It has been determined his account was enrolled as a result of the customer responding to a mail piece sent by Ethical Electric. The customer's account was canceled prior to receiving service with Ethical Electric therefore no charges were posted to his account. Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that it is slightly incorrect.  I was contacted by Ethical Electric and offered an amount that I originally requested along with an additional smaller amount due to an error per their math, their words not mine as well as charging me the original rate agreed upon for my final bill.  I find that this resolution is satisfactory to me.

[redacted] contacted the Revdex.com regarding a mail piece that was sent to him by CleanChoice Energy. [redacted] felt that the mail piece he received did not properly disclose information pertaining to the cost associated with signing up for renewable energy with...

CleanChoice Energy. Upon receipt of his complaint with the Revdex.com, a supervisor with CleanChoice Energy reviewed our history of communications with [redacted]. The mail piece that [redacted] received was distributed to residential customers in New York, giving them the opportunity to enroll for our renewable energy electric supply service. Included in that mail piece was disclosures about our prices, as well as the terms of the offer. We include a "[redacted] Box" in the disclosure statement component of the mail piece to clearly outline the plan details. Use of a box is considered by many to be an industry best practice. Additionally, there is a section in the disclosure statement component of the mail piece titled "Important Rate Information" which includes more information regarding the rate being offered in the mail piece. We appreciate Mr. Evitts' feedback regarding our mail piece, and will include it in our future marketing discussions.

Background:  An Ethical Electric customer in the [redacted] service territory incurs charges for electric supply from Ethical Electric as well as charges from [redacted].  When the customer remits payment to [redacted] maintains the payment history and applies the payment according to the utility's tariff.  Payments received by [redacted] from an Ethical Electric customer are applied by [redacted] in the following order:  1. [redacted] arrears.  2. Supplier arrears  3.  [redacted] current charges 4. Supplier current charges.  Payments applied by [redacted] to Ethical Electric charges are then transferred to Ethical Electric.  Any over-payment made by [redacted] to Ethical Electric may subsequently be withdrawn from Ethical Electric.
In an attempt to resolve [redacted]'s concerns, Ethical Electric contacted [redacted], via telephone.  [redacted] also attended the discussion, from his phone. During the initial conversation with the customer and [redacted]'s customer service representative confirmed that [redacted] had a credit balance with respect to his Ethical Electric charges and had a past due balance with [redacted].   As a result, Ethical Electric was prepared to provide the customer a check for the credit balance.  However, after the call with the customer was over, [redacted] further reviewed the customer's account and determined that a billing & payment error had occurred.  Subsequently, [redacted] withdrew payments that had been applied to Ethical Electric's supply charges and applied them to [redacted]'s outstanding balance with [redacted].  This correction and subsequent reversal of payments by [redacted] changed the balance on [redacted]'s account, for Ethical Electric's charges, from a credit balance to an outstanding balance in the amount of $319.88.  This correction is not within the control of Ethical Electric and is fully within the purview of [redacted].
However, at this time, Ethical Electric is choosing to waive any and all amounts due relative to his charges for electric supply received from Ethical Electric.  We have notified [redacted] in writing and over the phone, that he no longer has a balance with Ethical Electric.
Lastly, after the correction was completed, [redacted] notified Ethical Electric electronically, that [redacted]'s balance due for Ethical Electric charges had been transferred to Ethical Electric.  This notification communicates two outcomes:  1. The collection of any past due balance related to electric supply provided by Ethical Electric  (Ethical Electric's charges) is now solely the responsibility of Ethical Electric.  And 2.  As of the date of this notification, if the customer has a current or past-due balance with [redacted], that balance is completely unrelated to Ethical Electric.  Additionally, this notification generated a letter from Ethical Electric to [redacted], informing him of the past due balance.  It was our intent to prevent this letter from being mailed to [redacted], but we we unable to prevent the mailing and we apologize for any confusion this may have caused.

I am rejecting this response because:From: [redacted] <[redacted].net>Date: Wed, Nov 11, 2015 at 5:55 PMSubject: Re: You have a new message from the Revdex.com of Metro Washington DC & Eastern Pennsylvania in regards to your complaint #[redacted].To: [email protected] Sir,Ethical Energy contacted me to go over this case and ask if I can pull the 12 months of bills to inidcate the high fees that occured, in this case. I came to the conclusion that they have my billing that they can review their cost that inflatted highly more than my electric company , [redacted] Electric. in reading my bill had indicated that the third party was charging more than my electric company, in this case , if they're are  better, then why not a better and lesser cost, since the advertisment of better fees and cost are false on their part otherwise consumers would be doing more business with them instead of the electric companies. Ethical energy try and sell the consumer false hopeThank you for taking the time with my case[redacted]

kWh for three billing cycles with a variable rate thereafter and was billed in accordance with her agreement. As a gesture of good faith, Ethical Electric will issue the customer a goodwill credit for all bills issued at a variable rate. The credit is based upon the initial agreed upon rate and will be sent to Ms. [redacted] in the form of a check. On April 14, 2015, a supervisor with Ethical Electric spoke with Ms. [redacted] regarding the credit. We believe the customer is satisfied with this resolution.

[redacted] contacted the Revdex.com alleging that her account was enrolled for electric supply service with Ethical Electric without her authorization. We have reviewed the history of our communications with the customer and completed a review of [redacted]’s account....

The [redacted] residence received a letter from Ethical Electric d/b/a Clean Energy Option in the mail in March of 2016. The tear-away portion of the letter was executed and returned to Ethical Electric as authorization for us to enroll [redacted]’s account. At the time of enrollment, the customer agreed to an introductory rate of 13.3 cents per kWh for three billing cycles with a variable rate thereafter.  Our review has determined that a valid sale was made to the customer by way of mail. Ethical Electric has made three attempts to reach [redacted] by way of phone, however; at this time, we have not been able to reach the customer. On October 18, 2016, a letter was sent to [redacted] requesting that she call us regarding her complaint. Should [redacted] contact Ethical Electric, we will attempt to bring this matter to a mutually satisfactory conclusion.

Sales representative said the rate would not exceed my local utility's rate with in the first 6 months, however the rate jumped, almost doubling, after one billing cycle. I called to ask what happened and the representative said that there is only one month at the local rate and that I could lock in at a rate lower than the billed but still higher than the local company for 3 months. Cancelled them that day but still had to wait the billing cycle for them to transfer me back. I never received a notice of cancellation in the mail from them. Several weeks after I was back with my local company their retention dept began to call me every business day, sometimes more than once a day. I have repeatedly asked them to stop contacting me. Today when I told the rep that called that I have asked several times for them to stop contacting me she told me "well there are multiple suppliers in your area" and as I started to respond she hung up. This company is shady at best.

complaint, a supervisor researched the customer's account to ensure she was charged the correct rate. At the time of enrollment, the customer agreed to a month to month variable rate plan with Ethical Electric. It has been determined that [redacted] has been billed correctly as per her agreement with Ethical Electric. However, as a sign of good faith, we will provide the customer a good will credit. On June 18, 201 4 a representative with Ethical Electric called and spoke with [redacted] to notify her that she'd receive a credit in the form of a check. [redacted] claims no agent or supervisor with Ethical Electric attempted to reach him as per his concerns with the Revdex.com.
