and the minimum monthly payment for this amount ranges from $97.00/month to $105.00/month depending on the loan interest rate. Ms. [redacted] Application and Loan Agreement for PEAKS Private Student Loan form also specifies that the minimum (our emphasis) monthly repayment amount is $50.00/month. Ms. [redacted] received $13,106.51 in PEAKS private education loan funding, and her monthly repayment amount was determined according to the terms set forth in the Application and Loan Agreement that she signed. Ms. [redacted] received multiple education loans from different sources, each with its own set of terms and conditions, including repayment amounts. As our institution does not determine or define the conditions for repayment or the monthly repayment amounts for these education loans, we are unable to promise students a particular or specific monthly loan repayment amount. We are, therefore, unable to substantiate that anyone at the Baton Rouge school promised Ms. [redacted] that her total monthly repayment amount for her education loans would be any specific amount.
3.Ms. [redacted] further claims that she was denied access to her academic and financial records. We were unable to find any evidence that Ms. [redacted] requested a copy of her records, so we are unable to substantiate that any such request was denied. We have forwarded a copy of the records request form to Ms. [redacted]. As soon as we receive the completed request form from her, we will provide her records to her within the 45 day timeframe specified in the form.

This school is a joke! They promise you the moon and stars and return all you get is a BIG FAT bill that is unreasonable and they expect you to pay when what they tell you didn't every happen. No job in the field you studied, no increase in salary, no help in finding a job in your field that they promise they will get you. They flat out lie and push you to sign the financial aid forms and the temporary credit forms. This was a HUGE mistake on my part and I will forever tell anyone that ITT is a joke and not to ever waste your hard earned money with them.

iTT tech sent email 9/6/16 stating that the school was closing down and that there were no further classes being held there. My last semester starts on 9/12/16 set to graduate in December. After much research my current credits will not transfer to another college! So I am left high and dry to which direction life is going to go! Loans will have to be repaid ASAP! Not sure what to do???? Thank you for your time. I just don't want to see anyone else get hurt the way my family and just have been.
