In the complaint the Customer states that she
purchased a “Swiffer Wet-Jet re-useable pad” from a seller on Etsy which she
states did not work as advertised
Etsy’s Terms of Use, to which the
Customer agreed, state “[s]hould you have a dispute with one or more users, or
an outside party, you release Etsy … from any and all claims, demands and
damages … of every kind and nature … arising out of or in any way connected
with such disputes.”
Buyers on Etsy may file a case in order to
resolve disputes such as these (***)
Our records indicate that the Customer filed a case on 6/**/A member of
Etsy’s Trust and Safety Team mediated the Case between the buyer and the
seller, ‘***’Based upon information provided by the seller, Etsy was
unable to mediate the dispute via Etsy’s Case SystemIt is unfortunate that

By agreeing to Etsy’s Terms of Use, the Customer has agreed to “release Etsy from any claims, demands and damages arising out of disputes with other users or parties.”In the complaint, the Customer claims that he purchased a personalized sign from a seller on Etsy (the “Seller”) and that he is displeased with the durability of the sign after seven months of use.To reiterate, transactions on Etsy occur directly between a buyer and sellerThe Seller that the Customer purchased from is not an employee of Etsy, but operates a shop on Etsy.com.According to our records, the Customer did not open a case on Etsy for this transactionTo clarify, the Etsy case system is a platform where buyers and sellers can work together to resolve issues with an orderIf necessary, Etsy Administrators may assist in the mediation of the disputeUnfortunately, as previously advised by an Etsy Administrator, the day window to open a dispute for this order has expiredAs a venue, Etsy is not directly involved in the transaction, and we are unable to mediate between the Customer and the Seller outside of our dispute systemOnce the eligibility to file a case has expired, it can not be reinstated

Nothing has been resolved. You are enabling sellers to peddle goods that expire outside of a time period that an item should last. Not only do you not help mediate a resolution to the problem you don't have a means to warn or leave feedback for others that look at a prospective buyer. For all I know the vendor that stole my money has done this multiple times before but there is no way I could have known that. I purchased an item that was advertised to last in exterior conditions and I paid extra for that service and what I paid for has failed. I still have a sign that is falling apart because the vendor made it poorly and for all I know had never applied any exterior coating which is what I inquired after and paid for. I would like to know the product that was used for this exterior coating that if properly applied would last less than seven months

they never contacted me prior to suspending my account I have no emails or phone calls from them if they contacted me prior then show me proof, ironic that the warning email was never received yet the suspension email went through with no problem that's because they never sent me a warning they are lying and my art work is handmade I wrote them and told them my account had been hacked because there were items, a bunch of rings and wedding dresses which I don't have to even sell if I wanted to, I did not list on there and I deleted those items
they refused to even lift my suspension so I could at least buy things on the website and you don't need to open a store to buy things on there They are lying they never sent any warning and when I emailed them about getting no warning there was never a mention that they hadso unethical

their 'handmade/crafted' requirement.”
Etsy’s policies state, “Everything listed for
sale on Etsy must be handmade, vintage, or a craft supply.” They also state, “Etsy
may refuse service to anyone, at any time, for any reason.” ***
Etsy’s Marketplace Integrity Team
investigates whether members are selling material in accordance with our
policiesOn July **, 2016, we explained to the Customer that the material he
was attempting to sell violates Etsy’s policies as he was reselling commercial
materialEtsy then revoked the Customer’s selling privilegesAfter the
Customer’s inquiry, we followed up again on July **, with the following:
“To be clear, all listings in our marketplace
are subject to the same set of policiesRegardless of other sellers' actions,
it is still your responsibility to comply with Etsy's Seller Policy, which you
agreed to follow when you opened your shop.”
Etsy is not a pre-screened siteSimply because
others may be violating our policies does not permit the Customer to violate
Etsy’s policiesIf the Customer finds that another member may be violating our
policies, he can report them to our Marketplace Integrity Team who will
investigate privately
The Customer’s selling privileges were
revoked because of violations of Etsy’s policies, as the Customer indicated he
was in fact violatingThe Customer may continue to use Etsy as a buyer only

