Idea Buyer has created and delivered all of the deliverables in Mr. [redacted]’s contract and proposal.  In addition, we have created multiple prototypes of his product that have been shown to retailers in the product’s retail space. Each improvement to the design was based on input from...

Mr. [redacted], vendors, and/or other potential customers. While we agree it is unfortunate that no retailer has pursued this product, our agreement is very clear that we cannot in any way guarantee success for any product. Finally, we still believe this to still be a viable product with potential in retail, which is why we extended Mr. [redacted]’s agreement to keep the door open for interest.

We have since built the client 4 different versions and she has refused to approve any of them not allowing our team to continue our work.In June and July of this year is when the client began demanding a full refund after the following has been completed in her contract:-Professional branding completed and approved-Professional app specs wireframes approved-Professional patent filing - waiting on your approval-Professional trademark filing - finished - need client to confirm full legal name and address for filing completion-Professional app design completed and approved-Professional e-commerce website - this is linked to final app approval which is not confirmed yet-Monetization case - confirmed-End user agreement - in process-Target Social Media - confirmed when app is approved-Publicity - confirmed when app is approvedOur agreements are for 24 months because these projects do not happen overnight and we need to work through creative problem solving together as partners. I am attaching the materials and emailing the ones that we cannot attach. Our position is the same as it has been since several months ago of telling the client that we have done a large portion of the work and has already been approved, we also have spent additional funds in multiple development versions all of which the client has refused to approve. We want to try and find a way to work together and continue moving forward through development and launch.

I am rejecting this response because: I never received this new sales sheet they sent you. I attached the one they sent me. The picture of the label in Japanese was one of four labels they attached here was the only one not in English. About Tio2 they attached here is from my web page they just copied it. Idea over they attached is also mine Mr W[redacted] attachment was in August and after I told them that I will be in the States at that time. List of ingredient  attachment was mine I sent [redacted] Doc, I never received, [redacted] Market research and financial, I never received and the file was made July 22nd, I had asked many time to send me what they have done, From talking to MR, C[redacted] at the beginning; on the phone, I told him I DO NOT want the label changed but they did, I told Mr. W[redacted] this after they send the changed label then they send me a sales sheet with the logo change I requested not to do two times before. After telling them the importance of [redacted] and that it is the key point to my product; they left it out of the sales sheet. They also started to say that this is my fault for being so behind. I did have a web page with all the information that they required to do their job, I also sent sample in May to Mr C[redacted] but after I told them I will travel; at the beginning of July, Mr. W[redacted] requested more samples the day before I was leaving for my trip to the States and they blame me for getting the second set of samples late. Then I am switched to a new person; Mr G[redacted] and the process started all over again. For me as a business minded person, I can't work with people who are not listening to the customer, making repeated mistakes, can't understand my product and have no idea what they are doing. If I did the same thing to my customers I would not have a business. For a product that is already branded, already making sales and has something no other product has; should be easy to do. Just put it on shelves. I was told by Mr. G[redacted] that they are on track for a nine month launch but the product only needs a pipeline to the customer which they hadn't provides. After I started to get very disappointed with them is when they started to do things, so if I never asked I might still be waiting for work done. This is not a business I feel is good for [redacted] and its future. I just want this ended and get my money back. They say they have done work but they are just copying and pasting; their words not mine. Mr G[redacted] set up a call time of next week but never called. Then they said the number was wrong, but I had spoken to Mr. C[redacted] on the phone before, so not having the correct number is my fault? Then I contacted them to find out why they didn't call and they told me the number didn't work; over a a week later, after I contacted them to ask why they didn't call. To me this is not a professional way of doing business. The customer should not have to request to see work three months after contract was sigh and paid for, a customer should not have to keep repeating himself over and over again,  a customer should not have to play the blame game and pointing fingers. If they were under my payroll, they would have been relieved of position a long time ago. I am in eight different countries now and six of them have been set up in the past month and a half, with sales increasing and my brand getting more attention but I still have not gotten any sales from them at all. I even have sales from the States that I made myself. What is taking them so long to get my branded product to market? I feel since I am in a different country that they feel I am not a priority and have been put on the back burner till I started to complain and asked for my money back; then they started to move on it. Is this proper business ethics? I don't think so. You can see the progression of there work in the attachment I had sent with this email. Steve worked with [redacted] from her onset in 2014 until late September of 2015, when I, John W[redacted], became the full project manager and took over communication with her. During both of our times together we sent her over 70 emails and had client update calls. Steve also attended two trade shows specifically for this client's product, these additional costs we incurred and did not ask the client to pay for.During the course of our agreement we completed and delivered every objective in our contract that she signed, while also providing her with a physical prototype which is not included in her contract that we did not charge her money for. To date we have been partners for just over 3 months into a 24 month contract. We have made several attempts to set up a phone call with him to solve some of the communication issues documented below. We have also taken exactly the files he has sent us to use and used them and he is still saying...

