Dear *** ***-Thank you for the opportunity to look into the Revdex.com ID ***. We have met the consumer at his home to review his concerns. NVHomes has agreed to repair trim on the bay window that is chipped. There was not an issue found with the insulation though our service
team did discuss ways to improve the efficiency of the HVAC, including but not limited to window coverings, damper adjustments. Having said such, NVHomes has agreed to send the HVAC vendor to check the system. NVHomes appreciates the efforts of the Revdex.com in bringing closer to this concern. I am rejecting this response because:I don't believe this!! The only reason I require the so-called "different plumbing assembly" is because the Ryan assembly is permanently attached to the house's water supply line and can only be removed by a plumber! Incredible!Fine - I will take my case to the many consumer-oriented sites on the internetIf Ryan is going to make me pay hundfreds of dollars because of a a decision they made in order to save a few bucks, I'll see if I can't maybe stop the sale of at least one Ryan home by making their practices known to the publicGood job, Ryan homes! with the original scheduled settlement date. the Purchase Agreement Since the consumer has stopped payment on the hand money deposit, the contract was not ratified and does not need a formal release

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: ***I am rejecting this response because:There are several inaccuracies in the reply by the Corporate Customer Relations department and this is more then warranty work; I want the repair job that was started to be completed. The initial complaint started prior to December but was formally submitted on our day list as instructed by our Project manager; Brady.We were informed it would not be looked at until the spring thawThe pipe that was installed (as seen in these photos; *** ) is an improper installation of a french drain that was installed in February I communicated this with our project manager who said again, that I was right, they did a bad job and that it wouldn't be the permanent solutionHe requested that I wait a few months to see if it does anythingHe also said we didn't need to worry because it'll get fixedI asked what a permanent fix would be and Brady stated that most likely running a better pipe solution to the storm water drains during the development of the next phase of lotsThe problem did not go away so I filed a formal ticket on August 25th after trying to work with Brady and Shane (Brady's replacement) but nobody responded or followed throughIt was about months since *** took ownership of the issue but left it unresolved; not roughly a year. As seen in the photos there is no proper pipe entrance for customer maintenance or water flowThe placement of the rock was done so to prevent my daughter from playing in the marsh that developed.It was done after the water continued to seep through the ground not prior and has not gotten worse since the rock was placed there. You can see in the photos that the contractors hired by *** improperly installed a french drain using an unsleeved pipe without gravel and was certainly not deep enough to achieve the desired results of water mitigationThis is clearly a situation where corners were cutThey additionally damaged the silt fence to force the undirected water flow into adjacent lots which is eroding the land of the undeveloped lotsAny civil engineer or landscape architect will conclude that this was done improperly, without regard to consequence and is most likely causing additional water issues as a result of the corners cut. I have also included a copy of the customer warranty (in the attached photos) information regarding standing or ponding waterIt states under section "Performance standard" that; "The necessary grades and swales shall have been established by us to insure proper drainage away from the homeStanding or ponding water shall not remain for more than hours in the immediate area after a rain; except in swales which drain other areas." I still maintain that this has not been done and inferior/questionable methods were taken to attempt to resolve the issueI see no clause that identifies natural causes for ponding water to not be addressable issues. Further; The improper water mitigation installed by Fox Ridge and it's contractors violates MtJuliet storm water and water mitigation codes under section 4-and sub codes(4-through 4-106.303) in violation of Ordinance 2-20-and Ordinance No3013-(adopted Nov25th 2013) all sections through (in part but excluding section 9) and appears to also violate sections of the Federal EPA codeCFR 122.26.I have contacted the City of Mount Juliet for additional direction.Regards,*** ***

Dear Ms*** - Thank you for forwarding the additional comments from the consumer assigned Revdex.com ID ***. As previously stated, the remaining warranty on the home owned by the consumer is limited to the "structural warranty" which is specific to the load bearing components of the home. The consumer notes that she does not suspect the drywall cracks are related to a structural issue. Drywall settlement can continue to occur throughout the lifetime of a home and not something that NVHomes will continue to address. There will be no further action on this concern. I am rejecting this response because:Actually, city council asked *** about the driveway issues during the meeting for final phase of the developmentThe city was curious why they received calls about the city's deicers causing harm to multiple driveways in our development. Must of just been me? Driveways should not look like mine 6-months after being pouredIt's really that simple.

Dear Ms***, Thank you for the opportunity to look into the Revdex.com ID ***Ryan Homes’ service department was able to inspect the area of concern with the basement foundation on December 19, They identified a foundation crack typical of repair within the first year warrantyAs
this home settled in May of 2013, this type of issue would be beyond that time frame; though we were able to provide the consumer with a local contractor for repairs, costing considerably less than the original estimate provided by an outside vendorWe believe that we have addressed the concern in a manner which was satisfactory to the consumer.Ryan Homes appreciates the efforts of the Revdex.com in bringing closure to this matter. I am rejecting this response because:
We are going to need a few more weeks before we accept a
specific response as there are items that remain outstanding
We are allowing Ryan Homes the opportunity to fix these issues
out of respect for the efforts of the people directly involved in bringing
closure to these issues.? We do not
suspect that those involved in trying to fix the problems have contributed
directly to the issues we have experienced, but the efforts have been genuine
in making it right.? As a result, any
legal actions that would have been pursued have been placed on hold.? In addition, we will be holding off on
posting or submitting any corresponding photos/videos online and hold off on
passing out any associated flyers in hopes the efforts of a few can change our
hearts and minds
Ryan Homes has, since the complaint was opened, conducted
another survey of the home and finished some work as indicated in their
feedback to our complaint.? The
structural engineer came back out to survey the previous work and pointed out a
few minor things that needed to be done to complete that associated work.? The engineer also took a look at some of the
issues we had concerning the floor joists and the corresponding bulges we had
in the lower level floor directly above the main supporting beam and
corresponding support pillars in the crawl.?
In addition, we discussed with the engineer our concerns with the
drainage fix, the cracks in the drywall, the issues with the doors getting
stuck and the soil samples report where it indicates in the report and
specifically the concern with unstable soils and the statement “...not
recommended to build on this site due to organic fill present...”? We also provided the Ryan Homes? team that arrived on Wednesday? with the photos associated with our concerns as well as highlighted some areas on the initial engineering report and the soils report for discussion.Ryan Homes is awaiting the engineers written
report on the findings? by the structural engineer concerning the
issues identified with the floor joists and the corresponding bulges in the
lower level floor along with the other items that needed to be done with the
framing supports under the morning room and corresponding knee wall.? Drywall contractors will be notified to come
in and repair the associated cracks, nail pops, seam separations along with the
associated caulking.? Upon receipt of the
engineers report, Ryan Homes has assured us they will come in and conduct the
necessary tie-ins/bolting of the main supporting beams under the home and will
conduct the corresponding repairs to the lower level floors above along with
the doors and/or moldings associated
Wednesday, May 2016, was a good day towards resolving our
major concerns about the structural integrity of the home and the long term
integrity of our investment.? This has,
since day one, been our primary concern.?
While it does not completely erase some of the concerns we have
addressed in this note with regards to the initial craftsmanship of our home, those photos or those videos,
we do believe that the resulting issues are being addressed
It is estimated that the engineering report will be submitted
within two weeks and repairs conducted the following week and we would like this
complaint to remain open until such repairs are completed.? We are awaiting a call from the drywall
contractor to schedule in those repairs and have been told by Ryan Homes to
expect that call to come in sometime? this week.Regards,
