This vehicle is a 2004 and out of warranty for over 12 years.  The issue the customer has is with the dealer.  The dealer is a private owned and operated business.   This complaint need to go to the dealer not BMWNA.

As stated in the May 13 email, the review and technical evaluation of fault codes reveled that bike was found to have been operated outside of the engine’s normal parameters.  It exceeded redline on 5 occasions.  The resulting damage was determined to be negligence and improper treatment.  Warranty coverage for this repair has been denied.

I am rejecting this response because:
The light switch was in auto, regardless, the lights NEVER stay on with car switched off. The dealer...

claimed that "parking lights" were left on.  At first dealer tried to demonstrate that parking lights were left on in the car receiving bay, after several tries, every time the car was switched off the lights went off.  The dealer said that its because we are inside the darker bay, I told them we must go outside and show me.  We went outside in the daylight and the dealer tried to prove the lights on theory and again failed.  The dealer completely failed to demonstrate how the lights could stay on with car switched off. Even today, the lights cannot stay on when the car is switched off.  BMW and its dealership are unable to properly diagnose the car nor provide explanation for the battery drain hence the car may drain battery again at anytime due to improper diagnosis.  BMW and its affiliate are expecting me to accept unexplained battery drain which is completely unacceptable, I categorically REJECT this response.

BMW Financial Services contacted customer and apologized for their mistake in repossessing the vehicle. In addition BMW Financial Services provided $451.32 to reflect a car payment refund to include late fees.

time, December 20, 2014 and mileage, 46,661 mile.   Authorized BMW Motorrad Dealers are independently owned and operated.  BMW does not administer 3rd party extended warranties. Although we empathize with this situation, we cannot offer assistance in this case. We are closing our file on this matter and our authorized BMW Motorrad dealers are available to discuss the repair of this motorcycle.

I have personally reached out to the customer to offer to have the drivers side airbag recall satisfied a head of her vehicles schedule release, this is free of charge.  I also offered to schedule the appointment and while the vehicle is having the recall performed, to inspect/diagnose the error message, again, at no charge.  BMW of North America is attempting to work with the customer.  The customers refusal to cooperate is not understood.I sent the following email below this morning with no reply from the customer:   From: [redacted] (C[redacted]) Sent: Tuesday, August 29, 2017 10:21 AM To: '[redacted] <[redacted]> Subject: RE: 2011 BMW 328i Convertible - E537687 - [redacted] Good morning, I am going to have the driver’s side airbag final part sent to your local BMW center to satisfy the drivers airbag recall 16V-071.  While the vehicle is there, they will also inspect your error message for your passenger airbag.   Please confirm which BMW center you would like us to send an airbag. Thank you,Chris --BMW of North America, LLCChristopher A[redacted]Executive Customer Care Customer Relations and Services[redacted] Tel:      ###-###-####Fax:     ###-###-####E-mail: [redacted]Web:    [redacted]
