The Educational Credit Management Corporation is trying to bully me. I have told them already that I am working with another company to consolidate and create a repayment plan. They are very aggressive.

The Educational Credit Management Corporation is trying to bully me. I have told them already that I am working with another company to consolidate and create a repayment plan. They are very aggressive.

Two of my oldest loans (from 2007) were sold to ECMC in Feb of 2018. I received no notification of it being sold nor it going into default. While doing research on how to get my loans paid off quicker we happened to find out that these two were in default on the national student loan registry. It took a while for us to figure out where they were sold to and finally when we spoke with them we found out both me and my husband were placed on the Do Not Call list. Have no idea why. So no calls. They had a very old address, which we updated on their site before speaking with them. They said they sent emails to me, but I have no record of it. I have gmail so I have quite a bit of storage. When we finally spoke with them they could provide NO proof of them contacting us or anything of that nature. They could only tell us they obtained the loans through Navient after they went into default. Navient has no record of the loans nor them being sold....depending on which rep you speak with. ECMC has transferred us a billion times only for us to find out I cant even do loan rehabilitation because it would pay off the loan. ok....that makes sense. Loan Consolidation would require a lot of personal information of our friends they require as references which we were not comfortable with. They only want us to settle for a few hundred less than the total loan amount and then pay it off completely. I have a mortgage, car payment and bills. Their amount would put us severely in the hole. Since I wasn't even notified about this default I feel it isn't fair since the whole reason we even found out was because we ARE trying to pay off ALL of my loans.

In 1983 I took out a student loan for $2500 from Dime Savings Bank in New York to go to beauty school. The school close shortly after I took out the loan and I didn't pay it back right away. The beginning of 1997 I settled with NYSE dept. and for two years I made payments of $134 with my last payment being a payment of $46. That was over 20 years ago and the letter showing that I made all my payments satisfactorily has been missed placed over time. In April of this year a collection company called ECMC was able to take my $3700.00 tax refund stating it was for repayment of this defaulted loan ( which was paid in full in 1999) I spoke to a man named Philip I explain my situation and the mistake their company made and asked for my check back which she told me no and of the burden of proof is on me. The problem lies with the New York State education Department and their collection agency called HESE . In 1993 thru 1994 both companies were in the process of updating old computer software and I was told after speaking to a Bruce fellows at HESE and a Justin at the New York hire education department that the loan because the 93 was defaulted went back-and-forth Twice. Making it look like I had two loans. Both companies never corrected their information and in 1999 when I repaid New York State education Department the defaulted loan in full they never informed HESE. So it still looks like I have an outstanding defaulted loan which I do not. ECMC could have found all of this out if they would've investigated like I did. I sent them a copy of my loan payment and a letter stating that I paid the original loan in full . I also sent it in an email and I got a return email from them with the revised bill of over $1000. They're assuming that I had two loans or that I never paid the first loan. Because I pay this loan in full and it was only one loan they must return my tax refund to me. Anything after 1999 payments should have nothing to do with this situation / ECMC

At this time he explained your account balance was valid and owing at the time HESC transferred your loan to the U.S. Department of Education (ED) and was not paid in full. At the conclusion of the conversation you indicated you were going to call ECMC about getting a quote to pay your account in full however you still dispute the balance. They're assuming that I had two loans or that I never paid the first loan. Because I pay this loan in full and it was only one loan they must return my tax refund to me. ECMC first sent me a check that didn't even have my name correct let alone my address! When I called about my issue they refused to do anything about it stated that I needed to try everywhere before I could even think about sending the check back! After about 2 weeks I was finally able to reach someone that was able to give me a return address to send the check back and recent at another one. After doing so I received the second check today and low and behold the address on the check is still not correct. The only reason I got it is because my mailman Knows My Name! So I now have to return it and do the process all over again. Not to mention how unprofessional and downright rude customer service has been this entire time. I have been hung up on, placed on hold for over an hour at a time as well as transferred to different departments, then back to the same Department! I was refused information on filing a complaint, getting information for the corporate office, and getting to a manager.

This is in response to your complaint filed with the Revdex.com on May 10, 2018 concerning your husbands defaulted student loans guaranteed by Educational Credit Management Corporation (ECMC). Based on the promissory note signed by Mr., he has granted ECMC permission to speak to you regarding his account.

As a federal guarantor, ECMC is required to participate in the Treasury Offset Program (TOP) and is required to send notification to the U.S. Department of Treasury (Treasury) on each defaulted borrower in their portfolio who is not in a current payment arrangement. Through this program, Treasury may offset this debt against all payment streams authorized by law, either currently or in the future. These payment streams may include (but are not limited to) federal and/or state tax refunds, Social Security benefits, and/or federal travel reimbursements. ECMC records reflect one TOP payment totaling $5,375.13 posted to your account on March 6, 2018.