they are wrong - but they are taken directly from the files he sent us and instructed us to use?   We have created new branding for him to use as an option, he said he did not want to use the branding we created but that he needed the labels he has to be in English since he did not have those. We created those and we also created the marketing material for us to be able to present to companies for his product. Before we send anything out to any company or contact we always have the client review and approve our materials and get the approval from them before moving forward. [redacted] still has not done that or set up a call with us to discuss this instead he has requested his money back and become very negative in his communication.

I've initiated 90% of the correspondence, they told me to purchase my own domain name, which I thought was odd having to buy something in addition to what I gave them, and the website was supposed to be good for two years, but it isn't operable (see attached).  THEY said they would take care of all that with regard to the website.  They said the contract was for 24 months, well they never told me our relationship was terminated as it's been 27+ months.  I have emails attached which voice my displeasure with their stringing me along.  I inquired about patent in Jul 2017, and one of their employees said that a patent was filed on August 9, 2016.  I had to inquire in October 2017 as to what the patent numbers were, and they conveniently qualified the response whereas to shift the onus of time on the USPTO despite the fact that they never told me they applied for the patent to begin with.  I have emails supporting this, which I could not attach bc I already attached too much.Their response was canned cookie cutter where the bulk of the language can be used for any complaint, and it was sent within almost an hour of the complaint, showing there was minimal time to look into the complaint and reaffirming that the response was canned.This is the first step.  I am a licensed attorney and will make this my personal project to obtain restitution and pursue punitive remedies whereas they can't keep swindling people.

I am rejecting this response because:The deal was only agreed upon because we requested that the proposals be added to the contract. The proposal or Offer stated the specifics of what Idea Buyers were offering and when. It gives a six to nine month timeline and without that we would have not agreed to the deal and spoke in detail about it with [redacted], my Attorney Mr. [redacted], [redacted](Member of my organization) and myself. As you can see on Page 4 of their contract this was added. Without this being add to the contract and our understanding that the APP would be completed by December no later than March we would have never agree. Idea Buyer has never produced a product that works the correct way or performs the services that we agreed on.

revised May 11th – shirts designed July 28th  – Website started August 24th  – Website finished September 1st    – outreach started October 24 – New shirts designedOctober 28th – Shirts revised  We created the first website and he said: “I checked it out. . Looks good but still when you hit (buy now)it redirects to some template site." We then created an e-commerce page and incorporated custom PayPal buttons on the site and everything was approved. Everything we have done has been approved by the client. We never move forward in the process until the client gives us the go-ahead.  In another email he said this: “Between us I could really care less about the website it's about your company pushing my product to buyers that I don't have access to.”  Jess and myself both talked and worked with [redacted] throughout his time here as a client.  The market speaks for itself.  We do not have control over who would want to buy a t-shirt.  We did numerous rounds of outreach and no one was interested.  [redacted] was upset when we could not generate sales for him but unfortunately this is the name of the game and we were in full compliance with our contract.I have attached several items, sell sheet, shirt designs, tags/packaging, web content etc.
