I do NOT except there response, as I did NOT agree for them to take money, in the amount of 325.00 out of my account at one time, as they stated a post dated check. I went back into my records and found were I agreed to make 50.00 payments until Feb. 2015, which I did. At that time we would discuss how my finances were, they said they would contact me. " I actually thought I was done with this debt."
It says that _ _ _ confirmed that I agreed to the payment arrangement. I agreed to 50.00 a month until Feb 2015, not 325.00 all at one time. I do not make a lot of money and I know I would not have agreed to the large amount.
My point is: I know they are debt collectors but they can not just go ahead and take money out of someones account with out the agreement from the person and the correct amount and not being notified by mail until a week after they took out the money. I am sorry, but that must be illegal. The reason they could take that amount was because I was trying to take care of that debt and I trusted them with my account information and they illegally used it to take the 325.00 out of my account. Remember the only mail I rec`d from them was a week after they illegally took that money out of my account.
If they did it to me, how many other people is this happening to. I think there accounts should be investigated. They took what little money I had, so I could not pay my other small bills, which became late and now fees have been applied, they have already damaged my credit down to worth nothing. So I want this off my Credit, all three of them!! And maybe while they are at it, they can call my slate clean!!
If not so be it.. Oh yes, I want to see proof that I agreed for them to take that 325.00 out of my account all at one time.

Our records indicate the[redacted] account was opened in July 2007 and charged off in August 2010. The FTC settlement referenced in Mrs. [redacted]'s correspondence affected accounts that were opened on or before December 31, 2005. As such, the account is not included in the settlement. Jefferson Capital Systems, LLC, acquired the account in September 2010 with a balance of $1,029.22; enclosed is a copy of the Statement of Account Activity pertaining to the balance. Although we feel the balance is rightfully due, as a courtesy, we have closed our file and terminated collection efforts. We are also requesting the credit bureaus to delete our trade line from Mrs. [redacted]'s credit file.

This is absolutely ridiculous. This helps me none.. I am not being sued by [redacted]. I am being sued by Jefferson Capital Systems LLC. No where on the court summons does it mention [redacted]. If this company claims I owe them a debt, I would like to speak with them directly and have a promissory note faxed/emailed/mailed to me proving that they own a student loan of mine. Then close their lawsuit and set up a payment plan with my parents. It is that simple! I have tried contacting this place, [redacted], and every time I ask for a woman named " Jana [redacted] " they hang up on me! I also try asking any associate there about my case or the above account number given by Jefferson Capital Systems, and they have no clue what I am talking about nor can help me. Drop the Lawsuit, Prove that you own my student loan with legal documentation like the promissory note, and set up payments with my Father and I, the co-signer.

As stated in our previous reply, Jefferson Capital Systems, LLC, purchased the[redacted] account in May 2013. We placed the account with [redacted] in October 2014 for collection efforts and they filed suit on our behalf. Jana [redacted] has made attempts to contact Mr. [redacted] via the telephone but has been unsuccessful in speaking with him and she has not received a return call. Ms. [redacted] has sent Mr. [redacted] documentation of the account which includes the Promissory Note, Bills of Sale and Proof of Ownership. As a matter of information, the initial demand letter did provide RPM's name, Jefferson Capital Systems, LLC's name and SLM Education Credit Finance.
In a subsequent telephone conversation yesterday (March 17th) between myself and Mr. [redacted] he indicated his willingness to resolve the matter, I contacted Ms. [redacted] and she was able to reach Mr. [redacted] and he will be in contact with her again with regard to getting the matter resolved. He was provided with a direct line to call Ms. [redacted] back during their conversation.

After phone contact with Shirley [redacted], we were able to sort everything out. She contacted her 3rd party collection agency that represents her company for my student loan debt, RPM, and had them mail out proof of loan ownership. The Promissory note and bill of sale. Which is great ! Then soon after we were able to speak with a escalations rep at RPM named Malynda [redacted](ext. [redacted]) and she was able to re set us up with a payment plan. She also assured us that an formal email would be sent out stating that the lawsuit is being dropped, now that we were able to reach a settlement. I would only ask Shirley [redacted] from Jefferson Capital Systems to please re assure that the Lawsuit towards me and my father is being dismissed and dropped 100%. She can contact RPM to confirm this and that we have came to a settlement and a payment plan. Thank You !

Mr. [redacted] did not appear in court nor did he file a responsive pleading with the court per the Summons. Subsequently, a judgment was entered with the court on October 4, 2012 for $4,585.11 with post-judgment interest ordered at 24% per annum pursuant to Colorado Revised Statutes, Section 5-12-101 and the underlying original account Cardmember Agreement.  A writ of garnishment was lawfully requested and issued by the court on June 9, 2016.   Upon review of the account and the court file, Jefferson has acted legally in the enforcement of its court ordered judgment.
