Shortly after making complaint #[redacted] I received a response directly from Exceed concerning this matter. They promptly rectified the situation and this matter has been amicably resolved. I immediately notified you that the company responded to me directly and to cancel my complaint, however it appears you still officially served my complaint to the company. At this point I am satisfied that the company has addressed my concerns and there is no need to purse this matter further -- please close this case and/or simply cancel my complaint. Thank you.

5,000 cooperating broker offices across the USA, $0 if they never sell their home. No homeowner has ever been asked to pay us one penny. No homeowner has ever paid us one penny. [redacted] spoke with an independent contractor marketer employed by a third party marketer (not by us) about our wonderful program for homeowners. According to [redacted], the third party marketer failed to accurately explain the program to him. The marketer is no longer marketing our program. We, as a licensed real estate broker, enter into cooperating broker referral agreements only with other brokers. We are in long term agreements with more than 1,000 real estate brokerages across the United States, comprising more than 5,000 offices, and in those offices are more than 250,000 licensed real estate agents. Among our more than 1,000 contracted cooperating brokers are 70% of the 100 largest brokerages in the United States (almost all of the other 30% are in states in which we are not active).  We give our members cash benefits to spend on whatever they want to buy themselves, on average years before they sell their home! And they can keep it even if they never sell their home! When the home sells in the future, the cooperating broker pays us an industry standard referral fee (which costs the homeowner $0). We ALWAYS put our homeowner members, our clients, first, above all else. The '1%' [redacted] mentions inaccurately.... as mentioned, we have never asked a homeowner to pay us one penny, and no homeowner has ever paid us one penny. So, if [redacted] thinks it is better for [redacted] to NOT receive $500 from us, for which he would pay us $0, then [redacted] indeed should not be a member of our Smart Homeowners Program (we named the program for our members). Since our homeowner members pay us $0, and we pay them $300 to $10,000 each, [redacted]'s statement that we' trick' homeowners is absurd and with no basis in fact.

I have reviewed the response made by the business in reference to complaint ID 11620548, and find that this resolution is satisfactory to me.After speaking with company representative Tom Brown via phone conversation on 08/24/16 @12:45 PM he assured me that Exceed would release me of all contractual obligations due to the to program not being represented accurately by their contracted representative.

To whom it may concern:   Over the weekend I submitted a complaint against Exceed LLC based in [redacted] I filled in general space, but had to edit somethings to make it fit the allotted size. I was told I should email the rest to you.   When I was...

stopped in the mall, the man had a tablet in which I orally gave him information and he entered it in. When he was done, he showed me the information I had given him to make sure it was correct. I think he asked me to initial that the information was correct, but again, I was never told it was a contract. Also, I was never told about a cancelation policy, nor was I shown any contract to read.   I believe the company intentionally has no contact information on the paper that was enclosed with the gift card so they purposely cannot be reached, and likewise on their website. I want to be clear that I'm not trying to replace the card or value, I have the exact one that was mailed to me because until I was contacted via email last Friday, I had no contact person who I could return the gift card to.   When I was called on Friday, I was told I had signed a contract. I asked for a copy of the document with my signature, but nothing has been produced.   Also, since posting this, my house is no longer being sold. We had a potential buyer, but problems arose and the contract is null and void. But I would like this resolved so that if I choose to sell my house in the future, the problem doesn't happen again.   The resolution I would like is an address and contact to which I can return the same original gift card I've been trying to return since December and confirmation that whatever agreement I may have agreed to under false pretenses is completely canceled with no further repercussions and no further contact with Exceed LLC.   Thank you. I do want it on record they did not address what happens when a "member" sells the property with a broker whom is not part of their "group" and they did not address how I was signed up with out my knowledge. Otherwise as long as they do not contact me again and do not try to stake any claims for funds owed to them by me which should never happen, I am fine with this resolution.

Thank you for removing us from the registered site/company. I'd like to add that it still does make sense to me how I could have been signed up, to your site and to your company, if this individual did not have a connection to your company. If he was independent, how did he access your system and enroll us? And yes, he did have me sign my initials on his smartphone but there's a BIG difference between him telling me that signing up was to activate the gift card process VERSUS having me initial a binding contract, which would attempt to penalize me at 10% of house sale price if I didn't use one of 7 relators when I sold my house. That is bait and switch.

all else. We always return calls when a message is left for us, or respond to emails when we receive them. It is impossible that anyone could be unsuccessful in contacting us (if they call us, or leave us a message, or send us an email, or fill out our contact form at our website, or write us a letter, whichever is easiest for them).
Pursuant to his wishes, despite [redacted] seeming to acknowledge in his
complaint that he and his wife gave their information and agreed to be in the program, we
have cancelled his and his wife's registration in our program, and as a result,
as [redacted] desires, we will not be paying [redacted] and his wife $500 (for which
they would have paid $0).

