Our office recently received your correspondence of October 15, 2014 regarding the above mentioned
consumer's rebuttal of our response to her complaint
We have completed our investigation with [redacted] #[redacted]. I personally spoke to Ms.
[redacted] with the [redacted] today at phone number ###-###-####. Ms. [redacted] has verified
the account# [redacted] as reporting accurately on October 22, 2014. She recommends if the
consumer has any further questions he may contact Ms. [redacted] with [redacted] at
###-###-#### and request an AMCR. This is a statement on amounts received. We will be providing
the results directly to the consumer.
In regards to [redacted] #[redacted], this has been previously verified by the creditor as
accurately reporting on August 15, 2014.

This message, which willexpire after 7 years, alerts credit grantors to verify the consumer's identification in case someone isusing their information without their consent.Today I contacted the consumer directly by telephone and was able to assist him with his Experiancredit report. I requested that the consumer provide us a copy of a recent valid identity theft report(an official report filed with an appropriate federal, state, or local law enforcement agency, includingthe U.S. Postal Inspection service or others, the filing of which subjects the person who filed thereport to criminal penalties if the information filed is false), or a valid copy of a Federal TradeCommission affidavit with a police officer's signature and police report number.Please include a list of the accounts that were involved in the fraudulent account takeover along withthe addresses and other personal information that appears on his Experian credit report incorrectly.The consumer can forward this information directly to my attention at: Experian, [redacted]

So eventhough the court did not allow the filing of the bankruptcy or the bankruptcy did not go through, the fact that the case was documented allows it to appear on the personal Credit report.According to the Fair CreditReporting Act (FCRA), Section 605(d) (1), if a bankruptcy is withdrawn before a final judgment "the consumer reporting agency shall include in the report that such case was Withdrawn".The bankruptcy dismissed/withdrawn status will remain on the consumer's Experian credit report for seven years from the filing date.Experian strives to achieve a high level of customer service for all the consumers they assist. Consumer's personal Credit report.We are currently investigating the information with which the consumer disagrees. Upon completion of this process, we will provide the results of our investigation directly to the consumer.When a consumer disputes the accuracy or completeness of information on the personal credit report and tells us specifically why they believe the information is inaccurate or incomplete, we process the dispute as required by law. We contact the furnisher of the information or the vendor that collected the information from a public record source such as a court or other government office either electronically or by US Mail. We ask the furnisher or the vendor to conduct a thorough and complete investigation to verify all of the information regarding the disputed item, and report back within the time frame required by law. We review and consider the response to determine whether to accept it, reject it, or follow up for additional information. If, after processing, we find that the disputed information is inaccurate, incomplete or cannot be verified, we then delete that information, or modify that information, as appropriate, based upon the dispute and the results of our processing. If we do not receive a response from the furnisher or the vendor within the required period, we update the item as requested or delete the information, in some instances, upon reviewing the credit file and any relevant information submitted to us, we are able to determine whether the disputed information should be changed or deleted without having to contact the furnisher or the vendor. Investigations can take as long as 30 days to reach a conclusion. After we complete our processing, we send the Consumer the resultS.In addition to the consumer's right to dispute information in the credit file with the credit reporting agencies, the consumer also has the right to dispute information in the credit report directly with the furnisher of the information.if the consumer questions the results of the dispute process, then they may want to contact the furnisher of the information directly or review the original information in the public record.
