As already outlined in the original complaint:Monterey Collections Services has been advised by *** *** *** that Ms*** (now ***) entered into a contract with *** *** *** on May 5, at 3:pm (contract attached in original response, and attached again)Ms*** failed to make the payments as scheduled in the attached contract via either the allotment that was set up or the automatic draft as authorized by the ACH Authorization (this is the same account that the borrowed funds were deposited into), and the unpaid balance was placed with Monterey Collections Services on February 2, as a result of her defaultThe required notifications were sent to her at that time outlining her right to dispute the validity of the debt within daysShe did not do soI would urge Ms*** to once again, review the attached validation of the debt and contact our office immediately at 877-775-to make the necessary arrangements to satisfy her obligation to the defaulted contract (balance of $3,as of today including all accrued interest and fees) It should be noted that the statute of limitations pertains to the length of time legal action can be brought about for the collection of the debt in questionMonterey Collections has not brought, nor does it intend to bring such action. In response to the complaint received: *** * *** *** entered into a contract with *** *** ***on 08-09-as *** *** states in the complaint, and the contract outlines an amount financed of $at a 16% APR (Contract attached)
The contract was assigned to Monterey
Financial Services the same day, per the “Notice of intent to Assign” outlined in the contractIn January of 2016, *** *** spoke to a Monterey representative after the account had become months past due on paymentsHe indicated that he had not been working due to surgeries/hospitalization that he had experienced and was unable to pay the account up to date, and was unable to afford the contractual monthly payment amount
At that time it was discussed that he would need financial assistance, where the Monterey representative arranged a reduced payment arrangement to prevent the *** account from becoming further delinquentWhen the contractual payments were reduced to an amount lower than the contractual payments as agreed upon in the contract, it was explained that the past due amount would be moved to the back of the loan, and the loan would be extended accordingly (due to the fact that the *** were unable to pay the past due amount up to date at the time)
At this point, the *** have made of contractual payments, and the account is currently due for the July paymentI urge the *** to contact our office to discuss their current financial situation, and to discuss any further questions or concerns they may have regarding their loanThey may also visit our website at *** to view their account status/payment history

Monterey Collections is a third party Collection Agency that was hired by the bankruptcy trustee for *** *** *** to collect on some of their unpaid balances for services rendered. We do not have access to *** *** insurance claim or insurance payments as that information belongs to *** *** ***
Monterey only has access to ***’s data base concerning the services rendered and the invoice # *** for services rendered on March 4, shows unpaid. As previously stated, should *** *** provide us with the explanation of benefits (EOB) for the service date referenced on the invoice, and if there is no mention of a check being sent to her, then we will cancel the account with no impact on her credit whatsoever
We are aware of ***’s policy to assume all risk for any denied tests and are not pursuing her for any balance other than the insurance check amount that she may have received. If the explanation of benefits confirms that *** *** received a check, she will be responsible for the amount of the check received that should have been previously forwarded to *** We have explained to *** *** our request for the explanation of benefits and per our last conversation with her on May 18, she was going to attempt to obtain the EOB. That being said, in an effort to resolve the matter amicably I have flagged *** ***’s account as cancelled and we will not be pursuing the matter any further

In response to the complaint received:
M[redacted] entered into a contract with [redacted] [redacted] on 1-14-16 (contract attached). This contract was placed with Monterey Financial Services, LLC where the payments were made as scheduled until September, where M[redacted] fell delinquent with...

her payments (transaction history attached). Once an account becomes past due, Monterey representatives attempt to reach out to consumers to assist them in bringing their account into good standing. Each time a Monterey representative spoke to M[redacted] she failed to make the necessary arrangements to bring the account up to date. At this point, M[redacted]’s account remains delinquent in the amount of $292.50 (including assessed fees). Per her request outlined in this complaint, Monterey will cease all future contact with M[redacted]. However, I urge her to contact Monterey Financial to make the necessary arrangements to bring her account into good standing to prevent any future late fees or negative credit reporting that would result from continued delinquency. She may reach a representative toll-free at [redacted] or visit our website at www.montereyfinancial.com to make the necessary arrangements and set her account up on an automatic draft to ensure timely payments.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  I will wait for the business to perform this action, at my schedule,(May 26th) since I am not local any more, if it does fix the situation to my satisfaction, will consider this complaint resolved.  If Mossman cannot fix this to my satisfaction, I want to have a third party inspect and report their findings, at the expense of the pool builder.  I have been dealing with Mossman on this matter since last summer.  I am not completely satisfied with the explanation of the spa air line being too far from the pump to provide a venturi effect.  And the leak was caused by the piping alteration, not present before.  The pool builder should not consider the job complete until the purchaser is satisfied with the operation.  The operation of the Mossman Pool was flawed from the 1st day with a defective filter, and pump that failed, spa jets blocked, water features that did not function as designed,and numerous other problems that I have recorded. The very least Mossman can do now is to make this spa operate similar to EVERY other spas I have ever been in.  That was what was sold to us, and that is what we expect to receive.

