interest of putting this complaint to rest we will accept Ms. French's desired settlement and cancel the remainder of her loan.  Her loan is being serviced by Monterey Financial.  I have sent notice to Monterey Financial that they are to consider Ms. French loan to cancelled as of today.

I am rejecting this response because: we put the contract and loan in dispute.  We did not default on the loan.  Coral has chosen to ignore our dispute so they can mark the loan in default.  This cannot be legal and  I will alert the FTC of these actions.  I also demand a letter in writing with the dates of this supposed default.  This is ridiculous!

In
response to the 3/9 reply from Coral Sands:
Yes,
I do now have a full understanding of the contract-only because I took the
document to a lawyer who explained what it really meant and not what I was led
to believe.
Our
friends who arrived at Hilton Head the day before us introduced us to Coral
Sands.  They met with Cliff Adams and
Sheldon, toured the Coral Sand Resort (with the lazy river) and bought into the
“points program”.  Both of us explained
to Sheldon (at different times) that we wanted to come down once a year with
our children and grandchildren and stay at the Coral Sands resort.  We were told that this could be
arranged-there was a 9000 point cap because we would be in the platinum
program-we could stay at any of their resorts on the island if they were
available.  I met with Sheldon Thursday
morning to sign the contract – when I saw that it was for a unit at Island
Links (which I never saw) and stated bronze coverage, I questioned this.
Sheldon told me that it didn’t matter since we were buying into the points
program and not the “traditional time share”. We could stay anywhere on the
island-that this was just a formality to get us into the system.  This is deception on his part and not  “confusion” on mine (or my friends). At this
time I also asked again about the 9000-point cap.  My question was, “Will I be able to stay at the Coral Sands
Resorts and pay no more than 9000 points-is that correct?”  He answered, “as long as a unit is
available”.  There was no mention of
booking less than 30 days.  I then asked
again, if there would be a problem if I booked unit as early as January 1st
for the following season (July or August)-he then said there should be no
problem-that he only had problems with people who wanted to book units in less
than 30 days and that they were not that readily available. Clearly, his
responses were made carefully to make me think everything was legitimate.
When
I returned home, and was allowed on the RCI web site (long after my 5 day
cancellation period expired) did I learn I was deceived.  I tried calling Coral Sands 10 times and no
one would talk with me-just said to leave a message and someone would call me
back.  It was not until I called and
pretended to be someone interested in a time share purchase, was I put through
to talk to a person (I believe the name was [redacted]) who finally told me the
truth.
It
is quite clear that this company’s sales tactics are deceitful and
fraudulent.  This contract should be
cancelled and my money refunded since it is not what was presented to me.  Why would I buy a timeshare for a unit that
I was never shown unless it was presented under fraudulent circumstances?
