I have spoken with both the HVAC company and the above homeowner to confirm that repairs have been completed on her system and that all is operational.  I had the HVAC company run a full diagnostic on the system to just verify that all other components of the system are in good working order...

The Ac is back on, however we still are having issues with the noise.  I have been in contact with the homeowner regularly and our last conversation I let her know that we have a [redacted] (AC manufacture) rep coming out to inspect the unit.

The above referenced yard has been looked at by the local warranty representative and area construction manager, and there is no need for the requested retaining wall.  The local representatives have instructed a landscaping contractor to rework the area with some riprap in order to assist, but...

they have not been allowed to make this corrective action due to refusal from the homeowner.  We are willing to make the above repairs if granted access by the homeowner.   Thank you,   [redacted] Customer Service Manager- Carolinas Division

This company has lied on the previous complaint stating we have come to an agreement. We have not. We asked for a retaining wall. But were denied after two other estimates state we need one. The manager came to the house and was extremely hostile screaming and yelling. We also has several other rewind on the website that remain to be addressed. When I spoke to [redacted] on the phone he stated he hasn't even got ahold of the landscaper to schedule the repairs. Today April 27, 2015

MESSAGE FROM BUSINESS:
We have arranged for landscaping repairs to begin on Tuesday, June 16th and should be completed by EOD Friday, June 19th. We advised Mr[redacted], who was given as the contact person for Ms. [redacted] of [redacted] of this today and he accepted the start date and plan of action.  We trust once the repairs are completed and confirmed to have resolved the situation, the case can be closed as resolved.   [redacted]Warranty Dept Mgr.

Our response will remain the same. I have attached our internal documents with Ms. [redacted]’s signature stating what she requested during her warranty period with regards to paint and the sign off is below as well with her signature stating she is satisfied with the work done and it is completed.

Yes, we have lived in our home for 4 years and I know the policy handbook states that we are only covered for the first year. DR Horton does not have to resend that and/or mention that every time we contact them. Perhaps, they could try fixing the problem instead of throwing that policy attachment into all the e-mails and complaints.  No favors have been provided to us at all.  I have proof that our issues have been on record since the first week we moved in. I have text messages, phone calls and e-mails stating that someone will come to fix the issues within "2 weeks". Unfortunately, they are all empty promises. They come once, then ignore us for months, until we call back. Very unhappy for now.

even though it is a month since I've reached out to Revdex.com. I did speak with someone from the Atlanta warranty office today. See attached phone screen shot.The work was scheduled to occur Friday and Monday. However only 3 vendors have shown up, two vendors rescheduled and multiple have not called. WeWe took off two days fromm work, again, yet will need to take additional days. [redacted], our representative, even commented that he didn't schedule the Painters. His response was that the email never did go through. So, no our work is not done. If necessary I can also scan copies of the work that still needs to be done.

Please enter your reason(s) for rejecting the business response below.  To set the record straight: First: the last response to Revdex.com by [redacted] of Horton stated that they had "taken several actions to assist Mr. [redacted] with his drainage concerns."The reality is that as I previously stated, they engaged in only one action: the placement of 'French Drains' on the sides of my home to alleviate some of the flooding which they claimed was caused by a lawn service using a rider mower. Blaming rider mowers seems to be the 'default position' for this issue. As a life long resident of Florida, I have never experienced the claim that a rider mower was responsible for property damage resulting in flooding nor in my numerous homes have I ever personally witnessed it. Second, Mr, [redacted] claims that "the back yard of his property was checked and we saw no signs or issues within his property lines." Untrue, and under separate and final cover, I will exclusively provide email evidence that this is false. Again, I once questioned the property borders, but my years long concern was with flooding in areas of my back yard, along with the sides (you have such photos already sent). HR Horton representatives acknowledged such an issue and promised (more than a year ago) that an engineer would come out to inspect it (I was on the list) and I just needed to be patient because things were moving slowly. A specific email will show this. The oft-repeated line by DR Horton representatives that they "went beyond their obligations" to address my concerns with property flooding is less than honest. I first went through DR Horton online warranty protocol (as they dictate) within my first 12 months at this property on the issue. In addition, I had several phone calls back and forth with [redacted] from Horton about this matter who was assigned to deal with me. Because of their contractor issues, my concerns were never resolved within the 12 month warranty period, and now Horton states that I am long out of warranty and anything they've done after that initial 12 month period was executed "as a courtesy."  In exasperation over any lack of action having gone through the "proper channels,' I finally emailed [redacted] a Horton Sales Rep, who sold me my home as well as the HOA management company at that time. And that's when Horton Construction Manager [redacted] got involved on this matter whose emails I will share with you. He was very sincere in attempting to resolve my situation, to the extent I sent a letter to the builder commending him for his diligence after he emailed that I was on the list and an engineer would, in fact, be inspecting my grading. Then...everything on this issue went cold and the denial of any builder responsibility or follow up began. And still continues. Final communication with actual emails to follow. ("Horton") response to the BetterBusiness Bureau ("Revdex.com") with regard to the above-referenced complaint.We are aware of Mr. [redacted] complaint about the noise levels in his house that he says isfrom the [redacted] Mr. [redacted] house is located between other houses on [redacted]
[redacted]see attached Google Earth image). There is also a heavily wooded area between the toll roadand the community.The U.S. Department of Housing and Urban Development (HUD) require sound studies forhouses that are within 1,000 feet from a highway, freeway, or heavily traveled road. Thisparticular community is farther than 1,000 feet from the 183 Toll road, thus no sound study wasrequired or obtained. There are no building codes or city/county requirements regarding soundproofing a residential house.D.R. Horton does not usually install sound proof windows in our homes. Due to the informationstated above we respectfully decline the desired settlement of Mr. [redacted] to install soundproof windows in his home. Thank you for giving D.R.