Although the issue was resolved it was like pulling teeth without the benefit of a numbing agent.  However, I must commend Aaron (female) for her assistance in this matter. Miss [redacted] has completed her 12 payments and can be seen in the attached payment history, she has now paid a total of $553.07. Her final payment was scheduled for 08/01/17 which has now been paid; Miss [redacted]’s account is paid in full. There will be no refund issued as there is no basis for her claims. If Miss [redacted] believes there is any type of discrepancy with the payment history I have attached I encourage her to call me at toll free 800-456-2225 [redacted].

Monterey is the billing agency of record for [redacted]. Records show multiple attempts were made by [redacted] to contact [redacted] regarding his signed lease agreement. [redacted] currently holds his lease agreement. Monterey Financial...

representatives have encouraged Mr. [redacted] to contact [redacted] directly at [redacted] to resolve his concerns. Monterey Financial is a third-party billing agency which works on behalf of financial companies and customers to manage billing and payments. Contractual disputes are directed to the company and the customer holder directly.

I went to Citifinancial on Hazeldean Road to pay a loan payment. I walked in, went to the reception, stood there and received no acknowledgment from the one person working. I understand he was with a client but he did not say any word to me or anything. After a while, I asked, "Is there anybody here that can help me? The reply was loud, aggressive and rude, "NO THERE IS NOT".

I had to go to another location to pay my loan the next day. [redacted].

[redacted]. You will pay a very high interest and you will regret going there. If you do not qualify for a loan elsewhere, get a co-signer or anything else but Citifinancial.

received:
Ms. [redacted] voluntarily
entered into a contract (attached) with World...

Discovered Pacific LLC on June
14, 2017for the purchase of a vacation club software license as outlined in the
contract. This contract was assigned to Monterey Financial Services, LLC on July
03, 2017 to service the payments outlined in the Retail Installment
Contract/Credit Sale Contract, where the account was assigned an account number
of [redacted] and the required notifications of assignment were sent to Ms. [redacted],
outlining her right to dispute the validity of the assignment. She did not do
so. On the contrary, her first payment scheduled on July 15, per the terms of
the agreement and as authorized in the automatic payment authorization (also
included in attached). The August payment was declined, and Monterey
representatives spoke with Ms. [redacted] on September 7, 2017 where she indicated
she wished to cancel the contract. The Monterey representative she spoke with pointed
out the 3 day rescission period (that Ms. [redacted] acknowledged and initialed as
understanding) that expired on 06-19-2017 per the attached agreement. After
setting up payments that she outlines in her complaint, Ms. [redacted] then contacted
our office on September 20, 2017 indicating that she was dealing with a death
in the family. The Monterey representatives discussed financial assistance
programs available to assist her through this time, but she did not want to
accept any assistance that was offered to her.
Due to the facts
outlined above, it is clear that no fraudulent activity as Ms. [redacted] alleges,
and I urge Ms. [redacted] to contact our office today at 877-399-6374 to discuss
her obligation to the loan. As outlined, if she needs financial assistance,
Monterey is willing to discuss and qualify her for such in the event she is
eligible.

In response to the complaint received:
[redacted] financed the purchase of a mattress & box spring bed, and sofa-bed from [redacted] on 9-27-15 (contract attached). The financing she received contained a "90 Day Payoff Option" where [redacted] was able to pay the amount financed...

($504.43) if paid by 12-26-15. This was also pointed out in the initial paperwork sent to [redacted] on 9-30-15 after the contract had been purchased and assigned to Monterey Financial Services. This was not done.
Monterey phone records indicate that no messages were received from [redacted], and that the only phone call received was on 1-6-16, well after the 90 Day Payoff deadline had expired. In this conversation, the Monterey representative that spoke to her, pointed out that the 90 Day Payoff expiration date had long since expired, and was no longer available per the terms outlined in the contract.
At this point, [redacted] is now delinquent for both her February and now March payments. She is still eligible for an Early payoff per the terms outlined. She also contacted our office on the 3rd of this month indicating that she had lost her job 2 months ago. It should be noted that Monterey Financial has financial assistance programs available to [redacted] if she is experiencing a financial hardship at this point, but the 90 Day Payoff Option is no longer available. As already pointed out, she is still eligible for a discounted payoff per the Prepayment clause in the contract & I urge [redacted] to contact our office toll free at [redacted] to make the necessary arrangements to satisfy her delinquent payments.