This letter sets forth Etsy’s position regarding the complaint dated April **, against Etsy, Inc(“Etsy”)Etsy’s service, Etsy.com, is a marketplace where people around the world connect to buy and sell unique goodsTo use the site, each individual must agree to Etsy’s Terms of Use and other site policies*** *** (the “Customer”) is an Etsy member and agreed with Etsy’s Terms of Use
Etsy’s Terms of Use state, “Etsy cannot ensure that a buyer or seller will actually complete a transaction.” Etsy’s Terms of Use also state, “You release Etsy (and Etsy's officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with disputes with one or more users, or an outside party.”
In the complaint, the Customer claims the purchase they made from a Seller on Etsy (the “Seller”) has not been delivered
Pursuant to Etsy’s Terms of Use, the Customer releases Etsy from all claims, demands and damages arising out of or in any way connected with this disputeTransactions on Etsy occur directly between a buyer and sellerThe Seller that the Customer purchased from is not an employee of Etsy, but operates a shop on Etsy.comI see that as of today’s date, April **, the Customer has not opened a case on EtsyAccording to our records, the Customer was eligible to open a case on Etsy for this transaction as of March **, 2015, and will be eligible until May **,
As a venue, Etsy is not directly involved in the transaction, but we can attempt to mediate between the Customer and the Seller through our case systemIf the Seller doesn't respond or resolve the case within one week from the date it was opened, the Customer will have the option to escalate the case for review
In the event the Customer requires additional assistance with opening a case, we would encourage them to reach out to our Trust team directly (***) from the email address associated with their account
We are sorry to hear that the Customer has been concerned over their experience with this SellerHowever, in accordance with our Terms of Use, the Customer releases Etsy from any and all claims, demands, and damages arising from such disputes

Etsy is the worst company EVERI purchased a dollar table from ***I paid dollars to get it shipped to my houseThe table arrived to my house damagedThe seller told me to file a damage claim with *** picked up the table, inspected it, and then shipped it back to the sellerAfter weeks, *** says my damage claim is denied because the seller IMPROPERLY PACKAGED IT*** told the seller that they only insure items that they packageThey asked if they could repackage it and the seller said NO, ship it as isNow of course the seller will not respond to my messages and Etsy says there is nothing they can doEtsy and the seller think that it's ok that I have no table and no moneyWHAT ON EARTH?!!!! *** stole from me and Etsy let themI have now contacted my bankI can't believe this website does not back their customersThat is A WEEKS WORTH OF MY PAYUnacceptableWhatever you do, DO NOT SHOP ON ETSY!

Customer was a buyer on the Etsy site and as such agreed to Etsy’s Terms of
use
In the rejection,
the Customer states that an Etsy *** made a decision in the Customer’s
favor in Etsy’s dispute resolution process (“Cases”) and the Customer requests
a refund
Etsy’s Terms of Use state “[s]hould you
have a dispute with one or more users, or an outside party, you release Etsy …
from any and all claims, demands and damages … of every kind and nature …
arising out of or in any way connected with such disputes.”
Etsy customers may file cases via
Etsy’s case system to resolve disputes such as theseThe cases remain open
until an Etsy moderator closes themOn 2/*/14, at the beginning stages of the
case, an Etsy moderator stated that the case would be re-openedEtsy also
requested that the seller provide a return address and method of shipping, and
explained to the Customer that she would have to return the items to the seller
for a refundThe case was still open at this timeThe seller subsequently
explained via Etsy’s case system that the items the Customer ordered were
delayed by the post office, not the seller, and the seller provided tracking
informationBased upon this information, Etsy’s moderators decided that the
error was not on the part of the seller and on 2/**/14, Etsy closed the case

note that the item the customer purchased was from the Etsy user ‘***’
who operates a shop on Etsy‘***’ is not an Etsy employeePursuant to Etsy’s
Terms of Use, the Customer releases Etsy from all claims, demands and damages

It is unfortunate that the Customer did not
have a satisfactory experience purchasing from a seller on EtsyThe Customer

This case is not closedEtsy still continues to state that both accounts are under the same nameMy daughter has used *** to pay for all shop expenses since it has openedIf my card (which says MY name) it was used to help her pay for a payment for one monthThis in no way means that the shops are managed by the same owner! She even owns another shop that which is financed again by her *** accountADDITIONALLY..according to *** she was told that she must either remove the listings in violation with Etsy policies, or her account would remain in suspensionIn September of this year ALL LISTINGS WERE REMOVED, and she now manages her shop on its own websiteWith what Etsy has continuously said they deactivated both accounts because ***'s shop "***'s ***" was in violation and they believe "both accounts are managed by the same user"Because *** has since removed all merchandise from her shop, she has complied with Etsy's guidelines and therefore the ban on my account should be liftedThis only goes to show that again, Etsy has neglected to properly investigate this issue by failing to even see that all items in violation had been removedWhether they believe the accounts are separate or not, ***'s *** on Etsy has no listingsMy account still remains unlawfully suspended, although guidelines have been met.Sincerely,*** ***
