complaint that he and his wife gave their information and agreed to be in the program, we
have cancelled his and his wife's registration in our program, and as a result,

To whom it may concern: Over the weekend I submitted a complaint against Exceed LLC based in *** *** I filled in general space, but had to edit somethings to make it fit the allotted sizeI was told I should email the rest to you When I was stopped in the mall, the man had a
tablet in which I orally gave him information and he entered it inWhen he was done, he showed me the information I had given him to make sure it was correctI think he asked me to initial that the information was correct, but again, I was never told it was a contractAlso, I was never told about a cancelation policy, nor was I shown any contract to read I believe the company intentionally has no contact information on the paper that was enclosed with the gift card so they purposely cannot be reached, and likewise on their websiteI want to be clear that I'm not trying to replace the card or value, I have the exact one that was mailed to me because until I was contacted via email last Friday, I had no contact person who I could return the gift card to When I was called on Friday, I was told I had signed a contractI asked for a copy of the document with my signature, but nothing has been produced Also, since posting this, my house is no longer being soldWe had a potential buyer, but problems arose and the contract is null and voidBut I would like this resolved so that if I choose to sell my house in the future, the problem doesn't happen again The resolution I would like is an address and contact to which I can return the same original gift card I've been trying to return since December and confirmation that whatever agreement I may have agreed to under pretenses is completely canceled with no further repercussions and no further contact with Exceed LLC Thank youSincerely, *** *** *** Sent from my ***

Mr***'s registration has been cancelled.
Mr*** apparently does not understand the 1.2% he references.
The 1.2% is payable to Exceed ONLY if Mr*** were to violate his agreement by using a broker to sell his property that is NOT one of Exceed's
cooperating brokers.
Now in our 10th year in business, we have never asked a homeowner to pay us 1.2% of anything, and we are not aware of any homeowner that has violated our very simple agreement.
Homeowners pay $to join our program, and $to be in our programOur members may choose to never sell their home, or may sell their home if they choose to do so in the future using any broker they select within our network of more than 1,cooperating brokers with their more than 5,participating offices, and in either case, they pay us $Our program is wonderful for homeowners, and it is a shame when people make statements about the programThe 1.2% is clearly stated in BOLD CAPITAL LETTERS in our one page homeowner enrollment agreement, which is emailed to every homeowner who joins our program, and is available to homeowners to review when they are registering to join the programIn addition, we are implementing third party verification, which will result in a 3rd party company calling and speaking with every homeowner who registers to join our program, which will provide a 3rd opportunity to be sure that every homeowner joining our program knows 100% of the very few things to know about the program, which ideally will result in zero additional complaints about something that is made abundantly clear to every homeowner who joins our program

Nonetheless, pursuant to ***'s wishes, we have cancelled their registration in our
program, and as a result, we will not be paying *** and *** $(for which they would have paid $0)

Unfortunately, this is the 2nd occurrence of an agent from *** *** *** communicating with 3rd parties regarding Exceed in
which they make libelous statements, which is unacceptable and actionableThe first agent from that firm sent an email to a client with numerous libelous statementsUpon becoming aware of it, we communicated with that agent by email and she immediately sent us a written apology for her libelous statements.
Contrary to *** *** libelous statements, Exceed and ** *** entered into a long term agreement in August of 2011, with a minimum term of five years, in addition to other firms in the Tri-Cities areaIt is not Exceed’s responsibility to be sure all agents at a firm such as ** *** are aware of our contractual relationship with their firm
Prior to receiving this communication to you from *** *** our lawyers have been in touch with ** *** lawyers who expressed a desire to resolve this matter amicably, we will leave it to our and ** *** legal counsel to resolve this matter, and we will not communicate with their agents (other than cc’ing *** *** on this email to you, providing her one opportunity to immediately withdraw her inappropriate complaint to you and to apologize to us for making libelous statements about Exceed)
Although *** *** is apparently unaware of the following, Exceed is in long-term contracts with more than 1,of the largest and most reputable real estate brokerages in the United States, with more than 5,participating offices across the United States with more than 250,agents in those officesMany of the 1,000+ firms are appropriately referenced at our website and other marketing materials, as is authorized by these firms within our contracts with such firms, including the contract between *** *** *** and Exceed
While some say ‘ignorance is bliss’, ignorance is not a legitimate excuse for a 3rd party to make libelous statements about another party (such as claiming we are ‘scamming’ people, ‘tricking’ people, using our contracted Cooperating Broker’s logos ‘illegally')Should *** *** choose to minimize the legal exposure she has incurred by making public libelous statements about Exceed, she should immediately withdraw her complaint to the Revdex.com, and email Exceed no later than Monday September 8th with an apology for the libelous statements she has madeShould *** *** fail to immediately take proper corrective action, the otherwise amicable and constructive conversations occurring between our lawyers and the lawyer for *** *** *** will likely become a much less friendly conversation, and we will need to pursue legal action against *** *** for making public libelous statements about Exceed, for which ignorance will not qualify as a legitimate defense
