I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

The organization is still attempting to bill me for a service I do not use and for a transaction that I have not approved.
As indicated in my initial complaint, I cancelled this service 2 years ago by calling the LoyalBlocks call center.
I unfortunately did not document this activity.
I have attached my [redacted] statement from March ** 2015 (yes, I said 2015 because I dealt will the same fraudulent charge of $718.80 last year in February 2015). On the statement, you will see on Page 3 that $718.80 was charged on January [redacted] 2015 and you will see on Page 1 the charge was removed after I disputed this with [redacted].
Today, I received a letter from [redacted] today about this issue. I also plan to contact them and ask for the communication I sent to them in [redacted]February 2015 [redacted] stating I cancelled this service and did not approve the charges in [redacted]February 2015[redacted].
I will never approve of these charges. I will also be filing a police report for this fraudulent activity once I have gathered all the paperwork from [redacted].

When you sign up to use flok, you agree to the terms and conditions stated. We don't charge based upon usage, you're charged to have your business's app live on the flok platform. Think of it like [redacted], you pay to have a subscription whether or not you watch a movie during...

that month. In order to not be charged or have your subscription renewed--you must notify us that you'd like to cancel prior to that renewal date. Our upfront plans are heavily discounted which is why they are paid upfront--with no refunds. Upon looking at your account and the correspondence, I do see an email sent to you on October [redacted] from your account manager regarding your plan. The best we can offer is to work with you to utilize the flok platform for the next year since you have paid for it.

We are a subscription-based business and much like a gym or [redacted] membership, the charges are recurring. These payments are automatically applied at the date of renewal. Over the course of your term (1, 3, 6 or 12 months) you can cancel at anytime, for any reason, with no notice and of course...

no cancellation fees. When you signed up with our service, you agreed to our Terms & Conditions by clicking "I Accept." This is not unauthorized.In our Terms & Conditions it states "you assume responsibility to send the [redacted] or [redacted] device back within 30 days of cancellation to avoid a replacement fee of $100. [redacted] does not take responsibility to pay for shipping and devices must be sent back in working condition." You must send the beacon back within 30 days otherwise a $100 fee is applied until received. Immediately after the return of the beacon, we will reimburse the $100. We have never stated that a return label and/or box would be given to you in order to return our equipment.

The subscription plan that you signed up for was a special offer for a 7 day free trial which rolls into a $228 upfront payment for a full year of flok. If you break it down it does come to $19/month. On the payment page where you enter your credit card, it is disclosed that you...

will be charged $228 after the free trial is up. In order to not be charged, you would have to cancel prior to that trial ending. We've never received any cancellation requests from you until after your card was attempted to be charged but was declined. We don't issue refunds as our upfront plans are heavily discounted. We also don't charge based upon usage. You pay for the flok app to host your business, whether you use it or not. We would be more than happy to work with you to get the best out of the app since you paid for it. Unfortunately we cannot issue a refund.

Not a good product
fails and makes the customers mad
when you leave they continue to charge with out a contract
they make excuses and say it will never happen again but this is untrue
as we are in Australia they have not invested in it here very well
we found the product to be very very poor
ended up going back to manual punch cards at 1/10th of the price with a 150% take up
as we are charged in USD we get fees each time they debit the card with out permission we loose as its a buy and sell with currency conversion plus fees

Tell us why here...As previously noted, we are NOT trying to bill you anything moving forward, because you contacted us last month and asked to cancel the service. As a result, your service was canceled immediately and an email confirmation was sent to you confirming this. It's that easy to cancel your service with us, just contact us and we shall make it so. If we haven't made it clear already, your account is canceled and you will not be billed from us moving forward. Just kindly send us back the device we sent you. 
As we also mentioned, you need to contact us to cancel your service and send your device back - this never happened until well after your subscription renewed. I invite you to confirm all this on our terms and conditions.

service) it also states that you'll be billed 30 days from now, once that free trial is over. Should you wish to cancel at anytime for any reason during those 30 days, you won't be billed anything at all. After the trial is over, you're billed the initial $22 but again, can cancel at anytime with no notice and with no cancellation fees. They are billing customers in advance for which I have asked to cancel prior to them charging my account no matter what they say.  My service has been canceled and I am due a refund because its for services in advance.  I paid for what I got.

This merchant opted out of/unsubscribed to receiving our emails. This is something that is out of our control. We notified the business through email multiple times within the 30 day window in regards to returning our beacon device. This is standard protocol for all businesses using flok/LoyalBlocks. Once the beacon is returned, we reimburse the $100 charge. Attached is proof of this businesses opting out of emails.

Our plans are also heavily discounted and therefore they are paid upfront. In order to not be charged you must cancel prior to the renewal date. Because you have now cancelled your account--you will not be charged again by us. The reason you were charged on January 2nd is because your plan renewed. We hadn't heard from you about cancelling prior to that date. If you would like to use the flok app for this year, please let us know as you did pay for it and are absolutely entitled to use our platform. Thanks and sorry for any confusion.

already been prorated, by 4X (which you can confirm on our pricing page). On top of this 4X reduction in price we also offer a 14 day money back gaurantee period just in case you feel this is the wrong fit, we offer a full refund - no questions asked :-)Since your cancelation request came over 2 months after you got started, we don't offer full refunds - this breaks the only term in your agreement (you're paying upfront for the year). We do offer month-to-month plans but you didn't select this one - and for all plans you can cancel with anyone for any reason at anytime with no notice and no cancelation fees. The only rule is we don't issue refunds retroactively outside of that 14 days I mentioned over the phone. Per your suggestion about a prorated refund, please note your plan is already prorated (by 4X) so we don't prorate it again in the event you want to cancel. voice messages we left her in August and September 2013, and again in April 2014, but no record of the "numerous voicemails" [redacted] claims she left with us. We are very easy to reach, our number is on our website, our employees in New York man the phones during normal business hours, and we have thousands of satisfied customers. Furthermore, as [redacted]'s complaint itself states, her loyalty club with us has 53 members. That being said - and although [redacted] signed a contract with us - we're sorry that she found her experience unsatisfactory, and are willing to refund the $59.97. We hope this settles the matter.
