When you completed the application you agreed to the terms and conditions which state:
•I agree that OpenRoad Lending may forward this application and my financial information to one or more third party lenders, dealers, affiliates or others that may be able to offer me, or assist me in finding, financing or other products that meets my needsSome of these affiliates may offer or arrange dealer financing rather than a direct loan from a lender
•I expressly grant OpenRoad Lending and its third parties, affiliates, agents, service providers or assignees the authority to call and/or email me with questions related to this application and share information about other products and services available
Also having multiple inquiries on your report (for the same type of credit)within a relatively short period of time (like days) has no adverse impact on your scoreYou can check out this article from Experian (http://www.experian.com/blogs/ask-experian/2009/03/01/impact-on-credit-scores-o... just google it for yourself and you will see that it is a myth
Again I am sorry for your experience

I am not sure what you mean by "Fossett for Maisch" but you came to us from *** *** Doing some backtracking it appears you once had a loan with *** for about $21,but since you have a brand new loan with *** *** (I am assuming because they havent placed the title or lien yet but it is for about $17,000) that you traded that vehicle in I am making an assumption on those facts If that is true we can no longer lend more money than a vehicle is worth The loans are tied to the vehicle you have and your loan to value must be within certain parameters The current vehicle that we have has a payoff of about $17,so we cannot payoff $21, This is no different than a mortgage loan, the max loan is based on the value of the collateral. Many of our consumers have excellent credit as we have low rates as well We try to help all types of credit so there is no intent to harm anyone and we help thousands of customers each month save month I do see you left a request for call back this morning and we left the attached voicemail about minutes ago If you need to call me directly you can at 972-215-but we are waiting for *** *** to complete the title work before we can complete the loan I do want to make you happy but we also have restrictions on what we can do as a lender

I am sorry we cant help you at this time but let me go back through the events. On 5/4/you applied and were approved at a rate lower than your current loan. We sent loan docs on 5/5/and then over the next weeks attempted at least a dozen times through email, text and phone calls
to speak to you about your approval. We did speak a few times during that time but eventually we were unable to talk with you and complete the loan. On 6/7/you called in after the day expiration to restart the loan. However we needed to pull credit again since the original approval expired. At that time your credit had changed dramatically since the first approval so we were unable to approve you on 6/7/17. The only effect on your credit is the credit inquiry on 5/4/and then 6/7/17. Multiple inquiries in a day period have no effect on your credit. Here is an article by Experian stating this (***) but you can research for yourself. The biggest drivers on credit score is 1) Credit utilization 2) payment history and 3) derogatory marks. You can research that for yourself as well but that something had happened already on your credit due to the decline from 5/to 6/7. Again I am sorry that we are unable to help you at this time

I am rejecting this response because:That is an error and most likely on my part which I apologize for, however, had your customer service representative who picked up the phone and taken the time and same steps you had to review my application and explain me to the the very same thing instead of cutting me off and telling me to call the credit bureau when this could have been resolved internally then I would have been more than happy and proceeded with making the necessary changes and could have avoided thisI am sorry but after dealing with customer service, I don't feel comfortable doing any business where I am not heard especially when it comes to handling my hard earned moneyPlease accept my previous resolution for this matter Regards,

Open Road Lending is engaging in selling data they gatherOpen Road Lending is promising low rate auto re finance with the intent of gathering and selling personal credit information not refinancing the majority of persons they solicitOpen Road Lending knows that the majority of the customers they solicit will not meet their credit requirements and then they sell that information to others whom start soliciting the customerOpen Road Lending is being deceptive in their advertisingThe disclaimers are cleverly written and very predatory practicesOpen Road Lending is preying on the uninformed and under informed customerI suspect if an investigation was initiated by an independent party, the outcome would find Open Road Lending generates the bulk of their revenue from selling customers data as as opposed to actually refinancing auto loans

The company replied saying, I didn't get the loan because I only worked for months at my current employer and did not have any employment beforeWell that's not trueI've been working consistently for over 36monthsI don't recall their application allowing me to put further employment information except the one I'm at currently atYes, I only worked months at my current job but I've worked consistently for over months

First let me start by apologizing this was not a good experience for youOur goal is to make applying with our company a positive experience for everyoneThere are specific disclosures you agree to once you complete the application.Once you complete the application, you agree to allow us to pass
your information to other lenders who may be able to offer you financing:I agree that OpenRoad Lending may forward this application and my financial information to one or more third party lenders, dealers, affiliates or others that may be able to offer me, or assist me in finding, financing or other products that meets my needsSome of these affiliates may offer or arrange dealer financing rather than a direct loan from a lender.I authorize those third party lenders, dealers, affiliates or others which are forwarded the application to share information in the application and any other credit information they obtain with other third parties who may be able to offer or arrange for a loan or financing through a dealer or other products and services. You can find the link here : http://www.openroadlending.com/terms-conditions/Also multiple auto inquiries in a short period of time (within weeks) have little or no affect on scoring as discussed here but you can find many more if you just google it. This is directly from Experian: http://www.experian.com/blogs/ask-experian/2009/03/01/impact-on-credit-scores-of... we do apologize for your poor experience with our company and hope we can earn your business some day in the future

