*** *** prior to his initial deposit and submission of any entry fees on FanDuelMoreover, when *** *** contacted FanDuel, we responded promptly to him and provided him additional credits for further play FanDuel's "First Time Deposit Bonus" is a promotion where FanDuel will contribute an additional percentage of a user's first deposit into his FanDuel accountFanDuel has structured this promotion such that the bonus “unlocks over time,” in an effort to counteract fraud and potential manipulation of the promotion by users who create multiple accounts simply to accrue the bonuses. Accordingly, the bonus is deposited into the user's account gradually, as the user participates in contests, at a rate of 4% of the entry fee for each contest entered. These details, including the terms and conditions pertaining to the promotion, are clearly identified on the FanDuel websiteIn particular, these terms are prominently accessible to any user prior to him making a deposit on the FanDuel website as explained in further detail in the next paragraph. After a user registers with FanDuel, the first screen that he sees is a prominent, direct, and user-friendly explanation of the bonus system. See Exhibit A. The fact that the bonus “unlocks as you play over time” is clearly and conspicuously noted in the middle of the page, followed immediately by a link to learn more about “how it [the bonus system] works.” When a user clicks on this link, a screen pops up that explains how the bonus works in simple, accessible language, and in a large font. See Exhibit B. Specifically, the language indicates the bonus is “earned gradually after you enter and complete paid contests” and “is released as real cash at a rate of 4% of the entry fee of the contest you enter.” Furthermore, the How It Works page provides an example of how the bonus is earned: “For example, if you enter a $contest, $of deposit bonus will be released into your main funds account.” FanDuel’s advertisements also disclose that the bonus is “earned as you play” and explicitly state that the full rules for the promotion are found on the FanDuel website and that the promotion is subject to those rulesSee Exhibit C In sum, *** *** was provided clear, thorough and accessible information regarding FanDuel's first time deposit bonus and has received a bonus consistent with FanDuel's termsOn October **, 2014, *** *** created his FanDuel account and deposited $with a 100% bonus match offer, making him eligible for a $pending bonusSince that time, *** *** has entered contests using a total of $in entry fees*** *** was credited with 4% of those entry fees as a bonus into his FanDuel account, consistent with FanDuel's terms explained above. On December **, 2016, *** *** contacted FanDuel concerning his bonus fundsFanDuel promptly responded to *** ***, repeating the bonus process outlined above and noting that the information had been provided prior to his ability to deposit fundsFanDuel also offered *** *** a $play credit to use on the site. FanDuel takes its consumer messaging seriously, as it wants users to be satisfied with its product. As evidenced by the displays on its site and the plain language used in its advertisements, FanDuel has been careful to ensure that it provides clear, thorough, and accessible information regarding its bonus promotion in order to avoid misleading or confusing its consumers. FanDuel also seeks to provide a positive user experience, including throughout the customer care cycle. Accordingly, FanDuel corresponded with *** *** promptly regarding his concerns and provided him with credit on the FanDuel site. This users account was suspended on December *** due to some activity the system deemed inconsistentWe were then contacted by the user later that day, and asked them to provide us with some account information in order to get them back up and runningUnfortunately, the system that we use to
verify accounts initially could not verify the account based on the information being provided, which is why we left it suspendedThe user would ultimately be able to verify their account, which we then re-opened for full useAfter some back and forth, we decided that it was best to part ways with the user, and suggested they withdraw their remaining balance, which they didThis withdrawal allowed the user to leave the site with $in winnings, which was in addition to the two deposits that we refunded back to the users credit card

To whom it may concern, *** *** requested a check withdrawal of $on 2/**/This sum included $that was deposited on 12/**/and not played through as well as a cent remainder from a previous deposit in that he did not playthrough. For security of the accounts used
to make payments, we do not issue checks in lieu of a refund for an unplayed depositAdditionally, *** *** requested his check be mailed to an address different than what he provided when he verified his identityWe sent an email at the time of the rejection advising that the information did not match and we were unable to process. *** *** emailed us on 3/**/ at 4:PM EST inquiring as to why this was unprocessed. Within eight minutes (4:PM, EST) our customer service representative explained the address did not match and advised him to resubmit his request with the correct information or do a PayPal if he could not receive his check at the verified address*** *** replied about hours later (4:AM EST) stating that he still wanted his withdrawal and cancel his account but did not not resubmit the request with the verified address or follow the provided link to update his addressOur customer service team reached out to him again this morning (AM EST) advising that we need the information on his account and check to match. We have now refunded his original transaction of $on 12/**/16, and he will see that return to his Visa ending in *** within business daysThe remaining cents is from a deposit in that we are no longer able to refundWe have issued a paper check for this sum and mailed it to the address that *** *** has verified with his identity: *** *** ***

