The customer was offered our Performance Guarantee which states : If publisher does not activate service within the first thirty (30) days of this agreement, client may opt out
of this agreement without penalty and receive a 100% refund of start up fees. The customer agreed to the service on December 1st, and was full activated on December 30th. The customer does however have the right to an early termination which is set forth on the eGumball.com Terms and Conditions page.Per the terms and conditions (***) of the contract, Clients reserves the right to terminate the Application/Contract, in which case the full contract balance will be due and payable immediatelyEarly cancellation (except for rescission within the first three days ) or cancelled in writing after the Contract converts to month-to-month status, will result in an early termination fee of 100% of the remaining contract balanceThe customers cancellation request was honored when received and payments have been stopped. These terms and conditions are in place to mutually protect both parties due to the enormous resources expended by both the customer and eGumball

After I filed the Revdex.com Complaint Egumball did decide accept cancellation of my service and further payment obligations. Now, the day after they answer the complaint, I am contacted by egumball (months after services stopped and Revdex.com complaint filed) and they are now claiming that I owe the balance of the contract (months-$750) threaten to turn account over to collections. No calls prior, no bills in the mail...nothing. Just threats after Revdex.com complaint. The account manager that cancelled the account and further payments...of course...no longer works there. They completely failed at the service that they guaranteed, and now claim that they never was a guarantee of performance. I am still seeking refund of ALL monies paid for their service (or lack there of)

Production emails detailing each
step of our service was emailed on 2/17, 2/21,
2/24, 2/25, 2/and 2/All emails provide detail as to work performed
alongside contact telephone numbersPer the email received by the client on
2/28, the client was provided username and password credentials to upload his
photosOn 3/6/2014, we received a conference call from our client and the
clients bankThe client wanted to cancel and did not want to discuss the campaign during this conference call
Consequently, our concierge department didn't have the chance to go over the uploading of the
photos since the client refused to discuss his account. If the 24th was so important to the client why didn't the customer call us on or near the 24th?

As per our Terms of Service (http://www.egumball.com/terms.html),
eGumball cannot guarantee specific search engine results or placement due to
the unpredictable nature and constant changes being made within search
engine
algorithmsIt also states in our terms of service, as well as in the contract
that once the contract is signed, the customer must see the contract through to

We are rejecting this response/offer because we have gone around in "circles" with eGumballeGumball continues to use verbiage that highlights what "they" believe is their positive track record -- however that has not been our overall experience. We have documented that eGumball failed to inform us that they could not do any work with the "***" search engines because *** is for sale. We also documented that eGumball uses an outside contractor source to sell their servicesthe outside contractor misled our business in believing we were under a 3-month agreementQuite frankly we hope eGumball accepts and understands that we, at 1st Avenue Salon - along with a series of other complaints filed against them, are NOT SATISFIED with the services they tried to provide

On 3/we asked the customer for the username and password for their *** ** *** listing in order to make changes The customer said that they would email and sent an incorrect username and password We attempted on multiple occasions to reach the customer through email
and phone calls to obtain the correct username and password After discussing with the customer, they informed us that they did not have access to the listing which required eGumball to take further action to recover the claimed listing Once eGumball gained access to the listing we were informed by *** that there was an internal issue with ***’s system that caused a merge between different business listings (1st avenue salon by Veka / 1st Avenue Salon) This contributed to the incorrect map location showing the previous location The customer was given access to their online control panel which allows for them to add information to their online profiles and also add the coupons and offers to the network. The customer’s claims of a month service agreement were not validated and we have informed and confirmed with the customer that the signed service agreement was for months and the months was also verbally communicated during the initial consultation We understand the customer frustrations and feel that the their concerns have been addressed and a further concerns can also be resolvedAlthough there have been challenges that needed to be overcome in order to reach the desired results, the customers online visibility has increase and the customer is ranking on the first page of *** We ask that the customer contact their Account Executive to further discuss the progress that has been made on the account and to review the results that have been obtained They can be reached at *** ext*

improve our customers’ rankings

is a Google Adwords Partner and a map optimization service helping businesses
rank higher in Sponsored Ads, Google Places, Bing Local and Yahoo Local. Our client signed up for our maps
optimization not our Google Adwords where it is
common place for our reps to

During the sales presentation, and as confirmed by our client’s
statement, we charge $per month in addition to a one time set up fee of
$as contracted. Total is $358.00. Our client signed our contract on 07/24/
On 07/31/2014, during our set up process, we discovered
a number of incorrect and duplicate listings.
We spoke with our client about the listings to be corrected:

contract signage and after a great deal of work has been rendered

frustrations, and hope that with further communication, the concerns can be

service representatives on 7/8/and the services were further explained to
her, as well
as the progress that has been made on her accountShe agreed to
stay on board with this service after this conversation
According to our terms and

may receive a 100% refund within the first three days of signing an agreement
to the contractThe cancellation letter must be received by fax or email, and
rescission cancellations are now allowed by phone callThis customer wanted to
cancel after this three day cancellation period, and is not entitled to a full
refund

As we continue to say, services are not as per contractWe are still not being listed with the correct address of *** *** *** - in fact many listings are reflecting *** *** (on first page listing which is from years ago) or 11-12th street (which is from year ago)We have spent countless hours upon hours to work with themThey are not honest, they are harassing, transferring us to over a dozen employees at eGumball and having to explain or issues over and over againWe asked them to terminate contract amicability and they are requiring us to sign a legal document, attached, that they will do that as long as we remove all our negative listingsWe refuse to do that, our reviews are honest and reflective of their servicesWe have continued to pay them even though we've been trying to resolve our issues to no avail and will continue to pay until our contract terminates in NovemberI ask the Revdex.com to honor our request in our favor to terminate contract, with the right to post our legitimate reviews which is freedom of speech and cancel contract without penaltyIf you read their reviews we are not the only customer with the SAME CONCERN AND ISSUEThis is a terrible way to run a business - chasing after your moneyWe've had issues with them from the start which increased when we made our first move to the 11-12th street addressEach time we wanted to cancel the contract they enticed us with a free service and promised to fix the listings which hasn't happenedMy second screen shot shows the wrong address again along with an error of all the listings which they are to manage.
The contract reads: Monthly Service Includes - local category research and analysis - never receive, Optimized listings in *** places and *** - address is not correct, 24/*** places algorithm monitoring - no proof this is being doneThey are absolutley not in line with their contractWe signed in February because they offered free Apple maps add-on, that's not working eitherTheir performance guarantee is not withheld - contact also attachedI've been working with them aggressively since February on the latest contract because we had a business address changeThey didn't have our address right on their own myserviceprofile site for monthsThis and all my phone calls have been documented
Please, after all this evidence submitted, allow us to terminate contract immediately with no penalty

eGumball has a proven record of success which is derived directly from improving our customers online presence. These successes can be seen for this customers campaign and viewed through multiple avenues such as the increase of consistent online citation sources, increases in
rankings, and increases to the traffic of the customers online listings. Upon initial review of the customer citation cluster multiple business names and addresses were found to be associated with the business online. Addressing these issues is a mutual concern that requires diligence to fix, create, and manage the data which is associated with the business. While 100% accuracy is the goal, fixing the many years of inconsistencies is a tedious process that requires ongoing servicing of the data. While we understand the customer frustrations, our goal is to work with our customers to highlight the work which has been performed and to address all of the challenges both past and present are associated with our customers campaigns. We have attached screenshots which highlight the improvements which have been made in a few key areas. While this does not fully illustrate the progress on the account, we ask that the customer contact their Account Executive to discuss and review all their areas of concern
