We do not email paid in full statements as a matter of company policyWe mailed the paid in full statement on the date that the complainant requested it, Sept 23, We update the credit bureaus weekly, and for this account, we are updating them that the account is now paid in full

Our collection agency received an account for the complainant on November 25, 2014, at which time we mailed him a detailed letter about the accountOur letter was mailed to the same address that the complainant has listed with this complaintOur letter was not returned to us by the USPSWe tried
calling complainant at the phone number he provided to our client when he was treated on December 16, 2012, however we were never able to reach himHe never contacted us about this account on his credit but rather filed this complaint against us, then after that he sent us a letter asking us to validate the account, so we are quite baffled as to why he filed the complaint before asking us about itWe are responding to his request for validation of the account as we have verified that the account remains unpaid

We have reviewed this matter and have concluded that the complainant fails to understand that in California, both spouses are responsible for the payment of each others medical necessities, whether or not they agree with thatI do not agree with the complainants version of events; he was VERY
aggressive in his phone calls to usIn any event, after our manager spoke with complainant, we agreed to take his name off of the account so long as his spouse keeps her promise to pay the accountWe also, as a courtesy, deleted the credit reporting of the accountAll this was explained to the complainant on November 16, and so as far as we are concerned, the matter is resolved pending payment from the patient

Complainant has one large balance unpaid account in our officeComplainant has never contacted us about the account, but rather is filing complaints against us with various organizationsWe will be sending a full validation of debt to the complainant, and we will not be deleting the debt from
complainant credit profile

[To Whom It May Concern,Since you have responded to my complaint for debt validation, I am requesting that you submit to me full records to validate the alleged debt within days.Additionally, I am allowed under the HIPAA law (Health Insurance Portability and Accountability Act of 1996), to protect my privacy and medical records from third partiesI do not recall giving permission to release my medical information to a third party I am aware that the HIPAA does allow for limited information about me but anything more is to only be revealed with the patient’s authorization, therefore my request is twofold and as follows;Validation of Debt and HIPPA Authorization- Please provide a breakdown of fees including any collection costs and medical charges- Provide a copy of my signature with the provider of service to release my medical information to you- Cease any credit bureau reporting until debt has been validated by mePlease send this information to my mailing address listed above and accept this letter as my formal debt validation request, which I am allowed under the FDCPA.Please note that withholding the information you received from any medical provider in an attempt to be HIPAA compliant can be a violation of the FDCPA because you will be deceiving me after my written requestI request full documentation of what you received from the provider of service in connection with this alleged debt.Additionally, and reporting of this debt to the credit bureaus prior to allowing me to validate it may be a violation of the Fair Credit Reporting Act, which can allow me to seek damages from your collection agencyI will await your reply with the above requested proofPer the standard, you have days in which to respond to this request, or this debt will be considered invalid, and removal from the credit bureau’s expected or damages will be sought after. With Regards, *** ***9/28/

The complainant is misinformedFiling a dispute directly with a credit bureaus does NOT constitute a request for validation to our companyWhen a consumer files a dispute with a credit bureau, the credit bureau notifies us and requests commentWe then investigate, confirm with our client that the debt remains owed, and respond accordinglyThe complainant has only ONCE requested validation of the debt to our office, on Sept6, Instead of contacting us about the account, complainant has chosen to file complaints suggesting our company operates illegally rather than communicate about the actual underlying debtWe mailed the validation response yesterday, which included a copy of the chargesWe are not entitled to the complainants private medical records, however if complainant wishes to receive those he can contact the hospital directly; we mailed only that which is required by the FDCPA and is not medical records.Regarding the interest, we have been trying to get complainant to respond to this debt since May of 2012, at which time virtually no interest had accruedCalls to the complainants phone number that he provided to our client were met with hang-upsWe have never been able to contact the complainant, and he has never attempted until now to contact us; this account has been reported to complainant credit for over yearsWe are only doing our job which we have been doing for many years, despite complainants' allegations of our being a 'scam' company and operating outside the confines of the laws that govern our industry