That same day, ECMC received a Tax Offset Hardship Refund Request form signed and dated by Mr. on March 5, 2018 and attached to this response. On March 12, 2018 ECMC reviewed and approved a partial refund in the amount of $135.36. As the original offset was for a joint return, the refund is required to be made payable to both individuals. The refund was issued to *** & H.W. ***. The refund was mailed to the address listed on the Tax Offset Hardship Refund Request form of ***, Brownfield TX 79316. The check in the amount of $135.36 was cashed and reconciled with our bank on March 20, 2018.

On March 16, 2018 ECMC received a Tax Offset Hardship Refund Request form signed and dated by Mr. on March 14, 2018 which included additional information and is attached to this response. ECMC reviewed and approved the additional refund in the amount of $5,239.77. As the original offset was for a joint return, the refund is required to be made payable to both individuals. The refund was issued to *** & H.W. ***. The refund was mailed to the address listed on the Tax Offset Hardship Refund Request form of *** Brownfield TX 79316.

On April 10, 2018 you called ECMC stating you were having difficulty cashing the second check. You said you would try a couple of other banks and call back if you needed the check to be reissued. On April 11, 2018 you called ECMC and stated you were unable to cash the check sent due to a name & address issue. You requested the 2nd check to be mailed to the 605 address and you requested your spouse’s name to be listed as *** W.

On May 7, 2018 ECMC issued another check in the amount of $5,239.77 and mailed it to the *** address. You received this check on May 10, 2018 but because the address listed E instead of W you refused delivery and returned it to the postal carrier. On May 15, 2018, ECMC issued another check and sent it via overnight mail to the address of ***. This check was made payable to *** W *** & ***, in the amount of $5,239.77. The UPS Tracking Number for this package is: ***.

You also expressed frustrations in dealing with ECMC representatives when attempting to resolve the issues with the checks. Please note, the original checks were mailed properly to the addresses provided by Mr.. It is unclear why he provided two different addresses – one on March 5 and the other on March 14, 2018. ECMC had no way of knowing the change of address was not correct. After about 2 weeks I was finally able to reach someone that was able to give me a return address to send the check back and recent at another one. After doing so I received the second check today and low and behold the address on the check is still not correct. The only reason I got it is because my mailman Knows My Name! So I now have to return it and do the process all over again. Not to mention how unprofessional and downright rude customer service has been this entire time. I have been hung up on, placed on hold for over an hour at a time as well as transferred to different departments, then back to the same Department! I was refused information on filing a complaint, getting information for the corporate office, and getting to a manager.

This is in response to your complaint filed with the Revdex.com on May 10, 2018 concerning your husbands defaulted student loans guaranteed by Educational Credit Management Corporation (ECMC). Based on the promissory note signed by Mr., he has granted ECMC permission to speak to you regarding his account.

As a federal guarantor, ECMC is required to participate in the Treasury Offset Program (TOP) and is required to send notification to the U.S. Department of Treasury (Treasury) on each defaulted borrower in their portfolio who is not in a current payment arrangement. Through this program, Treasury may offset this debt against all payment streams authorized by law, either currently or in the future. These payment streams may include (but are not limited to) federal and/or state tax refunds, Social Security benefits, and/or federal travel reimbursements. ECMC records reflect one TOP payment totaling $5,375.13 posted to your account on March 6, 2018.

That same day, ECMC received a Tax Offset Hardship Refund Request form signed and dated by Mr. on March 5, 2018 and attached to this response. On March 12, 2018 ECMC reviewed and approved a partial refund in the amount of $135.36. As the original offset was for a joint return, the refund is required to be made payable to both individuals. The refund was issued to *** & H.W. ***. The refund was mailed to the address listed on the Tax Offset Hardship Refund Request form of ***, Brownfield TX 79316. The check in the amount of $135.36 was cashed and reconciled with our bank on March 20, 2018.

On March 16, 2018 ECMC received a Tax Offset Hardship Refund Request form signed and dated by Mr. on March 14, 2018 which included additional information and is attached to this response. ECMC reviewed and approved the additional refund in the amount of $5,239.77. As the original offset was for a joint return, the refund is required to be made payable to both individuals. The refund was issued to *** & H.W. ***. The refund was mailed to the address listed on the Tax Offset Hardship Refund Request form of *** Brownfield TX 79316.

On April 10, 2018 you called ECMC stating you were having difficulty cashing the second check. You said you would try a couple of other banks and call back if you needed the check to be reissued. On April 11, 2018 you called ECMC and stated you were unable to cash the check sent due to a name & address issue. You requested the 2nd check to be mailed to the 605 address and you requested your spouse’s name to be listed as *** W.

On May 7, 2018 ECMC issued another check in the amount of $5,239.77 and mailed it to the *** address. You received this check on May 10, 2018 but because the address listed E instead of W you refused delivery and returned it to the postal carrier. ECMC has filed tax lien on me and has not even attempted to contact me in the past year. I have maybe seem two attempts over three years. That even includes while I was homeless. I would have tried to work something, but no contact from them, they went straight to tanking my tax return.
