We pay our members between $and $10,to be
a member (amount determined by the value of the member home when they join our
program)
Homeowners pay us $to join our program, $to
be a member, $if they sell their home some day using any cooperating broker
they choose among our more than 5,cooperating broker offices across the
USA, $if they never sell their home
No homeowner has ever been asked to pay us one
pennyNo homeowner has ever paid us one penny
According to our records, [redacted] husband Brandon spoke with an independent
contractor marketer employed by a third party marketer (not by us) about our
wonderful program for homeownersThe marketer is no
longer marketing our program.[redacted] incorrectly states she was again being invited to join our wonderful program for homeownersShe likely misunderstood our reminder that our membersreceive an extra $for every new member they invite to join our program (each new member getting $to $10,from us, for which they pay us $0)So, in other words, the more money our members help us to pay to their friends and family, we provide them with more member rewards, with no limitA member can invite another members to join our wonderful program for homeowners, and when they do, we send the inviting member an additional $1,000! If they invite another members, such as through their [redacted] page, we pay them an extra $5,000!
We, as a licensed real estate broker, enter into
cooperating broker referral agreements with other brokersWe are in long term agreements with more than 1,real estate
brokerages across the United States, comprising more than 5,000 offices,
and in those offices are more than 250,licensed real estate agentsAmong
our more than 1,000 contracted cooperating brokers are 70% of the
largest brokerages in the United States (almost all of the other 30% are in
states in which we are not active).
We give our members cash benefits to spend
on whatever they want to buy themselves, on average years before they sell
their home! And they can keep it even if they never sell their home! When
the home sells in the future, the cooperating broker pays us an industry
standard referral fee.
We ALWAYS put our homeowner members, our clients,
first, above all else.[redacted] makes the impossible statement that our program is 'some kind of scam'Such statements are absurdWe pay our members between $and $10,eachOur members pay us $No homeowner has even been asked to pay us one penny, no homeowner has ever paid us one pennyIf [redacted] could be so kind as to explain how we could possibly be a scam, we would surely like to knowReality is it is impossible that our program could be a scam, which is why whenever anyone suggests such a thing, and we ask how could it possibly be a scam, we never get an answer! So, if [redacted] thinks it is better for [redacted] and her husband to NOT receive $to $10,from us, for which they would have paid us $0, then [redacted] indeed should not be a
member of our Smart Homeowners Program (we named the program for our members)
Pursuant to her wishes, we have cancelled her and husband's registration in our
program, and as a result, as [redacted] desires, we will not be paying [redacted]
and her husband $to 10,(for which they would have paid $0).Thank you

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me. I'm happy they cancelled this claim against our home.
Sincerely,

Our company personnel just had a very pleasant conversation with [redacted] who seems to be a very nice person. We have agreed to cancel his registration for our wonderful program for homeowners. As a result, we will not be paying [redacted] $1,000 for which he would have paid us $0. The independent...

contractor marketer that [redacted] initially spoke with is no longer marketing our program, and it is really that independent contractor against which this complaint should have been filed.Thank you.

Mr. [redacted] registration had already been cancelled by Exceed prior to his contacting us.
We did so in conjunction with requiring our national marketer to terminate its contract with the company that had been marketing our program in the state of [redacted], which we did upon...

completing an investigation of similar allegations.
The program we provide to homeowner is truly wonderful, and there is no reason ever to fail to accurately describe the program.
As a result of what occurred in [redacted], numerous redundant steps have been implemented to be sure that 100% of homeowners joining our program 100% of the time will know 100% of what there is to know about our simple program.
We genuinely appreciate Mr. [redacted], and other [redacted] homeowners, who were kind enough to take the time to let us know what occurred.
Sincerely,
All of us at Exceed

It is confusing that Mr. [redacted] says he tried to contact us 'with no results', yet he also states he spoke with us December 17th.
Mr. [redacted] apparently 19 months ago spoke with an independent marketer about our program, not an employee of our company.
An...

officer of our company will contact Mr. [redacted] and will resolve this to our mutual satisfaction.
Thank you.

