Review: I stopped at a kiosk in [redacted] on motor pkwy in [redacted] about a year and a half ago. A very nice couple was offering gifts of checks and credit cards. I took some information and went on my way. In July I received a check attached to a letter from exceed for $200. There was no phone number on the letter so I found a [redacted] phone number and called. I left a message. A few days later a man named [redacted] called from exceed and told me that I had signed a contract and couldn't get out of it. I told him that I didn't recall signing anything of any significance. He said that he would get back to me. He never did. I called [redacted] the real estate on the letter and spoke to,the owner. He told me that corporate probably handles contracts, but, he had never used Exceed on any home sales in the area. I do,not want to be locked in to any contract signed in a supermarket. Thank you for your helpDesired Settlement: If there ever was a contract I want this contract cancelled.

Response:

Mrs. [redacted], in her complaint, acknowledges that she signed an agreement, in a grocery store, which she now wants to cancel. If Mrs [redacted] returns to us the check she acknowledges that she received, which she should mail to our PO Box (the return address on the envelope in which she received the check) we will then cancel her registration. Thank you.

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.

Sincerely,

Review: We received a check from Exceed's [redacted] Program recently. We were surprised as we had never received any other correspondence other than what my wife had been led to believe was entering a contest to win a [redacted] Gift Card. My wife told me that someone solicited her at a grocery store over a year ago and told her she was entering for a chance to win a [redacted] Gift certificate and there was no commitment or obligation. She was not informed that she was obligated to use Exceed or its network of realtors to sell our house or that there was a 1.2% fee if they were not used. (Facts that I learned by researching Exceed this past weekend.)

The person misrepresented himself and the product and did not inform my wife fully. She also never received any emails, contracts or further correspondences. Thus it was a surprise to receive a check from Exceed in the mail.

Both of our names are on the deed and any agreement to list our house in any way must be signed by both owners. We do not wish to participate in this program and feel my wife was misled.

I tried to reach Exceed by phone and email but have not received any return correspondences.

We would like to be removed from this program.

I will gladly void and return the check we were sent, we have not cashed it.

I would like a confirmation that we have been removed from the program.Desired Settlement: Please immediately remove us from this program and from the Exceed sales list. We do not want any further contact with this company. We also request a statement confirming we are under no obligation at anytime from Exceed or any of its affiliates, or agents.

Response:

The independent marketer Mr. [redacted] wife spoke with was barred from marketing our program soon after he spoke with her, due to our discovering situations similar to what she experienced. We have asked Mr. [redacted] to please write void on the check and mail it back to us, and we apologized for any inconvenience this may have caused them.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.

Review: A door to door sales man came to our home on Thur, 10/23/14. He stated that if we planned to sell our home at a future date, that we could benefit from his free program by agreeing to sell with a realtor. I explained that my husband's company moves us every 2-3yrs and we use a realtor of his company's choosing each time. I further explained that we have no control over the choosing of our realtor, as the company relocation company handles the selling of our home. The sales man stated that was perfectly fine and that we were not bound to use a specific realtor. He stated that we only needed to use a realtor, rather than selling our home "For Sale by Owner," in order to benefit from this homeowner's program. When he began to sign us up electronically, I noticed that he selected a specific realtor to assign to us. I, again, reiterated that we would not have the ability to choose our realtor when it came time to sell our home and he stated that we could easily log onto their website and update our realtor information to whomever our relocation company assigned to us.

Once the sales man left, I got onto the website to confirm the details of the program we joined. The website clearly stated that we MUST use one of the approved realtors within the Exceed Network. We were contractually bound to do so and would be subject to a fee of 1.2% of the value of our home if we used a realtor outside of their network!! I promptly printed the cancellation form and had it time stamped at the post office.

The sales man touted that their company was backed by the Revdex.com as part of his sales pitch. As such, I thought it prudent to report this fraudulent misrepresentation of contractual obligation through the Revdex.com website. Upon looking up Exceed on the Revdex.com website, I see that Exceed is not even yet rated by the Revdex.com! Once again, misrepresentation by the sales man!Desired Settlement: We would like written documentation acknowledging that the sales person misrepresented the terms of the contract and confirmation that, as such, our participation in said contract is null and void. I would also appreciate confirmation that this sales man and the entire force in this area is brought up to speed on at least the basic details of the contracts they're representing! This lapse in information could have contractually cost us over $3,000 at the time our home sold.

