In response to the rejection received: As already outlined in the original complaint, Ms*** entered into a Closed End Consumer Product Lease (Lease# ***) with *** Lending on October 20, (copy of lease previously attached)On that day, the retailer (Buy & Save 2) drafted, and Ms*** voluntarily entered into this leaseAs originally outlined, all *** Lending agreements are sent electronically to the email address provided in the consumer’s applicationThis is done for the security and protection of the consumers*** provides a courtesy cover page included on all lease agreementsOn this cover page, the consumer must initial next to all critical terms of the lease, such as the total amount the consumer is financing, amount due to the retailer at lease signing, the monthly payment amount, the lease period, the total amount to be paid by the end of the lease term, and the purchase option at the end of the lease term if the consumer wants to purchase the product at the end of the lease termMs*** initialed next to all areas, including the “total amount you will have paid by the end of this lease”, indicating that she understood these terms before entering into the Lease AgreementFurther supporting the fact that this agreement is a lease, and clarity of that fact, is supported (and acknowledged by Ms***) in the “Notice to the Lessee” on page of the executed leaseOnce again, a Monterey Collections representative recently explained the facts above to Ms*** as recently as May 8, at 1:24pm PST, and even offered Ms*** a settlement offer well below the contractual defaulted balance & applicable feesShe failed to accept this offerDue to the facts outlined above, the balance will remain in collections and report accordingly, as an open, disputed collection item It should be noted that a Monterey representative spoke with Ms*** on August 26, subsequent to the original responseShe indicated that she would need to review her finances so that she could discuss a settlement of the contract, and indicated she would be calling our office back no later than August 31, to make the necessary arrangementsI urge Ms*** to contact our office today at 877-775-to make the necessary arrangements to satisfy her obligation to her defaulted lease Sincerely, *** *** Senior Manager of Finance & Quality Assurance

After Monterey’s first response to *** ***’s complaint, we received a copy of the explanation of benefits as requested in our original response Upon carefully reviewing the documents provided, Monterey Financial has deemed *** ***’s account as placed in error and we will be sending supporting documentation that confirms this in the mail to *** ***As stated in our previous response we have already completed a request to remove the negative credit reporting from *** ***’s credit

Monterey Collections was hired by the bankruptcy trustee for *** *** *** to collect on some of their unpaid balances for services renderedMonterey Collections was informed by *** bankruptcy trustee that the patient’s insurance company may have mailed a check to the patient to
cover the expense for numerous lab tests that were authorized by the patient’s doctor, instead of mailing the payment to ***Since the check from the insurance for services rendered may have been mailed directly to the patient, the debt remains unpaid and the patient is responsible for the amount of the check receivedThe account was placed with Monterey for the above mentioned unpaid balance and thus we mailed out an initial dunning notice on April 29, to the patient informing the patient of the unpaid laboratory costs
*** *** does not have an account with Monterey CollectionsHe responded to a letter that was sent to *** *** on May 17, We informed him we could not discuss this account with him as we needed to have *** *** authorization to release information to himOn May 18, we spoke with *** *** and explained what we needed to investigate the claim and she advised that she would attempt to get the appropriate explanation of benefits
We have flagged the account as disputed and we are not currently reporting it to the credit bureausShould *** *** provide us with the explanation of benefits (EOB) for the service date referenced on the invoice, and if there is no mention of a check being sent to her, then we will cancel the account with no impact on her credit whatsoeverWe are aware of *** policy to assume all risk for any denied tests and are not pursuing her for any balance other than the insurance check amount that she may have receivedIf the explanation of benefits confirms that *** *** received a check, she will be responsible for the amount of the check received that should have been previously forwarded to ***

contacted our office where this was explained to her, and Monterey has refunded

if you get a brochure from sun stone Dental with a quote " come in for a FREE dental implant consultation with CT scan of your mouth ($ Value)" do not believe them, first they will give you an appointment one and a half month in the future, and when your appointment approaches they will tell you "the dentist is not available that day" and you have to make another appointment one month in the future, and again when the second appointment approaches, the will tell you " the CT scan machine is broken" or the brochure is too old ( btw, I called them for my first appointment the same day I got the brochure in the mail)Would you trust them with your teeth under their mercy ?

