PNC did not send me where they got the starting balance of 127kI understand that they are claiming that I didnt argue this soonerI tried asking CS and got no clarificationI tried to argue amount when I applied for modification and was yelled at do u want to do a modification or argue! My husband was sick and I was unsure if I could even afford house after he passed so I agreed to sign modificationThe balance was still upsetting me and I found free legal help NYLAG that helped me file complaint with esculation deptI had at least contacts at PNC that I spoke to once and was told when I called back someone else was handling my caseI was willing to drive to PNC in NJ to have someone show me how they were showing the higher balance they refusedI know what was spent and it is not what PNC is showingNYLAG sent a request for proof of starting balance that was all NYLAG could doI went to a lawyer he wanted retainer that I could not affordPNC would not renew my modification and my payment almost doubled so I could not afford that amount and got a mortage with bethpage credit unionI am so upset that I did not have the finances to pay a lawyer or understand what to do sooner and was treated badly by PNC customer service

For your reference, details of the offer I reviewed appear below.April 12, 2016We absolutely reject and dispute PNCs response.They continue to tell us that our appraisal is not satisfactory to PNC.As we have stated and included documentation to prove, our appraisal was conducted by a *** State licensed appraiser and in addition our appraisal was an FHA appraisal which as everyone knows, including PNC, is a much more detailed and thorough appraisal processFurthermore, we have NEVER signed ANY contract with PNC mortgageOur original mortgage was with *** mortgagePNC bought our mortgage from ***I have included (page attachment) our original signed contract with *** mortgage.We were told that as soon as the value of our property reached the required amount our PMI would be automatically terminatedThis is exactly how we understood the contract.Since we never signed anything with PNC, how can they now say we don’t meet “their” requirements? If that was the case they could say any absurd thing they want to about any part of our mortgage.In addition I have included (page one attachment) a letter from PNC with states “we may request an appraisal through PNC mortgage”It does not say we are “required to” it says “may”.PNC can and should accept our appraisalPNC has the ability to simply include our appraiser in their so called “approved appraisers” listWhy can’t they do that? Why won’t they do that?This is absolutely ridiculous…anybody…any realtor, any assessor, any banker… anybody with a computer can confirm that our property’s value has reached the required 80% home to loan-to-value ratio.This is not the intent of the The Homeowners Protection ActI am prepared to take legal action against PNCI will let the court decide whether or not the intent of the The Homeowners Protection Act is to make the homeowner jump through hoops of fire and spend thousands of dollars in order to stop being overcharged for useless and illegal PMI.Below is an excerpt from the Board of Governors of the Federal Reserve:The Homeowners Protection Act of (the Act) was signed into law on July 29, 1998, and became effective on July 29, The Act, also known as the “PMI Cancellation Act,” addresses homeowners’ difficulties in canceling private mortgage insurance (PMI) coverageIt establishes provisions for canceling and terminating PMI, establishes disclosure and notification requirements, and requires the return of unearned premiumsExcessive PMI coverage provides little extra protection for a lender and does not benefit the borrowerIn some instances, homeowners have experienced problems in canceling PMIAt other times, lenders may have agreed to terminate coverage when the borrower’s equity reached percent, but the policies and procedures used for canceling or terminating PMI coverage varied widely among lenders.I believe PNC is in violation of The Homeowners Protection Act of I believe they are required to, and in fact a long time ago they were required to automatically terminate our PMII believe they can, but refuse to accept our appraisal.Regards,*** ***
