In response to the rejection received: I've attached a copy of the call recording, which outlines the authorization given by [redacted] on 12-5, for payments to be drafted on 12-and 12-to resolve the Montoya's delinquent account statusThese dates and amounts were authorized, and reiterated in the phone call occurring on 12-5-at 3:38pmAgain, all payments drafted by Monterey Financial Services, LLC have been authorized by either [redacted] As stated in the initial response, the automatic draft has been cancelled, and the account is up to date with the next scheduled payment coming due on 1-20-Sincerely [redacted] ***Senior Manager of Finance and Quality AssuranceMonterey Financial Services, LLC

As previously stated, item in the attached Membership Purchase and Security Agreement ad**esses cancellation and specifically states that the member may cancel the agreement within five days following the execution of the agreement by returning all received related documentation to the Member Service Representative at the Residence Club and sending written notification by certified mail, return receipt requested to [redacted] *** [redacted] have not provided proof that they followed the terms of the cancellation policy as they do not have any proof that [redacted] received and acknowledged the cancellation request An email sent to the client is not sufficient proof of cancellation per the terms of the Membership Purchase and Security Agreement Since [redacted] do not have valid proof that the account was cancelled per the contract terms, the account will continue to report as a disputed open collection account We may be able to offer to settle the balance at a discounted rate, however [redacted] will need to contact us since they sent us a cease and desist notice I strongly encourage [redacted] to contact our office to resolve the defaulted balance Sincerely, [redacted] Collections Manager

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below I am rejecting their response I purchased a Maltese from [redacted] and was under the impression when I signed the contract that it was for the purchase price of $plus interest for months [redacted] the person selling me the Maltese told me that I was approved for $5, [redacted] then said, “I could buy a few more dogs.” I told her to just finance me for the Maltese After being there for over hours, there were all kinds of confusion with getting the sale to go through my email addressThey were having a hard time sending me information So, we did it over the phone and the papers were faxed to the storeBy this time my patience was exhausted so that when they started putting papers in front of me; I initialed them and never did anyone ever told me I was financing for 5K or that I was leasing this Maltese Again, I have a bill of sale that says, “SOLD PRICE $1, The entire transaction was very misleading and lacked transparency I don’t know why I wasn’t given a copy of the contract when I left the store If I had the contract I would have had time to look it over more clearly when I got home I would have gone back with either with the Maltese or would have insisted upon them honoring what they had told me about the month payment plan Next Point – I have more paperwork that shows me that this dog’s pedigree is supposed to be a pure breed Maltese Maltese are small dogs My dog is only months old and is over pounds I don’t think it is a pure breed So, I went online to find a test kit that I can buy for $from Amazon I plan to purchase this kit and test my dog The results will take about two to three weeks [redacted] or [redacted] is fraudulent and a reasonable cash outcome can’t be agreed upon, I will hire a lawyer and will go from there Again, I am willing to honor the deal I was told on the day of the Sale I don’t know what terrible person or persons came up with greedy and dishonest business practice, it is wrong Also, I have spoken to other people that had the same problem with [redacted] and *** One person purchased a TeaCup Yorkie These dogs are small dogs but within the first few weeks the dog was getting bigger She went back to [redacted] and they told her she can return the dog She said I will not, you can refund me my money She had to hire a lawyer to get $back from the company This needs to stop This company needs to held accountable and not be allowed to keep scamming customers What it all comes down to is, I want a fair deal I pay all my bills but it has to be fair A month ago when this came to light I continued to pay and I will until the months are done The only difference is I will pay with a check mailed to ***/Monterey Financial Services, CA and I am requesting a statement in return I am cancelling the automatic withdrawal with my bank I don’t trust [redacted] or Monterey with access to my money.Regards, [redacted]

