In responds to Mr [redacted] not finding our offer satisfactory and claims we have not communicated.  We have communicated our response and he didn’t like the answer.  I acknowledge that Mr. [redacted] would like a backyard with a revised slope.  The Backyard currently has an acceptable slope and the grade promotes positive drainage form the back yard and the house pad elevation.  The facts are that we have a 20’ private drainage easement at the rear of Mr. [redacted] home.  We need to maintain the current grade because it is working as it was intended.  We created a 30 day list and agreed to regrade and re-sod uneven sod.   After closing we regarded the uneven sod and the rear yard is acceptable.  As far as the property being a hazard or dangerous because of the slope we just don’t feel like that is the case.  In fact, we believe if we revised the slope closer to Mr. [redacted] home and had a more severe slope towards the easement it would be more of hazard and there would be a greater chance for drainage issues. We made a good faith effort to re-grade and re-sod the yard and it is similar to everyone’s home backing to the easement.  Nevertheless we attempted to remedy Mr. [redacted] concerns but the repairs were not acceptable to the homeowner.   Finally, DR Horton feels that the rear slope of the back yard is safe and acceptable and promotes positive drainage.

We will be contacting [redacted] this week to schedule an appointment to meet, review, and resolve his outstanding warrantable items.

Please enter your reason(s) for rejecting the business response below.At this point DR Horton has not agreed to resolve the issue that
they created by using faulty materials and poor contractors.  They have
agreed to ONLY re-stucco and re-paint the rear of my home which only
eliminates 1/4 of the problem that they created and the remaining 3/4 of
the home is runny and it is clearly visible it was not completed
properly during construction.  This is very different then my fellow
neighbors who had to file a construction defect lawsuit just to get DR
Horton to acknowledge that they made several mistakes during the home
construction and repair and repaint their homes.  So far the repair
process has been HORRIBLY handled.  I was originally told on 9-14 that
the repairs were to start on 9-23 and that they would take just a few
days to complete all the work.  No contractors showed up on 9-23 and I
was told by the DR Horton rep [redacted] that the contractors had made a
mistake and would be coming the next day.  On 9-24 two workers showed
up, laid down tarp and started taking off the old stucco.  The workers
left and left the tarp on my lawn which started to kill my grass
immediately and they also left behind a sharp knife that they were using
to cut off the stucco.  I moved the tarp and called DR Horton to find
out when the workers would be back and done with the work as my grass
just continued to die underneath the tarp.  [redacted] assured me that they
would be back out to continue the work by 9am on 9-25 and that now he is
estimating that they will take one week to repair the stucco and he has
the re-painting scheduled in 2 weeks, but I never heard back from [redacted]
and no workers showed up again until 9-28 when they did no new work to
the back of my home, but left a ladder in the middle of my yard. 
Tomorrow will be one week from when they started the work and by DR
Horton's rep [redacted]'s estimate they should have been completed.  This
repair is already going poorly and explains why this problem came about
in the first place.  I just need DR Horton to complete the work and
still I am requesting that they agree to paint the entire exterior of my
home, properly, so that we can close this matter and I do not have to
deal with them again.I tried to attached photographs but they would not upload.  I would be happy to email any photographs or more of my documentation if needed.

Hello [redacted]       This customer did not purchase the home from D.R. Horton, the original purchaser closed in 2005.  [redacted] purchased the home in 2007 from a bank.   The one year builders warranty for the original purchaser expired in 2006 and is...

non-transferrable.   If they feel they have a structural issue Adrian can contact RWC as the 10 year structural warranty is transferrable however, it would have expired on the date of close of escrow (08/31/05)  for the original purchaser this year.   Thanks [redacted]       [redacted]

Per the terms of the signed warranty agreement at the time of closing, the customer's one-year warranty expired in April 2016, which was communicated to the customer via email.

While D.R. Horton acknowledges Claimants’ concerns, D.R. Horton follows the requirements of California law with respect to all of our homeowners.  D.R. Horton responded quickly to the call from Claimant on 11/30/2015 pertaining to a leak in her home. During the repair process, on 12/8/2015 Claimants stopped D.R. Horton from performing the remediation/restoration repairs, but later allowed the work to resume on 12/22/2015. Remediation and restoration work was completed on 12/30/2015 per the IICRC guidelines.   Claimants complaint referred to the leak, that was completed on 12/30/2015. The Revdex.com Complaint also refers to the emergency restoration company was in our home for a total of (10) days causing undo expense. As noted in the earlier response to the Revdex.com, D.R. Horton has requested Claimants to provide the electrical statements from [redacted] for November 2015, December 2015 and January 2016 to evaluate the excess amount of electric use for reimbursement. The last Revdex.com complaint item is requesting copies of the mold inspection report. On 1/5/2016, I emailed Claimants copies of the Post Remediation reports and mailed a hard copy. Claimants have convoluted the leak repair matter by involving their insurance company, their attorney and last the Revdex.com. D.R. Horton, as a gesture of goodwill, is offering a one-time courtesy payment of $1,500.00, with a signed release, to resolve this matter.  The electrical expense is included as part of the courtesy offer. The courtesy offer will expire on February 1, 2016.  This is D.R. Horton’s final offer. No further negotiations will be discussed.   Thank you for your time in this matter. This issue has been addressed several times through the Revdex.com, emails and multiple conversations with the homeowner.  As the homeowner has indicated we have offered a solution that would completely remove the drainage swale from her property.  We feel that this is a fair solution for both...

We have spoken with the customer and confirmed this is an old complaint and all warrantable items have been addressed.

The warranty manager has been in communication with the homeowner and while the home, which was closed in 2014, is no longer covered under warranty, we are reaching out to the window vendor on the homeowner's behalf to help facilitate a resolution.

We appreciate the customer reaching out regarding their concerns and apologize for the delay in responding to the Revdex.com file. It is our understanding that the open items have been addressed and our warranty manager has emailed the customer to confirm.