rescission period outlined in the contract (on 3-29-16), Monterey has taken the necessary steps to have the information verified to close the account accordinglyI apologize for any perception of a delay in getting the cancellation verified, but the account has since been closed accordingly as a cancellation

The information written in response is again inaccurateAs for "Notification of this account transfer was sent to Mr*** on July 14, (copy of the notification also attached), contrary to his claims." I did not receive word of this change until September I have included the only notification that I received from them as an attachmentI have also included my responses to them as well to indicate that I received no true assistance in the matterMeaning all I received was notice a few days before I was to pay my bill, me asking why I was being charged when I could only see that my account was closedThe main confusion being that if I were to owe money and needed to make a payment then how I was I supposed to log into this new account? The web page only allows you to use a username and passwordThere was absolutely no help on this matter except an answer that practically outlines "we don't care pay us." Next up is the response that they included above from ***I never received this email and if I did it probably came through my spam in which I do not checkI delete them in bulk without reviewThere is also a couple of problems I have with this responseFirst of all, I entered into the service with a Nick Gitto and had only met with himThe last meeting was in July and the last time I used the service was August I felt as though the service contract had been termi***d when I went to make a payment in August and noticed that the account had been closedI went on about my life assuming that there was not a contract and never any contact from ***Until September when I inquired about the loan, I had first heard about owing money on September I have attached all communicationsWhen I responded with a complaint to the Revdex.com, I finally heard from *** in the form a phone call and an emailPrior to the complaint I had heard nothingI have two questions hereOne, why did the person assigned to me change to another person? Two, why didn't they call me and follow up? Lastly, it really only seems that I got any answers when the complaint was madeMonterey Financial cannot explain to me still why a loan would be transferred to another departmentAlso why would it need to be? I have never had that happen in any other loan that I have ever made a contract withA look at my credit history and you will see that I have never missed or been late on any paymentsAm I being punished because I made payments in a month to get a little ahead on the loan? At this point they can keep their money I have paid them and just close my account and not report it to the credit bureaus and I would be happyI do not wish to do business with either company because they lack the certain customer service and honesty one would expect from eitherEvery time that Monterey calls me it is blocked by a spam notice with many complaints listed about themThen they leave a message with a robotNone of these calls started until I also filed my complaint*** only seemed to care about my participation with their consulting firm after I made the complaint as well.

In response to the rejection received: As already pointed out in the initial response, Mr*** entered into the contract with Plantation Vacations of Myrtle Beach, LLC on February 3, (contract attached again)As explained in the original response, upon execution of the contract (that was signed by Mr***), Mrand Ms*** are bound to the terms of the contract and associated Master Deed as outlined in item of the contract named "Related Documentation." This section outlines "The purchaser acknowledges that the following documents have been made available prior to the execution of this agreement and the provisions of the said documents are incorporated herein by reference and made a part of the Agreement: (1) A copy of the Master Deed for the Horizontal Property Regime." Again, a copy of the applicable portion of the Master Deed is attachedIn the Master Deed it clearly outlines "If an Owner shall be in default in the payment of assessments, the Board of Directors may accelerate the remaining installments of the annual assessment upon notice thereof to the owner, and thereupon the unpaid balance of the assessment shall become due upon the date stated in the notice, but not less than ten (10) days after the delivery thereof to the Owner, or not less than twenty (20) days after the mailing of such notice to him by registered or certified mail, whichever shall first occurNo unit week may be reserved or utilized by any co-owner unless and until all assessments, late fees, legal fees, collection fees or other obligatory costs or expenses are paid in full..." She did state that she had new account information and needed to update it, however, she did not have it at the momentOur representative explained the payment would be scheduled with the account on file in order to keep her account out of collection review, but she would need to call by the end of the day to change the account number*** *** agreed to call back by 8pm CST; however, she failed to call back
Since she did not call back to update her billing information, the payment ran as agreed on 06/30/*** *** in fact authorized the payment of $If *** *** still wants a refund issued to her checking account ending in ***, her account with *** *** will be three months past due and she will need to pay it through a different methodI encourage *** *** to contact me directly so that we can discuss her payment options more in detailMy toll free number is *** *** ***