In response to the complaint received: Ms [redacted] voluntarily entered into a contract (attached) with World Discovered Pacific LLC on June 14, 2017for the purchase of a vacation club software license as outlined in the contractThis contract was assigned to Monterey Financial Services, LLC on July 03, to service the payments outlined in the Retail Installment Contract/Credit Sale Contract, where the account was assigned an account number of [redacted] and the required notifications of assignment were sent to Ms [redacted] , outlining her right to dispute the validity of the assignmentShe did not do soOn the contrary, her first payment scheduled on July 15, per the terms of the agreement and as authorized in the automatic payment authorization (also included in attached)The August payment was declined, and Monterey representatives spoke with Ms [redacted] on September 7, where she indicated she wished to cancel the contractThe Monterey representative she spoke with pointed out the day rescission period (that Ms [redacted] acknowledged and initialed as understanding) that expired on 06-19-per the attached agreementAfter setting up payments that she outlines in her complaint, Ms [redacted] then contacted our office on September 20, indicating that she was dealing with a death in the familyThe Monterey representatives discussed financial assistance programs available to assist her through this time, but she did not want to accept any assistance that was offered to her Due to the facts outlined above, it is clear that no fraudulent activity as Ms [redacted] alleges, and I urge Ms [redacted] to contact our office today at 877-399-to discuss her obligation to the loanAs outlined, if she needs financial assistance, Monterey is willing to discuss and qualify her for such in the event she is eligible Sincerely, [redacted] Senior Manager of Finance & Quality Assurance Monterey Financial Services, LLC

In response to the complaint received: In January of 2015, [redacted] entered into a lease agreement with [redacted] Financing for the purchase of a Golden Retriever (copy of lease agreement attached)This contract was purchased, and assigned to Monterey Financial Services on 1-13-to service the terms of the lease agreementUpon receipt of the complaint, and after researching the matter with [redacted] , [redacted] Financing has advised Monterey Financial that they have since reached out to [redacted] and come to a resolution due to a misunderstanding at the inception of the agreementMonterey Financial has been advised that it was agreed that [redacted] would be responsible to pay the amount financed on the contract (an amount of $524.86) which will be paid to Monterey Financial on 11-16- Sincerely [redacted] Finance Manager Monterey Financial Services Inc

In response to the complaint received: [redacted] financed the purchase of a mattress & box spring bed, and sofa-bed from [redacted] on 9-27-(contract attached)The financing she received contained a "Day Payoff Option" where [redacted] was able to pay the amount financed ($504.43) if paid by 12-26-This was also pointed out in the initial paperwork sent to [redacted] on 9-30-after the contract had been purchased and assigned to Monterey Financial ServicesThis was not done Monterey phone records indicate that no messages were received from [redacted] , and that the only phone call received was on 1-6-16, well after the Day Payoff deadline had expiredIn this conversation, the Monterey representative that spoke to her, pointed out that the Day Payoff expiration date had long since expired, and was no longer available per the terms outlined in the contract At this point, [redacted] is now delinquent for both her February and now March paymentsShe is still eligible for an Early payoff per the terms outlinedShe also contacted our office on the 3rd of this month indicating that she had lost her job months agoIt should be noted that Monterey Financial has financial assistance programs available to [redacted] if she is experiencing a financial hardship at this point, but the Day Payoff Option is no longer availableAs already pointed out, she is still eligible for a discounted payoff per the Prepayment clause in the contract & I urge [redacted] to contact our office toll free at [redacted] to make the necessary arrangements to satisfy her delinquent payments Sincerely [redacted] Finance Manager Monterey Financial Services

Monterey Collections was hired by the bankruptcy trustee for [redacted] to collect on some of their unpaid balances for services rendered Monterey Collections was informed by [redacted] bankruptcy trustee that the patient’s insurance company may have mailed a check to the patient to cover the expense for numerous lab tests that were authorized by the patient’s doctor, instead of mailing the payment to *** Since the check from the insurance for services rendered may have been mailed directly to the patient, the debt remains unpaid and the patient is responsible for the amount of the check received The account was placed with Monterey for the above mentioned unpaid balance and thus we mailed out an initial dunning notice on April 29, to the patient informing the patient of the unpaid laboratory costs [redacted] contacted our office on 05/05/advising that she received our notice and refused to provide any documents to support here claims that she did not receive a check We have flagged the account as disputed and submitted to remove the account from her credit report Should [redacted] provide us with the explanation of benefits (EOB) for the service date of August 7, and if there is no mention of a check being sent to her, then we will cancel the account with no impact on her credit whatsoever We are aware of [redacted] policy to assume all risk for any denied tests and are not pursuing her for any balance other than the insurance check amount that she may have received If the explanation of benefits confirms that [redacted] received a check, she will be responsible for the amount of the check received that should have been previously forwarded to [redacted] Sincerely, [redacted] Collections Division Supervisor
