[redacted] This is NOT something that was brought up after 3 years and 9 months and has absolutely NOTHING to do with a warranty but, rather a walkthrough item that was documented by [redacted] in January 2013 and NEVER honored (he and your company have ignored us since 2013 after the first walkthrough and several promises to take care of it). I've been emailing, calling, and texting for 3+ years trying to get this resolved with NO response. Now that I'm getting violation letters from our HOA, it has prompted us to reach out to you again. As stated in my email/letter to you on 5/17 - [redacted]e first noted that the sodding was laid incorrectly and asked us to provide this as an item on our list be redone back in 2012. You can't maintain a yard with grass seed and topsoil that is several inches thick with rock and limestone. You claim you threw some grass seed and topsoil in our yard but, I ask you what did this do for us or the sod that was not laid properly in the first place? This was to pacify us and not the original promise of raking the rock and dead soil out and re-sodding. Furthermore, you dug rock out and re-sodded for other neighbors on [redacted] and [redacted] just to name a couple that we are aware of. Why did DR Horton honor it for others but not for us? Wouldn't it be easier to honor a 3 year old promise rather than go back and forth on this issue? We are asking once again that you honor your original promise of taking care of this. Thank you.

Since being informed of the issues in her home, we have actively pursed completing the list that was given to us. This list was confirmed to have been completed as of this past week. Our company had offered to her, a complete re-cleaning of her home, along with a 6 month extension of her home...

Until the builder has completed the repairs as stated in the contract this will remain a problem.

The warranty manager will be contacting the customer to schedule an appointment to visit their home at the customer's convenience.
In responds to Mr [redacted] not finding our offer satisfactory and claims we have not communicated. We have communicated our response and he didn’t like the answer. I acknowledge that Mr. [redacted] would like a backyard with a revised slope. The Backyard currently has an acceptable slope and the grade promotes positive drainage form the back yard and the house pad elevation. The facts are that we have a 20’ private drainage easement at the rear of Mr. [redacted] home. We need to maintain the current grade because it is working as it was intended. We created a 30 day list and agreed to regrade and re-sod uneven sod. After closing we regarded the uneven sod and the rear yard is acceptable. As far as the property being a hazard or dangerous because of the slope we just don’t feel like that is the case. In fact, we believe if we revised the slope closer to Mr. [redacted] home and had a more severe slope towards the easement it would be more of hazard and there would be a greater chance for drainage issues. We made a good faith effort to re-grade and re-sod the yard and it is similar to everyone’s home backing to the easement. Nevertheless we attempted to remedy Mr. [redacted] concerns but the repairs were not acceptable to the homeowner. Finally, DR Horton feels that the rear slope of the back yard is safe and acceptable and promotes positive drainage.
Hello [redacted] This customer did not purchase the home from D.R. Horton, the original purchaser closed in 2005. [redacted] purchased the home in 2007 from a bank. The one year builders warranty for the original purchaser expired in 2006 and is...
non-transferrable. If they feel they have a structural issue Adrian can contact RWC as the 10 year structural warranty is transferrable however, it would have expired on the date of close of escrow (08/31/05) for the original purchaser this year. Thanks [redacted] [redacted]

I am rejecting this response because: There is clearly an construction issue with the mix of the concrete. As well as damage and stains left behind by the builder. I attempted to clean the stain using a light duty power washer. The power washer is eroding the concrete. A light duty power washer (under 1200 psi) should not be cutting into the concrete. I have filed a complaint with Manatee county and they will be inspecting the driveway. I'm also hiring an independent contractor to inspect the driveway as well. If the county and or contractor confirm that there's an issue with the construction/mix of the concrete, I will be moving forward with a lawsuit if [redacted] continues ignore the issue.