Homeowners pay $0 to join our program, $0 to be a member, $0 if they sell their home some day using any cooperating broker they choose among our more than 5,000 cooperating broker offices across the [redacted] $0 if they never sell their home.  No homeowner has ever been asked to pay us one penny. No...

homeowner has ever paid us one penny.   We pay our members between $300 and $10,000 to be a member (amount determined by the value of the member home when they join our program).   [redacted] or her ex-husband likely spoke with an independent contractor marketer employed by a third party marketer (not by us) about our wonderful program for homeowners. The marketer is no longer marketing our program.   We give our members cash benefits to spend on whatever they want to buy themselves, on average years before they sell their home. And they can keep it even if they never sell their home. When the home sells in the future, the cooperating broker pays us an industry standard referral fee.    We ALWAYS put our homeowner members, our clients, first, above all else. We pay our members between $300 and $10,000 each. No homeowner has ever been asked to pay us one penny, and no homeowner has ever paid us one penny. It is impossible that we could be a scam, as [redacted] unfairly and inappropriately suggested. If [redacted] could please explain how we could possibly be a scam, it would be very helpful to know how that could be possible, as we cannot determine how this could ever be possible.   Also, contrary to [redacted]s statements, our member services personnel attempted to call her and email her several times.   Pursuant to [redacted] wishes, we have cancelled her and her ex-husband’s registration in our wonderful program for homeowners, and as a result, as [redacted] desires, we will not be paying her between $300 and $10,000 (for which she would have paid $0).   Thank you.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me. To answer their questions:
I never spoke to a single representative about this program. No one called me or came to my door and I did not sign up for this on my own so I am very skeptical about this.
Reasons Why It Seems Like A Scam:
1. Because of the, above I am VERY skeptical when I am sent information telling me that I have joined a program and even more skeptical when a random company I have never heard of sends me a live check.
2. It is always nice to receive free money, but when I have never heard of the company or received ANY correspondence from them, it seems fishy at best.
3. The letter that I received stated that I joined this program in 2014. I have never received any correspondence. If I joined in 2014, why was I sent a check 2 years after that? For what reason?
4. The letter that I received also indicated that I MUST contact this company before I sell my house. This seems like a threat - if I do not call this company (which I have no intention of doing) what will happen? Will I be sued? Will I have to pay a fine? Will I have to pay back all this money they have sent me? It doesn't make sense.
5. I fear what will happen to me if I cash this check. I worry if it is some sort of virus that will steal my information or bind me to some unknown contract.
In short, I have only ever received one single piece of correspondence from a company I have never heard of (nor had my lender) - a letter stating I signed up, with a live check for $100 telling me that I have to contact them if I want to sell my house. I do not trust this at all, which is why I went online to do some digging. Several sites mentioned this to be a scam and they had over 50 complaints on Revdex.com.
I am satisfied with the response because I received an email yesterday from someone stating that my "membership" had been canceled.
Sincerely,
[redacted]

[redacted] registration has been cancelled. The broker she selected, [redacted], is in a written long term agreement with Exceed, and anyone who claimed anything other than that is a dishonest fraud. Our lawyers have spoken with a lawyer representing [redacted], and we will...

have our lawyer call them and speak with them again. Our company is tiring of dishonest fraudulent brokers and agents making false statements about our company, and will soon very aggressively pursue court action against those who are making dishonest false libelous statements about our company. We provide valuable major brand gift cards to homeowners who pay us $0. It is not our company who is a scam or dishonest. In any case, [redacted] registration has been cancelled.

To whom it may concern:Despite the [redacted]' request to cancel being made two months after they registered to join the program, which is long after the three business day right to cancel, nonetheless, we have conditionally cancelled their registration which they now claim to have not completed. We...

have conditionally canceled their registration subject to their home not showing up as being for sale in the next two years. If the home shows up as being for sale in the next two years, this would cause us to think that the request to cancel is not legitimate, and could possibly be due to unethical behavior, and if so, we will pursue our rights under the law.The [redacted]' should be aware that their false statement about our program being a scam is both ludicrous, and libelous, and we have referred this matter to our lawyers to consider filing a lawsuit against the [redacted]' for making numerous unsupported false statements about us which could damage our reputation. The [redacted]' complaint to the Revdex.com contains multiple false and dishonest statements. One such false statement is that Exceed is not a Revdex.com Accredited Business, which indeed it is, enjoying, and quite proud of, its A+ rating with the Revdex.com. Another false statement by the [redacted]' is that our website [redacted].com 'proved to be invalid'. It surely seems odd, and dishonest, that they claim our website URL 'proved to be invalid' when every other Internet user in the world is able to enter [redacted].com and arrive at our website.Homeowners pay us $0 to join our program, $0 to be in our program, $0 if they never sell their home, and $0 if they sell their home in the future using their choice of any of our many cooperating brokers. It is completely illogical, and without merit, for anyone to ever suggest we are a scam. When, from time to time, someone makes such a foolish and unsupportable claim, we always ask 'how could this possibly be a scam', and to date, no one has ever provided an answer, which causes us to continue to know, as we have always known, that our program is wonderful for homeowners, and could never be a scam. If the [redacted]', or anyone else, can give us any reason how our program could be a scam, please be sure to let us know.Thank you.

