Monterey Collections was hired by the bankruptcy trustee for [redacted] to collect on some of their unpaid balances for services rendered. Monterey Collections was informed by [redacted] bankruptcy trustee that the patient’s insurance company mailed a check to the patient to cover the...

expense for numerous lab tests that were authorized by the patient’s doctor, instead of mailing the payment to [redacted]
Since the check from the insurance for services rendered was mailed directly to the patient, the debt remains unpaid and the patient is responsible for the amount of the check received. The account was placed with Monterey for the above mentioned unpaid balance and thus we mailed out an initial dunning notice on April 29, 2016 to the patient informing the patient of the unpaid laboratory costs.
We have not spoken with [redacted] to be able to explain that we need the explanation of benefits to determine if [redacted] is responsible for any amount. We have flagged the account as disputed and we are not currently reporting it to the credit bureau. Should [redacted] provide us with the explanation of benefits and if there is no mention of a check being sent to her then we will cancel the account with no impact on her credit whatsoever.
However if the explanation of benefits confirms that [redacted] received a check, she will be responsible for the amount of the check received that should have been previously forwarded to [redacted] I encourage her to contact our office to provide us with an explanation of benefits so we can investigate and resolve this matter promptly.

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I know my husband spoke with someone at Monterey conceerning this account.  The original payments was automatic withdrawal from our credit card account in the amount of $140 which the bank cut off because of frad activities.  Our first payment was made on 09/27/2015 so how are we 5 out 36 payments.  If the payment arrangement was for $100 a month for four months ($140 orginal amount) how does this balance goes back to orginal amount of $3992, they can not explain why the balance only went down by $82.  Even if you add the interest rate it still does not add up. I can submit our credit card statemennt to show evidence that these payment where taken out.  On top of this they were receiving out payments was still calling a harrassing us about payment.  Regards,[redacted] .

In response to the rejection received: As outlined in the original response, Mr. [redacted] was given multiple explanations of the amounts he was past due after falling delinquent in September 2016, after having made only 2 of his 24 contractual monthly payments. I apologize for any miscommunication that Mr. [redacted] feels occurred, but the amounts owed again, were explained to him, and representatives of Monterey encouraged Mr. [redacted] to view his account online on multiple occasions to manage and view his account status and details. Mr. [redacted] was not cooperative with Monterey representatives that he spoke with, and at no point made any mention of having difficulty viewing his transactions details. Had he done so, a Monterey representative would have gladly walked him through his online account to answer any questions he may have had, in effort to resolve his delinquent account. Mr. [redacted]’s claim that Monterey representative couldn’t tell him when his last payment was made is patently false. As stated in the initial response, Monterey representatives immediately reached out to Mr. [redacted] in September after his monthly payment that was set up on automatic draft was returned as “Insufficient Funds” from his bank. The situation was explained to Mr. [redacted] initially on 9-17-17, that his payment for September was rejected by his bank after July and August had drafted successfully. His statement that Monterey would not provide paperwork outlining how the added charges were valid is also false. Mr. [redacted]’s contract was sent to him at his request on numerous occasions prior to his default… the first of which was in July. Mr. [redacted] also mentions other online complaints against Monterey, but those complaints bear no relevance to his particular complaint, or the default of his obligation to the contract. As stated in the original response, Monterey Financial Services, LLC investigates and responds to every valid complaint received in a regulated forum. Again this is evidenced by the A+ rating we have earned through the Revdex.com.  At this point, the account has been returned to Achieve Today due to his default. The contract as it was sent to you was not presented to me in its entirety when I signed it. When the contract was offered to me, I was mislead to believe that with total payments including interest my total paid would be $3,846, which is still a ridiculous amount on its own, but even more astonishing and appalling at $6,636. I do not understand how it is even legal to charge someone $4,136 in interest to borrow $2,500. This is an outrage. What person in their right mind would agree to terms like this?  I also was mislead in that the part that stated [redacted] planned to place my account with Monterey Financial was not in the initial agreement I "electronically" signed. I am a very thorough person and do research on who I borrow money from and had I known that Monterey was going to be my lender I would have researched them and NEVER have agreed to borrow money from such an awful company. The initial agreement I signed was just a one page explanation and did not include any of this information and the woman on the phone explained it in such a way that it appeared that I would have this paid off in 2 years, that's 24 months, not 48. In fact, I believe those were her exact words. This entire agreement is a sham and after researching this company I am disgusted to find that this has not only happened to me, but to countless other individuals with horror stories of dealing with this awful company. As for your "attempts to bring the account current" this does not give you the right to call 2-3 times per day, and verbally accost your client over the phone. I have spoken with several different "agents" of yours and I don't know what you tell them in training but it is never okay to raise your voice at a client, yell at them, threaten them with "further action", lecture them on what YOU think is right, or try to tell them they HAVE to go obtain a payday loan to make their payment to you. This is most definitely harassment. I want my account transferred to another company immediately and want to deal with Monterey financial no longer, and I want an investigation into their business practices as they appear to be severely unethical.

In response to the complaint received:
At no point in time has Monterey Financial Services refused to provide [redacted] with his account information. [redacted] signed a contract with WAGS Financing on December 22nd, 2014, which was assigned to Monterey Financial Services Inc.  In the agreement...

with WAGS Financing, [redacted] Authorized for Direct Withdrawal, and Authorized Monterey Financial Services to debit his checking account in the amount of $116.07 for each monthly payment, starting 01-20-15 (attached agreement). [redacted] is indeed late one payment as he placed a “stop payment” on his April 20th payment. He is currently delinquent for the April payment in addition to applicable non-sufficient funds fees. I urge [redacted] to contact Monterey Financial Services toll free at [redacted] to make the necessary arrangements to satisfy his delinquent payment and discuss any questions he may have concerning his account.

Review: In May of 2008 I got a loan through CitiFinancial in Lexington, NC. I gave them my 1995 Ford truck title for collateral. The loan was paid in full in January 2013. Once the loan was paid I was to get my title back. As of today I have not received my title. I have received the paper showing that the loan was paid in full. I have sent 3 letters to 3 different addresses but no response. I had addresses for Lexington, Winston-Salem and Fayetteville, NC. No response from any of them. The loan originated in Lexington, NC. I would really like my title back. If they do not have it, I would like for them to request a duplicate for me.Desired Settlement: I would like my title back or a duplicate requested for me.

Review: A week ago I found out a lien was attached to my home by citi financial. However, this lien was never suppose to be attached to the home because I was going through a BK during that time (Feb 2009). During the title search to close on my home a week ago the lien was noticed (5100 and change). I had no other choice but to pay the lien because I had agreed to sell the home. I am asking citi financial to refund me my money because of chapter 13 process this debt was discharged in 2012.Desired Settlement: Refund the proceeds that were paid by the closing attorney during the closing of my home 5104. These funds were not warranted because the debt was discharged in 2012 through chapter 13 BK process.
