We have conducted an internal investigation of this case and located the transaction in question. We could not trace any correspondence between our representatives and the buyer, indicating that the buyer did...

Our records show that the cancellation of the buyer's subscription was done at 5:16 PM (Pacific), from California, using Mac OS X machine, on March 22, 2014. The 7-day free trial began on Mar 14, 2014. The subscription was cancelled on the 8th day, after the 7-day free trial had expired, resulting in the credit card charge, and hence, indicating their satisfaction with the product.
The buyer has agreed with our Billing Policy that includes the following:
"Free trial
Grammarly may offer a free trial membership from time to time. If you accept such an offer, no charges will be applied to your account until the end of the trial period. If you do not wish to be charged, you must cancel the Services before the end of the trial period. Grammarly will not refund any fees that have accrued to your account(s) after the free trial period. If you cancel the Services before the end of the trial period, all your rights to any remaining free trial period will be waived and you will not be eligible to participate in any further trials.
Termination and Refund Policy
This Agreement shall continue until you cancel your subscription or until terminated by Grammarly. You may cancel your subscription at any time. I accept the refund but wished someone would have just helped me. I liked the program and really wished to keep it. I just wanted to get logged in. While it does appear to be an easy fix because of a typo, it would have been nice to have someone just help me. I'm quite surprised to hear that no one received my request. Again, I wished to have kept the service rather than a refund but do appreciate the refund. Thank you.

We were able to locate the correspondence between the buyer ([redacted]) and our representatives. Our records show that the buyer filed a chargeback, and the bank settled it in favor of the...

The payment cannot be refunded for two reasons: 1) technical limitation the buyer filed a chargeback and the payment became non-refundable (please see the screenshot attached); 2) per our Terms of Service and License Agreement, the payment cannot be refunded: "You may cancel your subscription at any time. All Fees paid or accrued in connection with any Service are non-refundable. Except as may be expressly set forth herein, Grammarly will not prorate any Fees paid for a subscription that is terminated before the end of its term."
The user has full control over the account management and cancellation process. Had the buyer contacted Grammarly support without filing the dispute, we would have been able to refund the charge.

We are not accepting this response. This is what happened. At first, as with any dispute, the credit card company that was charged the $95.45 gave us a credit, then they investigated and finally they removed this credit and charged us back the $95.45. The Am. Exp. credit card placed the $95.45 charge back on our account, but we would still like to get that credited back from Grammarly. As we said before , we just discovered the charge a few days after our account was billed, and as soon as we realized, we tried to cancel the service and get our money back. This is a recurring charge, that has been paid by us since 2010 ($95.45 x 4 years= $381.18). Even though it is our fault that we forgot that we were being billed, the company should have no problem giving us the $95.45 that we just paid. We really should be asking for the whole thing ($381.18)! The account has never been used since 2010. I would think they would want happy customers rather than unhappy ones that could tell other people! I have a copy of the letter from our credit card that's removing the credit. I can submit it if you let me know how to do it. Thanks!