Complaint: [redacted]
I am rejecting this response because:First of all I did not sing any agreement with you, Do you have anything sing by me?? No. right.. I did not even know I was enrolled in that program until  received $100... that by the way as soon as you release my name from your data base I will  send it back to you. As soon as I received the $100 I asked my sister  and she explained to me that I will be only enrolled  for 5 years  that I will be free  after those 5 years and all she did was refer my name  and my email address  to you  without my knowledge so  I never sign anything to you.  Second I never received any email like this person mention telling me that I would be bound to them for the rest of my life with them, that is completely false, when I called on 6/7 and spoke with this person "[redacted]" promise to send the email explaining everything and untill today I did not receive anything.Third You said I did not  call you on  6/7 , Well I spoke to [redacted] .. so  see how fake your site is when someone from your company gave me a fake name and you are denian someone spoke to me.. I can send you  my phone records from the phone company( however see attached screen shoot of my phone  showing the call ). All I want is my house and name to be remove.       I want my name and my home address to be remove from your data base as soon as you
Sincerely,
[redacted]

According to our data records, [redacted] (“[redacted]”) registered to join our program December 29, 2013 after speaking with an independent contractor marketer (“ICM”) when [redacted] was shopping at the [redacted] in [redacted]...

After we recently received a communication from [redacted], we requested the ICM call her. According to the ICM: (i) He called and spoke with [redacted], she was very friendly, confirmed she regularly shops in the [redacted] in Hamden, and it seems she must have forgotten about registering for the program; (ii) Nonetheless, [redacted] did say she wanted to cancel her membership and return the gift card. Although more than one year past the three business day period provided to mail a cancellation notice, we agreed to cancel [redacted]’s registration and provided our mailing address to return the $100 gift card. Every homeowner who registers to join our program, within the registration completed confirmation email sent to them at the email address they provide during registration, is informed in writing about their three business day right to mail in a cancellation notice, and is provided a completed Notice of Cancellation to print, sign and mail to us via the [redacted].
Homeowners pay $0 to join our program. Homeowners pay $0 to be in our program. If the homeowner never sells their home, or if they sell their home in the future using any Cooperating Broker they choose in our national network, they pay us $0 (our national network comprises more than 1,000 contracted cooperating real estate brokers, with more than 5,000 participating offices, in which are more than 250,000 licensed real estate agents). Now in our 10th year in business, no homeowner has ever paid our company one penny, nor has one homeowner ever been asked to pay our company one penny.
According to the ICM who spoke with [redacted], all is resolved, and we await her return of the gift card to us by mail in conjunction with our canceling her program registration.

We are confused what he is complaining about.
He says he signed up for the program.
He says he decided he wanted to cancel his registration due to reading fall nonsense on the Internet.
He emailed asking for his registration...

to be cancelled.
Per his request, we cancelled his registration.

Unfortunately for [redacted], her initial impression, in her own words "wow, this is cool, OK!" was absolutely correct, and her false impression now is absolutely incorrect.
We pay our members between $300 and $10,000 to be

