Thank you for the opportunity to review the Revdex.com assigned ID *** NVHomes has reviewed the consumers’ complaint and disagrees with his assertions that NVHomes is trying to “fool” customers regarding the ceiling height in the basement media room of his home which is
currently under construction
NVHomes has, in fact, we have made every effort to disclose his ceiling height properly prior to him completing his purchase agreement with NVHomes The consumer did purchase the product/floorplan which is also the model home within this community He is correct that the construction of the ceiling in the media room of the NVHomes model no longer matches the actual design of homes being built in the community NVHomes made significant changes to the media room ceiling design based on feedback from numerous customers who had purchased the original media room layout and did not like the ceiling design More specifically, the prior design had numerous sections of the ceiling that dropped down resulting in an uneven appearance
NVHomes updated the ceiling design for the media room to address these concerns prior to this consumers purchase While the consumer did review our older existing model home with the previous layout every effort was made to disclose the new ceiling design More specifically, the NVHomes salesperson took the consumer o review the media room of another home that was completed to demonstrate the ceiling layout he would be receiving instead of the design in the model home The visit to this other home was made with the sole purpose of showing the consumer how his ceiling would look and confirming that he understood his home would be different from the model In addition, the purchase agreement the consumer signed with NVHomes states that NVHomes builds per the blueprints because there are oftentimes updates/improvements made to model homes Blueprints were made available to the consumer which shows the new design of the media room ceiling prior to him completing his purchase agreement
The consumer states in his complaint that NVHomes should have told him his ceiling would be different from the model home NVHomes did in fact inform *** *** before he agreed to purchase from us Furthermore, when the consumer first brought his concerns to our attention after seeing his home under construction NVHomes offered to completely rebuild his ceiling but required the consumer to pay for the changes as this portion of the home was already built The consumer did not respond to our offer to pay for this change even though we pushed our deadline back several times in a desire to accommodate his requests As a result, as communicated to the consumer NVHomes will make no changes to the ceiling design in his home under construction

I am rejecting this response because:Sorry, but the warranty should start from the LAST time the driveway was tore outIf I but a TV and it breaks I get a new one and the warranty starts from the day I got the replacementFurther more I sent several request prior to the warranty being up and the representative said they driveway was not bad enough YET! Exposed aggregate (had that) but could not move the aggregate with his finger nailGuess what?? Not only is it exposed it has since fell completely apart to the point where the hose rinses off into the yardWe are forming a group for a class action law suit against NVR as this is not the only community having the same problemsThere are two other communities that are have the same issuecommunities all having the same issue! Come on NVR get your head of of the sand and do what is right by your customers! It is a shame how we are being treatedKeep quoting your warrantysometimes you have to do whats rightRegards,

Thank you for the opportunity to look into the Revdex.com assigned ID *** Our *** Homes service manager has been in contact with the consumer The consumer understands that while *** Homes did install a drainage pipe shortly after their settlement in an effort to
help with the ground water, *** Homes does not and is not able to warranty naturally occurring springs or ground water situations Our *** Homes service manager has also explained to the customer that it is not our responsibility to maintain the drainage pipe that was installed roughly a year ago or take further action with the natural ground water (in accordance with our warranty and purchase agreement)
Our *** Homes service manager observed that near the entrance of the drainage pipe the consumer has placed a large rock which is currently acting as a partial dam and is dispersing the ground water several directions, some of which is draining towards their neighbors yard It was discussed that as a courtesy *** Homes would assist in removing the rock which was left in their yard from the original buildThe consumer also agreed to fill in the void from the rock and fill in the small gully that was created when the fence was installed between the two lots *** Homes discussed that the pipe is truly discharging a large percentage of the water off of their property, as designed, but that it is believed the rock was potentially crushing a portion of the pipe as well as damming and redirecting the remaining percentage of the water throughout the yard

was more? consistent with a water stain.? Having said that, Ryan Homes is willing to have a mold test inspection performed and is awaiting confirmation with the consumer.? The consumer has requested a replacement of hardwood flooring where carpet floor was previously installed.? Homes”However, NVR is not a successor to *** Homes, Incnor did NVR assume any of the liabilities to the closed customers of *** Homes, Inc The consumer does have a warranty on his home If any items fall within the warranty timeframe, the previous owner would handle the warranty claim This information has been provided to the consumer

The consumer signed the Maryland Purchase Agreement for her Ryan Home on December 31, which includes information on the? limited warranty in Section 6.? The consumer’s contract and signature are attached, acknowledging receipt of the warranty information.? All homeowners are given additional warranty information when they move in to their home via a USB drive.? In addition, the warranty information is is available at myryanhom.com under the? Warranty, Single Family Home: Maryland Residents pdf? (also attached herein for reference).? The specific language in the warranty is included under ‘Section V ??" AOne Year Warranty Items, Section Roof, Gutter, and Downspouts’ on page 23.? This clearly states the warranty coverage is year only and also includes instructions on properly maintaining the roof.? In addition, on page of the aforementioned warranty, ‘Appendix B Exclusions From Warranty Coverage’ item number 7.mnotes “Any loss or damage caused by acts of God or natural occurrences” is excluded.? The damage referred to by the consumer clearly falls under this provision as well.? ? In summary, Ryan Homes has performed in compliance with our contractual obligations.? The repairs requested by the consumer as outlined in the contract and warranty clearly occurred after the warranty expired and were also technically excluded from warranty coverage as this was a natural occurrence.?