1. SECOND PARAGRAPH OF D.R. HORTON'S RESPONSE - We were Never given a copy of the MLS listing. We were shown the house by [redacted] and was quoted a price of $349,900. We went home. [redacted] contacted us by phone and we make an offer of $320,000.00 based on the quoted price over the phone. Within six (6) hours [redacted] phoned us to say that our offer was accepted. We were never given a "configuration sheet" during this process. Mr. [redacted] notation that we paid less that the MLS listing price is correct - $2,000.00 less. The MLS listed price was $322,455.00. After attorney review we found the MLS listing of $322,455.00. Another untruth is the comment that we received an explanation that the same house constructed on a different lot in the Camelot community would cost $20,000.00 more. That discussion never occurred with us and we resent the attempt by those representing D.R.Horton as some great benevolent benefactor. The MLS price represent a house that was completed in June and offered as a Quick Sale. There was an "unadjusted price" - Adjusted to fit a cash buyer. We have a copy of the listing.2. THIRD PARAGRAPH OF D.R.HORTON'S RESPONSE - We signed a contract based on [redacted] explanation that "a junior employee entered the wrong price on the MLS listing" with misgivings unaware that there was another option. As the attorney review was completed we signed the papers and gave a deposit of $5,000.00. Ms. [redacted] was unaware that we knew of the the MLS price when she presented us with papers justifying the $349,900.00 price. Her paperwork was prepared in advance. We did not inform our attorney of the pricing discrepancy. Furthermore, our attorney, [redacted], was unaware of this incident until we asked him if we could file a complaint days before the complaint was filed. It is our understanding that in New Jersey items advertised lower by a seller must be honored. We were not given the option of making a lower bid for this house. In addition, [redacted] works for the interest of D.R. Horton. She did not show up for the closing. She sent someone else to the closing who was completely unaware of what was taking place. We expressed our dissatisfaction with the entire process at closing and made it very clear that dealing with D.R. Horton was "Messy". We may or may not receive remediation for what happened. However, it is our expressed intent that D.R. Horton and those acting in their interest will conduct more honest, transparent transactions in the future. It is our belief that we were victims of "improper conduct" by those involved in this transaction. No letter from an attorney or anyone's attempt to muddy the facts will change what occurred. There is no misunderstanding. Thank you for your attention in this complaint.

they created by using faulty materials and poor contractors. They have
agreed to ONLY re-stucco and re-paint the rear of my home which only
eliminates 1/4 of the problem that they created and the remaining 3/4 of
the home is runny and it is clearly visible it was not completed
properly during construction. This is very different then my fellow
neighbors who had to file a construction defect lawsuit just to get DR
Horton to acknowledge that they made several mistakes during the home
construction and repair and repaint their homes. So far the repair
process has been HORRIBLY handled. I was originally told on 9-14 that
the repairs were to start on 9-23 and that they would take just a few
days to complete all the work. No contractors showed up on 9-23 and I
was told by the DR Horton rep [redacted] that the contractors had made a
mistake and would be coming the next day. On 9-24 two workers showed
up, laid down tarp and started taking off the old stucco. The workers
left and left the tarp on my lawn which started to kill my grass
immediately and they also left behind a sharp knife that they were using
to cut off the stucco. I moved the tarp and called DR Horton to find
out when the workers would be back and done with the work as my grass
just continued to die underneath the tarp. [redacted] assured me that they
would be back out to continue the work by 9am on 9-25 and that now he is
estimating that they will take one week to repair the stucco and he has
the re-painting scheduled in 2 weeks, but I never heard back from [redacted]
and no workers showed up again until 9-28 when they did no new work to
the back of my home, but left a ladder in the middle of my yard.
Tomorrow will be one week from when they started the work and by DR
Horton's rep [redacted]'s estimate they should have been completed. This
repair is already going poorly and explains why this problem came about
in the first place. I just need DR Horton to complete the work and
still I am requesting that they agree to paint the entire exterior of my
home, properly, so that we can close this matter and I do not have to
deal with them again.I tried to attached photographs but they would not upload. I would be happy to email any photographs or more of my documentation if needed.

I am rejecting this response because: the original warranty repair work was never completed correctly. A technician should come out to verify that the work was never successfully done properly. My warranty request was filed within the allotted time for the repairs to be made and I not left with fixing the incompleteness of a job done on the half of DR Horton. Attached is the technicians summary of a recent visit in which I had to pay to discover this work was not completed properly.