Having to invest $in gaming wages to earn the $matching funds as advertised boldly on television, internet and radio ($ @ 4% match = $200) is ludicrous, regardless of the voluminous and over-complicated language used to mislead customers The Advertising was clear on the surface that "FanDuel will match you initial deposit up to $200" is an outright lie They don't go on to verbalize that you will get that matching money as you invest $in wagers There advertising is and deceptive It is easy to see why services like these (Fanduel, ***, etc.) are being investigated by Congress I will be sending these details to my Congressman so that he can include this proven deception of the public and FanDuel's use of deceptive business and marketing practices on television, internet and radio

This customer registered for FanDuel on April ***, and made a $deposit while using a special promo code. The customer received a 100% matching pending deposit bonus, as advertised on our deposit screen.After registration, this customer used the deposited funds along with funds that were
released from his bonus account to play in paid games. Some of these games resulted winnings, which have since been withdrawn. Thus, this customer is ineligible for our money-back guarantee program. The money-back guarantee program is only available to customers who lose their first contest on FanDuel as described on our website.Additionally, the customer contacted our support department with his complaint on May *** in which we offered the complete details on how our pending bonus program works. We also generously credited his account with loyalty points, which have since been used to enter into more paid games

This user has been provided a full explanation on how FDP are calculated, and has been informed that his FDP balance is fully accurateTo provide some context, FDP are FanDuel Points, and they are FanDuel's loyalty program that rewards users who consistently play our siteUsers receive these FDP
points every game they play, win or loseThese FDP are credited to users accounts at a rate of FDP for each $enteredThus, since this user has entered $worth of contests, his FDP balance is accurately showing as 1,($x FDP)

Case # ***. This user has been playing FanDuel since 2011, and is very much aware of the fact that we only provide first time depositors with deposit bonuses unless under special promotions. We communicated with this user on multiple occasions in an attempt to get them to drop the complaint. This included sending them a private correspondence through our website, offering them a loyalty credit of $25. This offer was met with no response, and we simply felt that there was nothing more we could do with this complaint. This is because we are unable to offer multiple promotional codes to users

To whom it may concern, We write in response to *** ***s December *, consumer complaint regarding FanDuel's prohibition on the creation of multiple accountsAs discussed in detail below, FanDuel's Terms of Use ("Terms") expressly prohibit users from establishing more than one account
on the FanDuel serviceFurther, *** *** was able to withdraw all monies owing to himMoreover, when *** *** contacted FanDuel, we responded to him promptly, confirmed that he would not be eligible to re-open his account and immediately allowed him to withdraw all monies owing to him. Under FanDuel's Terms, each user "may establish, maintain, use and control only one account on the Service." The Terms further provide that "[i]n the event FanDuel determines that you have opened, maintained, used or controlled more than one account, in addition to any other rights that FanDuel may have, FanDuel reserves the right to suspend or terminate any or all of your accounts and terminate, withhold or revoke the awarding of any prizes." *** *** incorrectly asserts that the prohibition on mutli-accounting was added to FanDuel's Terms after 10/**/In fact, the above language was present in FanDuel's Terms when *** ***i created his unauthorized account on February ***, 2016. I have attached the version of the Terms that existed prior to such date. Accordingly, *** *** violated the Terms by establishing more than one account on FanDuelAs a result of this violation, and consistent with FanDuel's Terms, FanDuel has terminated all of *** ***'s accounts on FanDuel. As for the funds remaining in *** ***'s accounts, he was properly refunded all amounts owed to him*** *** had an account balance of $at the time he was suspendedAs he mentions in his complaint, he also had active entries in NFL tournaments when his account was suspendedIn all, he had nine active entries, totaling $in entry feesAccordingly, FanDuel refunded him $94.24, which included both the balance of his account ($68.24) and the refunded entry fees for the cancelled contests ($26). No further funds are owed to *** ***We have attached *** ***'s account history for reference. As for FanDuel Points ("FDP"), these are credits awarded to users for their play on FanDuelUnder FanDuel's Terms, FDP may be awarded by FanDuel at its sole discretionFDP may only be used as credits for future play on FanDuel and cannot be redeemed for cashAccordingly, *** *** is not eligible to receive any FDP as cash.
