Based on
review of our records, it does not...
appear that we received a request to cancel.
The Cedar Rapids/Marion, IA 2016 contract auto renewed based on the terms and
conditions of the Cedar Rapids/Marion, IA 2015 contract.
4. Duration of Agreement;
AUTOMATIC RENEWAL; Distribution of Directories:
A. With respect to advertising in the Directories, the term
of this agreement is equal to the issue period for each Directory. The issue
period for each Directory is 12months from date of publication. Publisher
reserves the right to extend or reduce a Directory's issue period by no more than
six months. If the issue period of a Directory is extended, charges will be
extended accordingly. With respect to Internet Services, the initial term of
this agreement is for 12 months. Thereafter, this agreement will continue in
effect with respect to the Internet Services until Publisher or Customer
cancels. Any cancellation by Customer under this paragraph 4.A shall be made in
accordance with paragraph 8.
B. WITH RESPECT TO ADVERTISING IN A
DIRECTORY, BY ENTERING INTO THIS AGREEMENT WITH PUBLISHER, CUSTOMER AGREES TO
THE AUTOMATIC RENEWAL OF CUSTOMER'S ADVERTISING IN SUCCESSIVE ISSUES OF SUCH
DIRECTORY, ON THE SAME TERMS AND CONDITIONS AS SET FORTH IN THIS AGREEMENT,
PROVIDED THAT: (i) THE FORM AND CONTENT OF CUSTOMER'S ADVERTISING IN THE
SUCCESSIVE ISSUE OF THE DIRECTORY IS
MATERIALLY THE SAME AS THE FORM AND CONTENT OF CUSTOMER'S ADVERTISING IN THE PRIOR
ISSUE OF THE DIRECTORY; (ii) NOTICE IN WRITING OF SUCH AUTOMATIC RENEWAL IS
SENT TO CUSTOMER BY PUBLISHER AT LEAST FORTY-FIVE (45) DAYS BEFORE THE CLOSING
DATE OF THE SUCCESSIVE ISSUE OF SUCH DIRECTORY AND CUSTOMER DOES NOT
GIVE NOTICE IN WRITING TO PUBLISHER
CANCELING SUCH AUTOMATIC RENEWAL BY THE DATE SPECIFIED IN THE NOTICE, AT LEAST SEVEN
(7) DAYS PRIOR TO SUCH CLOSING DATE; (iii) WHERE CUSTOMER HAS PURCHASED
ADVERTISING IN A DIRECTORY AS PART OF A BUNDLE WITH OTHER PRODUCTS, THE
AUTOMATIC RENEWAL OF CUSTOMER'S ADVERTISING IN THE DIRECTORY WILL INCLUDE AUTOMATIC
RENEWAL OF THE OTHER PRODUCTS INCLUDED IN THE BUNDLE; AND (iv) THE COST FOR THE
ADVERTISING WILL BE THE THEN-CURRENT PRICE ESTABLISHED BY PUBLISHER FOR SUCH
ADVERTISING AND WILL BE INDICATED IN THE NOTICE OF AUTOMATIC RENEWAL SENT TO
CUSTOMER. SEE PARAGRAPH 4.A OF THIS AGREEMENT FOR INFORMATION ABOUT THE ISSUE
PERIOD OF
DIRECTORIES. IN THE EVENT THAT
CUSTOMER CANCELS THE AUTOMATIC RENEWAL OF ADVERTISING IN SUCH DIRECTORY AND CUSTOMER
WISHES TO AGAIN ADVERTISE IN SUCH DIRECTORY, A NEW AGREEMENT BETWEEN CUSTOMER
AND PUBLISHER FOR ADVERTISING IN SUCH DIRECTORY WILL BE REQUIRED.
In
speaking with [redacted], we have come to a mutual agreement. He accepted a one- time adjustment totaling $130.75.
This credit has since been applied to the account and it will be reapplied to
the unpaid agency balance. [redacted], has agreed to remit payment to hibu for $622.20
by September 30, 2016. If payment in the amount of $622.20 is received by
September 30th, 2016 hibu will have the account reversed from the
collection agency and this payment will satisfy the remaining unpaid balance on
the account. If payment is not received from [redacted] for the $622.20 by
September 30, 2016 the account will remain with the collection agency and they
will attempt to collect full payment to satisfy this debt.

I am rejecting this response because: It has no resolution, and by repeatedly ignoring our requests to cancel or inform us that requests to cancel must be done in writing, I feel that a resolution must be made in writing with the 3rd party. Due to Hibu repeatedly not having records, all calls with Hibu in the future will be recorded on our end. Paying the balance due on the account can be discussed if we have a cancellation of the account and assurances that Hibu will not auto renew the account again.

April 23, [redacted]Dear [redacted]:This correspondence confirms receipt of Complaint ID [redacted] filed by [redacted]. Our records indicate that the customer advertises in the Atlantic County, NJ directory which bills each year from June to May. Each contract is for twelve months. For the...
past three years, [redacted] has renewed his advertising via voice verification. We have reviewed the most recent renewal which was in December 2014 and is for the Atlantic County, NJ [redacted] directory which publishes in May of this year. The current advertising in the Atlantic County, NJ [redacted] ends this month. On the voice verification, the sales representative clearly advised that she was calling to renew the advertising. The customer asked the sales representative about his program from last year and the pricing; he then agreed to renew the program. There does not appear to be any confusion, the call was brief and to the point. The contract has not been extended for 18 months as indicated in the complaint but it is the standard twelve month contract. Suburbs, IL 2017 print directory has a publication date of October 21, 2016
and our Chicago,
IL 2017 has a publication date of January 24, 2017. He is scheduled to have
two [redacted] ads in each of these directories. One under the heading Electric
Contractors and the other under Contractors-General. As a courtesy for the
misunderstanding a 10% credit for $48 was extended and this credit has been accepted by [redacted]. This $48 will be credited back to
the same banking account that was used to make the pay in full payment back in
May. The credit may take 7-10 business days to appear in his account.

experienced and pleased to be able to resolve the matter in a mutually

I am rejecting this response because:We have tried to contact Hibu Several times since receiving their call. I spent a 2 hours drive last week trying to simply navigate their phone system to even reach Kris G[redacted]. Twice no one knew who I was talking about and finally after finding someone who knew her, I was put on hold for a long time, to be told she was not able to be located. Then once again on hold for another very long period of time (was about to hang up) before I was told she was on the other line and could not speak with me. Then on hold again and forwarded to her voice mail. I left a voice message asking for her to please establish a set time to talk. I travel often and one of the jobs I am currently working, there is no cell phone service. I would like to please request a SET time and day scheduled by Ms. G[redacted] to resolve this issue. As the process of going through Hibu's customer service number is so extensive and disorganized, I'd appreciate it if she would please call me, at the agreed up set time. Email is suitable for establishing a date and time, so please send an email to [redacted]

I was not able to find a recorded phone call between **. or [redacted] with our telephone sales department indicating they would get a guaranteed first page placement on the search engine. As a goodwill gesture I’ve extended the offer of a refund of $144.33 which [redacted] has accepted. I’ve let [redacted] know refunds do take 2 to 4 weeks to be processed.