[redacted] spoke with an independent marketer. The marketer she spoke with is NOT an employee of our company, and is not contracted by our company, and has no interaction with our company. This complaint should have been filed against the company employing the marketer who spoke with [redacted]. We cancelled their registration, and emailed them to let them know. [redacted] thanked us for doing so, and apologized for "the bad feedback on the Revdex.com website".

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.

Sincerely,

Review: On August 8th, 2014, a young man came to my door around dinner time. He said his company, Exceed, was partnered with all of the major real estate agents in [redacted], **. He said that if I signed up, I would receive $500.00 regardless if we sold our house or not in the next FIVE years. The only thing I had to do was use one of the real estate companies that they partnered with IF I sold my house in the next FIVE years. He never said that it was a lifetime binding contract. If we decided to sell our house, we already had a real estate agent that we would work with. He stated that they work with [redacted]. And if our real estate agent was part of [redacted], it would not be a problem. The salesman did not say anything about being penalized for not using a company on the list. He said that it would not be an issue because all major real estate agencies are partnered with their company. The salesman was very misleading of what I was actually signing up for. He made me believe I was signing up for something that would help both me and my real estate company. He DID NOT ever give any indication that this was something that I was signing up for for a lifetime. He stated that it was ONLY for five years. The only time I have had any contact with that company was over a year ago. I have not received any other emails, letters, or phone calls.

Recently my wife and I decided to sell our home. She remembered that if we sold our home in the next five years that we must go through a company in agreement with Exceed. After going to their website to look for specifics, I was appalled to see that I had initialed a contract on Ipad that was a lifetime binding agreement. I was also appalled to find out that if I did not use one of the real estate agents in agreement with Exceed we would be charged 1.2% of the sale of our home. NEVER did the salesman ever indicate those things.

I was lied to (1. Salesman said the contract was only for FIVE years. 2. Salesman indicated that I would be receiving $500.00 in the next year (still have not received)). I was misled (1. Salesman said that it would not be a problem with a real estate agent that I used in the area. 2. Salesman never indicated that this was a lifetime agreement. 3. The salesman never asked to speak to my wife. She is co-owner of our home and needs to be part of any conversation or contract that involves the selling of our home. The salesman simply asked for her name and birth date. He NEVER said that she was also being signed up for this lifetime contract. The salesman should have asked to speak with her before knowingly putting her name on a binding contract. I feel that that alone is ethically wrong).

I feel I was violated by the sale that afternoon. The salesman was/is misleading people to believe that they are just simply signing up for a gift card. The only thing they have to do is sell their house in the next FIVE years (not a lifetime) with a major real estate company. I would have never signed up with the company if I was told it was a lifetime contract and I would be obligated to pay if I did not use one of the real estate agents.

After reading several complaints on [redacted], it seems as though we are not the only people who have been misled, deceived, and lied to. I wrote an email to the company this evening asking to cancel my membership, but after reading all the complaints that are so similar to mine I decided that I needed to take further action.Desired Settlement: My wife ([redacted]) and I ([redacted]) would like our membership cancelled. We would like our names to be taken off any other company that we unknowingly signed up for. I would like my name and my wife's name to be taken off any type of contract. I would also request a statement confirming we are under no contract at anytime from Exceed LLC. After receiving the statement confirming we are no longer under contract with this company, we would like no further communication with this company.

Response:

An officer of our company spoke with Mr. [redacted], and we were told Mr. [redacted] wanted to remain in the program, and we sent he and his wife their first $100 gift card 9/25/15.

Review: We received an e-mail telling us we had joined this scam. It tells us that if we sell our house without using one of their agents, we must pay them 1.2 percent of the sales price. None of us has ever heard of this company, much less signed up for their services. They claim to be a Revdex.com member in good standing, but a search of your website could not find them. Their supposed web site is "[redacted].com, but that proved to be invalid also. We did not join, and want no part of this company. Supposedly we could cancel within 3 days of joining, but did not find the e-mail until 2 months after it was sent.Desired Settlement: We want removed from their business database and want no further contact from them.

To whom it may concern:

Review: Two salesmen came to my door yesterday for a company called Exceed saying I would receive $1000 in a gift [redacted], if when I sold my house I would go with a real estate company on their list. I told them who I would use and they said that this company was on their list. I was suspicious so later called an owner of this real estate company who informed me they were not associated with Exceed and that this was a scam. The young men were polite but overly aggressive, at one point taking my smart phone to see if I had received an email from Exceed then entering information in my phone. I have called the company and told them I do not want to be their customer. They agreed and said I would receive an email this afternoon confirming I was off their list. It is 4 :15 and I have not received that email. I also talked to a Revdex.com investigator this morning confirming that I should write this.Desired Settlement: If this is a scam, these people need to be prosecuted. Or short of that at least negative local media coverage.