To whom it may concern:
Despite the [redacted]' request to cancel being made two months after they registered to join the program, which is long after the three business day right to cancel, nonetheless, we have conditionally cancelled their registration which they now claim to have not...

completed. We have conditionally canceled their registration subject to their home not showing up as being for sale in the next two years. If the home shows up as being for sale in the next two years, this would cause us to think that the request to cancel is not legitimate, and could possibly be due to unethical behavior, and if so, we will pursue our rights under the law.
The [redacted]' should be aware that their false statement about our program being a scam is both ludicrous, and libelous, and we have referred this matter to our lawyers to consider filing a lawsuit against the [redacted]' for making numerous unsupported false statements about us which could damage our reputation.
The [redacted]' complaint to the Revdex.com contains multiple false and dishonest statements. One such false statement is that Exceed is not a Revdex.com Accredited Business, which indeed it is, enjoying, and quite proud of, its A+ rating with the Revdex.com. Another false statement by the [redacted]' is that our website [redacted].com 'proved to be invalid'. It surely seems odd, and dishonest, that they claim our website URL 'proved to be invalid' when every other Internet user in the world is able to enter [redacted].com and arrive at our website.
Homeowners pay us $0 to join our program, $0 to be in our program, $0 if they never sell their home, and $0 if they sell their home in the future using their choice of any of our many cooperating brokers. It is completely illogical, and without merit, for anyone to ever suggest we are a scam. When, from time to time, someone makes such a foolish and unsupportable claim, we always ask 'how could this possibly be a scam', and to date, no one has ever provided an answer, which causes us to continue to know, as we have always known, that our program is wonderful for homeowners, and could never be a scam. If the [redacted]', or anyone else, can give us any reason how our program could be a scam, please be sure to let us know.

Any agent who recommends a homeowner not be
in our program does so to put more of the homeowner's money into
the agent's own pocket (taking it out of the homeowner's pocket)

the home sells in the future, the cooperating broker pays us an industry
standard referral feeAnd yes, while the homeowner pays less (by getting
the member rewards from us), the agent will be paid a lower commission.
On a home such as [redacted]'s home, the agent selling
the home would earn approximately $5,if [redacted] was not in
our wonderful program for homeownersIf [redacted] was in our wonderful
program for homeowners, the agent would earn approximately $3,390, while [redacted]
and her husband would have received $from us for being in the
program.
So, in this example, by an agent scaring [redacted]
out of the program, [redacted] will cause the agent to be paid $1,more, and [redacted]
and her husband will get $less.
Question: Who wins and who loses if [redacted] is NOT
in the program?
Answer: The agent wins[redacted] and her husband lose!
Our homeowner
members themselves choose which of our many outstanding cooperating brokers
they would like to work with when selling their homeThey may
change their selection any time at no cost, as often as they like,
until they enter into a listing agreement with their chosen broker to sell
their home
We ALWAYS put our homeowner members, our clients,
first, above all elseApparently, whatever agent [redacted] spoke with does
not do the same, and instead puts his or her needs above [redacted]'s and [redacted]'s husband's needs
The 1.2% [redacted] mentionsas stated above, we
have never asked a homeowner to pay us one penny, and no homeowner has
ever paid us one penny
To be clear, any agent who makes any statement
about being or not being a part of our program is being dishonest, as no agent
can ever be a part of our programonly the brokers they work
for can be a part of the programAny agent who is affiliated with any of
our cooperating brokers is 'a part of our program' if they want to sell
our member's home, whether they want to be a part or do not want to be a
part.
Seems pretty obvious why an agent who puts
their needs above the client's needs may not like our programThe
agent gets less, the homeowner gets more
If the agent selling [redacted]'s home were to earn a
commission for selling [redacted]'s home of $3,instead of $5,215, so that [redacted]
and her husband could receive $from us in Member Benefits for which [redacted] would pay us $0:
If the agent put in hours of time to sell the
home, the agent would earn $an hour (instead of $an hour if [redacted] and
her husband were not in the program)
If the agent put in hours to sell [redacted]'s
home, the agent would earn $an hour (instead of $an hour if [redacted] and
her husband were not in the program).
So, if [redacted] thinks it is better for [redacted] and
her husband to NOT receive $from us, for which [redacted] and her husband would have paid us $0, and instead [redacted] thinks her chosen
agent should earn $an hour instead of $an hour, or $an
hour instead of $an hour, then [redacted] indeed should not be a member of our
Smart Homeowners Program (we named the program for our members)

in the program, we have cancelled her and her husband's registration in our