If I have accounts with his business why is this the only account being reported to all credit bureaus? I have had many different "dialogues" with many people over the years they have been reporting this debtAre they really insinuating I haven't contacted them regarding this debt? That's absurdI was actually an employee of this hospital at the time that they are claiming I brought a minor child in for careI was never contacted by the hospital (my then employer) regarding this debtMy minor children still see the same providers they have seen since they were born which is an affiliate of this hospitalI have chesked with them and I don't have an outstanding balance in their officeSo how was this bill generated? I have also since reached out to the hospital who states that they do not have any record of said debt and there is no balance owed by me to themI have filed only one other complaint with CFPB regarding this debt because it has NEVER been validatedThey have never sent me a contract with my signature showing that I am responsible for this debt and I then agreed to pay the debtFYI there were Octavia Porter's at the time they say I incurred this debt, she is a relative of mineThe only difference back then between her identification and mine was the day she was born on and the 1st numbers of her SSNHer birth month, year of birth and the last of her SSN match mineHer middle name is different from mineI have explained this to this collection agency on more than one occasion over the last years and that is the reason I deny the debt is mineWe have both been patients at this facility along with our minor childrenI would like the debt PROPERLY verified via a contract with my signature on itI have had to provide proof that other accounts at this facility were not mine because of the issue explained aboveI cannot verify the debt with the original creditor as explained aboveWhen I contact this collection agency the representatives are rude and vulgar, they yell and will not answer questions so I stopped calling and ask them not to contact meI starting writing letters and filed that complaint with the CFPBThis account/debt is not mine and I would like it removed from my credit file with all bureaus until the account is proven to be mineI also don't want this account sold to another collection agency and all attempts to collect this debt to cease until PROPER account verification has been established

In response to one of the complainants complaints to another entity, we provided complainant with a full validation of debt on August 11, We mailed it to the same address as he has on file with this complaint, and it was not returned to us by the USPS as undeliveredWe are bound by the FDCPA
to provide a copy of the bill when requested, and we did precisely that, along with an explanation of the balance due from the complainantWe are not bound to, nor interested in, responding to all the many other demands being made by the complainantWe have satisfied the requirements of the FDCPA and will provide nothing furtherThe debt remains owed, therefore will remain reported to the credit bureaus

While this case is highly suspicious, we chose to delete the account from the complainant's credit profile on January 11, 2017, and we have discontinued pursuing complainant for this account

We have mailed our validation of debts to complainant on two separate occasions, including copies of charges and explanations of balancesComplainant isn't satisfied with that but we have fulfilled the requirements of lawThe complainant states someone else has a name similar to hers, the evidence we sent the complainant clearly shows the minor child is named *** *** so we don't know how she could be confused about who owes this; does the other Octavia Porter also have a child named *** ***? Is the other *** *** also known as *** ***? We are reporting all accounts to the credit bureaus so we have no info as to why only one is showingIf complainant is correct that our client has told her she owes none of these balances, then why isn't our client calling to tell us? We have verified with our contact at client that the accounts remain owed

Although complainants story is not completely accurate, the truth is that the credit bureaus themselves do not allow credit deletions of accurately reported accountsWe often make exceptions though, and if complainant had simply called and asked us rather than filing a complaint we'd have deleted
the accountAs a courtesy, we have now instructed the credit bureaus to delete the item.

We do not email paid in full statements as a matter of company policyWe mailed the paid in full statement on the date that the complainant requested it, Sept 23, We update the credit bureaus weekly, and for this account, we are updating them that the account is now paid in full

We have mailed all relevant documents to the complainant as required pursuant to the tenets of the Fair Debt Collection Practices Act (FDCPA)

We have finally been able to locate the account that the patient refers toApparently the account belongs to a relative of hers that provided ID info on herIn any event, we have discussed this account with out client and our client has decided to cancel and close the accountWe deleted the item from the credit bureaus on April and sent a letter to the actual account holder on that same day.

The actions this company has taken against me has caused much grievance Therefore I will drop my complaint after this debt has been validated.I would like to see the original wet ink contract stating I owe this company a debt An accounting table that proves and shows how they arrived at the amount that they say I owe them I want to know the companies license number to collect debts and registration number I would like to see a contract giving them the authority to collect on a this so called debt as well