Response:

[redacted] registration has been cancelled.

Review: A door to door representative with Exceed arrived at my home and very quickly sped through a presentation that misrepresented Exceed and their [redacted]. The representative stated that Exceed helps link homeowners with real estate brokers and in doing so are able to offer me free rewards. The representative then asked if I was satisfied with my realtor in purchasing my home and I stated that I was and informed him that my realtor was actually my mother-in-law who runs a real estate agency entitled [redacted]. The representative then stated that he assumed I would use her again in the future if I decided to sell my home. I informed him that I would. The representative then asked me some basic information stating that he would use this information so that a free [redacted] gift card. I then provided the representative with my name, the address of my home, email address, and my date of birth. He then asked if my wife was also included on the lease and when I stated that she was he asked for her name and date of birth. He then asked be to type my initials onto the computer stating that this was confirmation that I had approved them to share my information that I had provided. He then stated that I would receive a phone call in the next 10 days to review his friendliness/customer service. The representative then left.

Since I still felt confused about what had just occurred I attempted to review information regarding this company. I could find very little information but then found in a previous complaint that in providing my basic information, Exceed was then attempting to place me in a binding contract to not sell my home through any providers other than their approved providers. This was very disturbing to me so as soon as I received an email from the company stating I had been enrolled I immediately attempted to find out more about my enrollment. I then found that I had three business days to print out, sign, and mail a formal notice of cancellation or I would supposedly be in a legal contract with the company. I had zero awareness that I was entering into a legal agreement with the company and, furthermore, can not believe that the representative would place me into a contract even after knowing that I had stated that I planned to use my realtor again if I sold the home, even though this contract would forbid me. To summarize, I feel that Exceed's door to door representative attempted to place me into a legal contract without my knowledge and that this company, or at least this representative, is acting immorally, fraudulently, and likely illegally.Desired Settlement: I would like the cost of my stamp back, an apology for the company's dishonesty, and for Exceed to stop this fraudulent practice.

Mr. [redacted] spoke with an independent marketer who worked for a contractor who works for a national marketing agency. The marketer Mr. [redacted] spoke with was NOT an employee of our company, and was not contracted by our company, and had no interaction with our company. This complaint should have been filed against the company that employed the marketer who spoke with Mr. [redacted]. No employee of our company had any interaction with Mr. [redacted], other than to process his cancellation request immediately upon receiving his request to cancel. We canceled his registration, removed his information from our system, and apologized for any inconvenience. Mr. [redacted] is absolutely correct that the actions of the marketer were immoral, and the marketer's services were terminated upon us becoming aware of what occurred, as we have zero tolerance for such behavior.

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me. The sales representative at my door reported being an Exceed representative so that still concerns me, but I will take the companies word for it that he was not specifically contracted through them.

Sincerely,

Review: I received a check in the mail from Exceed's Smart Homeowners Program that identified me as a participant in its program, which apparently pays homeowners for using only realtors in their network. I never signed up for such a service/program. When I called the business (whose telephone contact information is not readily available on its website), I was told that I may have signed up with a door-to-door salesperson. The fact that I would never give information or sign up for a program with a salesperson at the door notwithstanding, I was living in another state at the time (June 2014) and would not have been at the door of the house they claim I committed to one of their realtors. Tenants lived in the house in question. Second, the employee said that they had been unable to contact me through the email address that I had supposedly provided them at the time of my signing up; so for 18 months, I've been enrolled in this program and undergone their data collection process without my knowledge. Third, the employee on the phone acknowledged that there was not a recorded contract with my signature but that "someone" would have initialed digitally on a electronic tablet carried by their salespeople.

I believe this business is either using unscrupulous salespeople and/or are allowing tenants to sign contracts for the owners of the properties in which they live.Desired Settlement: I would like 1) my "participation" in Exceed's Smart Homeowners Program to be discontinued immediately, and 2) my record and any data they maintain on me and my house to be completely expunged.

