Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
The seller refuses to respond or acknowledge that the product is not what was describedThe seller was allowed to sell items that were not described on Etsy's site Etsy makes money by connecting buyers and sellers Therefore, Etsy cannot just disclaim all responsibilityI would love to receive a refund from the seller but Etsy did not hold the seller accountable for misleading its buyers Etsy never questioned the seller when I presented all of the facts Etsy simply closed the case and gave me no option to hold the seller accountableThe seller was very well of how well protected she was by Etsy and immediately escalated the case without attempting to resolve the issue The seller's return policy says that they will do what it takes to make the buyer happy I agreed to the terms of Etsy's website based on the fact that I would at least receive an item that what was describedI provided substantial evidence in my case that the item was not what was described to me Etsy needs to hold the sellers accountable and not simply disregard customer complaints I have purchased numerous items from Etsy and have never had a problem When I am sold an item that is clearly not what was described to me, Etsy disclaims any and all responsibility and refuses to force the seller to help me
There is no business that can advertise one product on their website and sell you another As administrator of this site, Etsy has a responsibility to help me
In order for the Revdex.com to appropriately process your response, you MUST answer the question above

I have always been a huge fan of Etsy and supporter of hand made goods until recentlyI made a purchase from a seller on Etsy (***i) for a pair of wine glasses for my best friend's birthday, and the processing time was 3-weeksAfter weeks, I politely asked the status of my order (it had been a week since the birthday of the recipient), and the seller informed me that she messed up my order and then proceeded to blame me for her mistake since I did not message her about my custom order beforehand-- which I actually had done, but she didn't bother to lookShe did not apologize, and then told me it would be shipped in a couple of daysAfter another week, I filed a case against her since I had not received my order, and I wanted a refundAfter SEVEN WEEKS, she sends the order to my friend whom I have already informed that she would not be receiving the giftEtsy did absolutely nothing to help me get my money back, and just watched the seller call me a liar even though I had screenshots proving that I was being completely honestSo now, after eight weeks, my package has been marked as delivered and my case is closedThis woman STOLE MY MONEY and Etsy let it happenedI spent $on two wine glasses to be shipped no later than weeksI did NOT get the service I paid for and I'm appalled that Etsy thought that this was okayI'm totally embarrassed by the whole situation, and feel terrible that my best friend got her birthday gift a month late

I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
[Your Answer Here] Until I receive the stated refunds into my bank account (which as of this am, 08/**/2016), this matter is not resolvedEtsy has failed to respond to many of my emails despite what they are statingThe only time I have been able to get Etsy, or Gary, the CS Rep to respond, is when the Etsy shop owner contacts themI am extremely disappointed in Etsy's lack of concern with getting my funds back to me in a timely mannerIt is now August **, It has been almost days since funds were taken from my bank accountAt this time and due to the fact that Etsy continued to tell me that refunds were issued when they were in fact NOT, I will never do business with them againThe customer inability to actually speak to a person at Etsy is ridiculousI have sent multiple emails to them asking for a call but apparently Etsy does not want to talk to its members/customersI am very, very disappointed and extremely concerned with Etsy' business practices!

Dear Mediator:
This letter sets forth Etsy’s position regarding the complaint dated October *, against Etsy, Inc(“Etsy”)Etsy’s service, Etsy.com, is a marketplace where people around the world connect to buy and sell unique goodsTo use the site, each individual must agree to Etsy’s Terms of Use and other site policiesGretchen Basham (the “Customer”) is an Etsy member and agreed with Etsy’s Terms of Use
Etsy’s Terms of Use include our Buyer Policy, which states, “Etsy provides a venue for buyers to find, learn about, and enter into transactions with sellers around the worldIt is important to note, however, that Etsy is not a part of that transactionBy shopping on Etsy, you understand that:
You are not buying directly from Etsy, but from one of the many talented sellers on Etsy;
Etsy does not pre-screen sellers and therefore does not guarantee or endorse any items sold on Etsy or any content posted by sellers (such as photographs or language used in listings or shop policies); and
Each seller on Etsy accepts different payment methods and has their own processing times, shipping methods, and shop policies.”
In the complaint, the Customer claims that she purchased a dresser from a seller on Etsy (the “Seller”) and that she has not yet received this item
Pursuant to Etsy’s Terms of Use, the Customer has agreed to “release Etsy from any claims, demands and damages arising out of disputes with other users or parties.” To reiterate, transactions on Etsy occur directly between a buyer and sellerThe Seller that the Customer purchased from is not an employee of Etsy, but rather an individual who operates a shop on Etsy.com.Although Etsy is not directly involved in the transaction, in some situations we can attempt to mediate disputes between members through the Etsy case systemHowever, I see that the Customer did not open a case on Etsy for this order and, unfortunately, the day window to open a dispute for this transaction on Etsy has expiredThat being said, as a courtesy, an Etsy Administrator has now contacted the Seller in an attempt to facilitate a resolution to this matterIn the event the Customer requires additional assistance, we would encourage her to reach out to our Trust team directly (***

In the rejection, the Customer states that her case for the dress she purchased from a seller on Etsy (the “Seller”) was reopened.According to our records, the Customer’s Not as Described case was reopened on May ** at her request, as she had previously been unable to supply additional proof the her dress order was significantly different from the Seller’s listing.On June *, after the Customer provided additional information in her case log, the Etsy Administrator assigned to this case determined, in accordance with our Terms of Use, that Etsy was unable to mediate this issue through the case system, as we did not find that there were material differences between the dress received and the item’s listing description and photographs

In the rejection, the Customer states that Etsy has not assisted in the mediation of their dispute with a seller (the “Seller”) from whom they’ve made a purchaseAs was outlined in previous responses to the Customer’s complaint and is stated in Etsy’s Terms of Use, the Customer did not purchase this item from EtsyRather, the Customer has bought their item from the SellerTo further clarify, the Seller operates a shop on Etsy.com and is not an employee of Etsy.In accordance with Etsy’s Terms of Use, the Customer has released Etsy from any and all disputes which may arise with one or more users, or an outside partyThis means that Etsy is not responsible for providing further mediation or assistance to the Customer in resolving their concerns with the Seller directlyHowever, Etsy may have been able to hold the Seller responsible for providing a replacement or refund for the sign the Customer is not satisfied with, had we found the sign to be not as described in the Etsy case systemTo reiterate, the Customer’s ability to open a case has unfortunately expiredAs such, we are unable to formally investigate the Customer’s concerns and can not offer mediation with the Seller for this transactionTo be clear, because Etsy is a venue, once the option to open a case has passed we are unable to further mediate such disputesAt this time, the decision on whether or not to offer a refund based on the Customer’s claims is the sole responsibility of the Seller, as the Seller is the party with whom the Customer entered into this transaction withIt is our hope that sellers will practice good customer service, and will meet such requests from their buyersHowever, as a venue, we can not guarantee that this will be the caseThat said, we would like to assure the Customer that we have made a note of their experience on the Seller’s account and will continue to review their business practices, as sellers who continually demonstrate an inability to fulfill business obligations in a professional, honest manner are permanently removed from the Etsy marketplaceIf the Customer has additional questions, he may contact our Trust team at ***Etsy considers this matter closed at this timeIf you have any questions, please contact me at ***Sincerely,

Etsy states that they have investigated this matter thoroughly, but, just because they did not find an issue at this time; it does not mean that the issue does not exist Also, they stated that we already received the benefits of the advertising service, however, per their own "stats" for our page, the ads did not generate any sales or increased traffic to our page; so their statement is not entirely true