marketer employed by a third party marketer (not by us) about our wonderful

accurately explain the program to her. The marketer is no longer marketing our
program.
Any agent with a broker listed as one of
our cooperating brokers who claims they 'never heard of Exceed' is
either honestly ignorant of the facts, or is simply a
fraudulent liar.
We, as a licensed real estate broker, enter into
cooperating broker referral agreements only with other brokers, and never with
agents. We are in long term agreements with more than 1,000 real estate
brokerages across the United States, comprising more than 5,000 offices,
and in those offices are more than 250,000 licensed real estate agents. Among
our more than 1,000 contracted cooperating brokers are 70% of the 100
largest brokerages in the United States (almost all of the other 30% are in
states in which we are not active).
Any agent who recommends a homeowner not be
in our program does so to put more of the homeowner's money into
the agent's own pocket (taking it out of the homeowner's pocket).
We give our members cash benefits to spend
on whatever they want to buy themselves, on average years before they sell
their home! And they can keep it even if they never sell their home! When
the home sells in the future, the cooperating broker pays us an industry
standard referral fee. And yes, while the homeowner pays less (by getting
the member rewards from us), the agent will be paid a lower commission.
On a home such as [redacted]'s home, the agent selling
the home would earn approximately $5,215 if [redacted] was not in
our wonderful program for homeowners. If [redacted] was in our wonderful
program for homeowners, the agent would earn approximately $3,390, while [redacted]
and her husband would have received $500 from us for being in the
program.
So, in this example, by an agent scaring [redacted]
out of the program, [redacted] will cause the agent to be paid $1,825 more, and [redacted]
and her husband will get $500 less.
Question: Who wins and who loses if [redacted] is NOT
in the program?
Answer: The agent wins. [redacted] and her husband lose!
Our homeowner
members themselves choose which of our many outstanding cooperating brokers
they would like to work with when selling their home. They may
change their selection any time at no cost, as often as they like,
until they enter into a listing agreement with their chosen broker to sell
their home.
We ALWAYS put our homeowner members, our clients,
first, above all else. Apparently, whatever agent [redacted] spoke with does
not do the same, and instead puts his or her needs above [redacted]'s and [redacted]'s husband's needs.
The 1.2% [redacted] mentions.... as stated above, we
have never asked a homeowner to pay us one penny, and no homeowner has
ever paid us one penny.
To be clear, any agent who makes any statement
about being or not being a part of our program is being dishonest, as no agent
can ever be a part of our program.... only the brokers they work
for can be a part of the program. Any agent who is affiliated with any of
our cooperating brokers is 'a part of our program' if they want to sell
our member's home, whether they want to be a part or do not want to be a
part.
Seems pretty obvious why an agent who puts
their needs above the client's needs may not like our program. The
agent gets less, the homeowner gets more.
If the agent selling [redacted]'s home were to earn a
commission for selling [redacted]'s home of $3,390 instead of $5,215, so that [redacted]
and her husband could receive $500 from us in Member Benefits for which [redacted] would pay us $0:
If the agent put in 20 hours of time to sell the
home, the agent would earn $169 an hour (instead of $261 an hour if [redacted] and
her husband were not in the program).
If the agent put in 10 hours to sell [redacted]'s
home, the agent would earn $339 an hour (instead of $522 an hour if [redacted] and
her husband were not in the program).
So, if [redacted] thinks it is better for [redacted] and
her husband to NOT receive $500 from us, for which [redacted] and her husband would have paid us $0, and instead [redacted] thinks her chosen
agent should earn $261 an hour instead of $169 an hour, or $522 an
hour instead of $339 an hour, then [redacted] indeed should not be a member of our
Smart Homeowners Program (we named the program for our members).
Pursuant to her wishes, despite [redacted] acknowledge in her complaint that she agreed to be
in the program, we have cancelled her and her husband's registration in our
program, and as a result, as [redacted] desires, we will not be paying [redacted] and her husband $500 (for which they would have paid $0).
Thank you.

Apparently, some time ago Mr. [redacted] spoke with an independent marketer about our wonderful program for homeowners.
Although he claims to have spoken to our company 11/30/15, 12/18/15 and 1/14/16, we have no record of any of these alleged contact...

attempts.
We always find it quite strange when people complain about receiving a check in the mail from us.
Our member support team is available to speak with our members 7 days a week, so it makes no sense that he claims to have been unable to speak with anyone for several weeks. We always promptly return any calls we receive, so it also makes no sense that 'no one called' him back.
Mr. [redacted] also incorrectly states that should he choose to sell his home in the future, that he would have to use our chosen broker, reality is he could use any broker in our program that he chooses.
He incorrectly states that he'd have to use our broker and pay 'their chosen rate' when reality is Mr. [redacted] would choose a broker he desires, and pay a rate he agrees upon with that broker. We do not choose the broker, we do not choose the rate. We do indeed contractually prohibit our contracted cooperating brokers from charging any commission rate higher than the normal rate in their market, and none of our brokers ever over charge our homeowner members.
As we provide nothing other than benefits to our homeowner members, and our homeowner members have never paid us anything, including Mr. [redacted], we have happily canceled his being a part of our program, and we wish him the best of luck with the future sale of his home, which unfortunately for him, will cost him more than if he was a member of our wonderful program for homeowners.
Thank you.