Review: A lady came to the door offering her services. She made it VERY clear to us that this was not a CONTRACT. She simply said " You will receive a gift card for simply telling us when you decide to sell and use one of our realtors" I told her we will be working with [redacted], if we ever decide to sell, because we know a few realtors. She said that is absolutely fine, they work with [redacted]. I asked her a few more times while speaking to her if this was a contract and she reassured me it was not. After doing some research I found that a lot of people were told the same lies we were told. We had completely forgotten about this women until yesterday when we received a check in the mail. We immediately voided the check and are ready to mail it back as so we can get out of whatever contract we are in. My husband called and left a message to speak with someone and they returned his call today notifying him that he is indeed in a contract and cannot get out of it. They flat out lied to us and that really makes me question why they are listed on Revdex.com.Desired Settlement: We want out of this contract! We were lied to and taken advantage of.

Review: I was approached to enter a drawing in the lobby of a [redacted] supermarket in [redacted], when a man named [redacted] started asking questions about my home. upon arrival home, I find emails that I am registered with this outfit([redacted]) and I have to go through an annoying process to cancel! CANCEL???? I NEVER signed anything! I NEVER agreed to anything! he got this info off the drawing form. and to top this off, he sent this emails to my long dead father's name [redacted]. what the heck is going on??? this is a scam!!! the Revdex.com should not condone this mode of doing business.Desired Settlement: I never want to hear from this outfit again I have NO agreement with them. how dare they ask me to cancel! The marketer she spoke with is not an employee of our company, and we have forwarded her complaint to the company for whom the marketer works. Her registration in our system was cancelled upon receipt of her email requesting we do so.

Review: A salesman claiming to represent local real estate agents came to the door and told me he wanted to offer me some gift cards based on the value of my home in the hope that I would use one of their real estate agents to sell my house in the future. I was careful not sign anything or give out any information that was not a matter of public record, I gave him my email address and verified my birth date on his little computer device, did not sign anything, figured I'd check it out when I received an email link about the program.

A few weeks after I received an email from "Exceed [redacted]" I checked out their website and see if it was legit. Reading through the details it sounds like they want you to sign a contract for life that requires you to use one of their real estate agents to sell you house in exchange for them sending their gift cards. Furthermore, from the language of the email it implies that I may have already registered to join their program. I am NOT ok with that and I do not have any interest in this program based on what I've read. The salesman did not provide any of these rather important details at my door or I would have probably not been so nice and would have sent him on his way immediately. I want them to (1) acknowledge that I did not sign any contract with them, (2) understand that I am not interested in signing up for their [redacted] and make certain that I am not registered, (3) remove my name, email, and any other personal information of mine from their system and not bother me in the future.Desired Settlement: I want them to (1) acknowledge that I did not sign any contract with them, (2) understand that I am not interested in signing up for their [redacted] and make certain that I am not registered, (3) remove my name, email, and any other personal information of mine from their system and not bother me in the future.

Review: Young Girl comes to the door of our house and does her sales pitch for giving gift cards to homeowners who agree to signup and obligate themselves to only sell their house with real estaters who contract with said business if and when they decide to sell their house. So I agree and she enters my email into a web site. The website just hangs and never does anything. Then she takes another email of mine and enters it into the system and it does the same. She instructs me to follow a link in my email to continue the process because the system isnt functioning at the moment. Later on I follow the link and the system still isnt functioning a couple days later. I am concerned that they have taken my name down and so I am obligated to their service but I wont get the gift card because I could never finish the setup process. Ive read that this may be a scam. The penalty for not using a real estater contracted with said business is stated to be about %1.3 of the price of the house after closing.Desired Settlement: I would like to be removed from any obligation I have with this company and they can keep their gift cards.

Review: I was solicited outside ansupermarket for a store gift card raffle. The man signed me up telling me I would receive in addition a gift card in one year for being a homeowner and over 21 as long as I used one of 7 real estate brokers. He told me that there was no obligation or penalty for getting the gift cards as long as I used one of ghe 7 brokers if I sold my home. He had me initial on his smartphone for myself and my spouse to sign up for the gift cards. He told me I would get an email, to check it if I decided to change my primary choice of gift card or broker. Well, one week later I finally scroll through my emails only to find an email from Exceed that states I basically signed up for a binding contract to use one of their cooperating real estate brokers or else pay a penalty of 1.2% of sale price for my home. A total scam! I was NEVER told I was signing a contract, let alone a binding contract on the sale of my home. I was told I was signing up for a raffle and to get gift cards. I have no copy of a contract and Exceed offers no direct contact info, only a general inquiry email link. I am so upset, feel totally duped. I do not want to be a member of Exceed, and also think other people should be made aware of this scam. Please help.Desired Settlement: According to their website there is no way to cancel the contract that they bait-and-switch me to sign. However, I want this contract null and void because it was fraudlently presented to me. Please help.