I am sorry we weren't able to give you the exacted rate on the mailer but we were able to lower your current rate over 2.5% and save you over $1,over the life of the loan As far as multiple inquiries you gave us permission in the terms and conditions directly above the apply button on the
application #is quite clear that multiple inquiries could occur By providing the information in this application and clicking on the "Click to Complete and Start Saving!" button and the “I Agree to these Terms and Conditions” box, the applicant and any co-applicant ("I," "me," and "my") each agree that: (1) I received and read the State Disclosures and the OpenRoad Lending Privacy Policy; (2) I received, read, and agree to the Consent for Electronic Disclosures and all other Terms and Conditions for this application shown above; (3) I am able to print or keep copies of these materials and this application; and (4) I understand that I could have multiple inquiries on my credit report through this process and I am granting OpenRoad Lending and its partners permission to access my credit report to determine if I qualify for refinancing my existing auto loan, and (5) I provide express consent to receive autodialed/prerecorded calls/texts regarding financial services or other credit related offers from OpenRoad Lending or one if its third party lenders or affiliates at any number I have provided (consent to be contacted is not a condition to purchase services). Finally, multiple inquiries do not lower your credit score as you can see from this article from Experian http://www.experian.com/blogs/ask-experian/impact-on-credit-scores-of-inquiries-... You can search for yourself and find there are many other articles stating the same information from the other credit bureaus.Again I am sorry we cannot meet your expectations but we did lower your rate by over 2.5% and can save you a sizeable amount of money over the life of the loan I would be willing to include GAP in your loan for only $as a show of good faith since your LTV is almost 120% Please let us know if you would like to proceed

As we find out your loan to value (how much your car is worth)and the exact amount of your payoff the rate can go upThe higher the loan to value the higher the rateMany lenders wont do any loan to value over 130% but yours is over 145%We are still lowering your rate by over 4% and saving you money over the life of the loanI am sorry that your LTV is higher than most which causes a higher rate to be chargedWe are still 25% lower than what you are currently paying so it can save you money

I am rejecting this response because: I have several credit inquires on my credit report from various banks because of your misleading company, lowering my credit score significantlyI was mislead to believe that there would only be one credit inquiry from your companyPlease take the neccesary steps to remove those inquires from my credit report, Most recently receiving a letter from Well Fargo, whom I would never do business withNext efforts would be to contact the Attorney General's Office and Consumer Protection agency if this is not resolved

I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID 11491487, and find that this resolution is satisfactory to meAlthough, there is not an option to opt out when applyingHad I note received the information in the business's response, I would have never known there was a way to opt outI did read the terms and did not see anywhere in the terms that it was being sent anywhere else

Thank you for sharing your concernsThe information you are stating is not accurateWe do offer new and used purchase loans along with our refinance loans, however, in WA, we only offer refinancingThere are laws in the state of Washington that makes it difficult to do loans other than
direct to the consumer (like refinancing)When a dealer is brought into the loop, the lender rules change and it makes it difficult to conduct those types of loans in your stateIf you are trying to remove someone from the existing loan and refinance it in your name only, that is not allowed in WA eitherTo refinance in that state, there can be no change to the way the vehicle is currently registered in the state. I am sorry for the inconvenience this may have caused and hope we can earn your business in the future. Regards,The OpenRoad Lending Team

I am rejecting this response because:If there are limitations in changing title in certain stars this should be stated up front or included in the application before a credit check.

I gave specific instruction to NOT run my credit furtherYou agreed and shared my information anyway. My payments are on time thank you. The Ohio Attorney General has this information and will send it to the FTC as well. What you have done is not legal.

That is not the case. The concerns you have are disclosed on this web page (http://www.openroadlending.com/terms-conditions/) that is agreed upon when submitting your application. Whether you read it or not I cannot tell but we help thousands of customers each month save money. I am sorry that I cannot reverse the inquiry as we are bound by the credit bureaus that we can only request to remove invalid inquiries

I am rejecting this response because: my experience with the company was not in line with the company responseI discussed the value of my car and the amount owed prior to running my creditat that point the loan to value ratio was establishedMy ratio was way to high so running my credit was totally unnecessaryNo matter how good my credit was I would not qualify for the loanThe company has poor business practices that hurt the consumer instead of helping themA reasonable company would have not run my credit when it was obvious I didn't qualify for a loan

Do you really want us to publish your full credit application with SSN and all? How else do you think we approved you without having your income, job type, address, SSN and even your IP address which is an ATT IP address in Gainesville Georgia (DSL type). I sent the link to the blank one so you could remember all the disclosures that you completed. I don't plan on disclosing all of your personal information for public record with the Revdex.com. I am sorry you don't remember