My response:

Thank you for removing us from the registered site/company. I'd like to add that it still does make sense to me how I could have been signed up, to your site and to your company, if this individual did not have a connection to your company. If he was independent, how did he access your system and enroll us? And yes, he did have me sign my initials on his smartphone but there's a BIG difference between him telling me that signing up was to activate the gift card process VERSUS having me initial a binding contract, which would attempt to penalize me at 10% of house sale price if I didn't use one of 7 relators when I sold my house. That is bait and switch.

Sincerely,

Review: A person named [redacted] (he was wearing a badge with his name and company name and probably in his 20's) knocked at my door the evening of 12/15/14 offering a gift card if I could be used as part of a marketing survey for persons selling their homes. I informed him that I was not selling my home and not intending to sell my home at any time in the near or distant future. He replied that this was not an issue, that this was just a survey for local real estate companies and that he/his company would be reimbursed for the gift card and his labor by these companies. He named several of the local real estate companies which many I recognized. He asked me to confirm my name, and my wife's name (he already knew our names) and if we were the owners of the house, for verification purposes. He also reported that there were no obligations to use any of the companies he was representing now or in the future, that the information I provided would be kept private and would not be sold or lent to anyone, there were no fees what-so-ever, I would not be contacted by the company, I was not joining any sort of program, and that it would not be used for any marketing purposes other than the survey described above. He did say that I would receive an email acknowledging that he and I had spoken and may receive a phone call to express how the our conversation went. What I received in the email stated that I was now a [redacted] Member, as well as my wife [redacted]. I researched Exceed on the web and read that it was a scam and that by being a member of this program I had to sell my home the program, that there were fees much higher than local real estate office involved, and that if I didn't use the program I would have to pay a penalty which would be a relatively large percentage of my home selling price. None of this was disclosed during the sales pitch.Desired Settlement: To be removed from the [redacted] membership, or anything other program that I unknowingly signed up for with the salesperson who came to my door, with no costs or obligations or penalties. To be totally removed from the data base of Exceed and any other company that I may have unknowingly have signed up for, and if the salesperson was misrepresenting his employment by Exceed, to not be obligated in any way to whomever he was actually employed by or representing.

Also my wife wasn't present, but yet I received a check over a year and half later with both out names on it, as both of our names are on the deed. I have tried to contact exceed with no results. I feel the representative was not forthcoming with all the rule and regulations of the company. Response:

It is confusing that Mr. [redacted] says he tried to contact us 'with no results', yet he also states he spoke with us December 17th.

Review: Employee #[redacted] Came to my door and explained if I signed up with this company, they would give me a 200$ gift card every year with no strings attached. He has explained that all they ask is when you decide to sell the home you consider choosing restate companies from a list. He was clear that there was NO OBLIGATION to use these companies if or when you choose to sell your home. Sounds great right? What I came to find out from 5 minutes researching online is that you are signing up for a LIFETIME contract that if you decide to sell your home and NOT use these companies, you will be forced to pay BACK the money you received.

I was also told that if I wanted to cancel I could simply do it by clicking on a link that I would get in my confirmation email. This IS NOT the case as the cancellation process is a form you must print out and send to the company dated within 3 business days or be stuck in the contact.

I considered both of these actions to be negligent and predatory and immediately felt the need to get this sorted.

I tracked down the employee a few houses down who was apologetic and said that I could just cancel online which I informed him you could not. He was very sorry and told me he was new and would help me fix this matter.

He called his supervisor who told me to also go online and cancel which I informed him that you could not as well. He then tried to tell me I could call them from an 1800 number on the website which I informed him they did NOT have ANY number listed on the entire site and only an email address. He then forwarded me to a listed number on the Revdex.com site which I called and did not get a response and the mailbox was full. He told me I could e-mail the company or he could e-mail the company and I would get a cancellation e-mail within 24 hours. I told him to do this.

To be fair, the supervisor was trying to be helpful but I found it very disconcerting that once I discovered the issues I was given more incorrect or useless information.

Ultimately I do not trust that I will receive a confirmation email of my cancellation and a bit angry that I now have had to spend my time sorting this out.Desired Settlement: - Confirmation of cancellation. This is all I desire besides a complimentary gift card for the time spent trying to sort this matter out. That I will not hold my breath for.

- I have already been apologized to and I have no reason to suspect that it wasn't sincere as both employees seemed to take responsibility and the supervisor said he would take care of it.

I will wait for my confirmation and follow up on here when it is done.
