Complaint: [redacted] I am rejecting this response because: I just got off the phone with the warranty managerHe had no idea about the issues we hadThe claim had never made it to him until I submitted a complaint with Revdex.comThe companies response is falseThe readings on the floor was taken over a week ago and the floor has been drying for weeks nowIt wasn't a swimming pool that flooded the homeHowever, the manager is scheduled to be at the home to look at the repairs tomorrow Regards, [redacted]

Complaint: [redacted] I am rejecting this response because:There was NEVER a hose hooked up there for the winterWe had did smores the night before and on sunday it was really nice and wanted to clean off and hose off the patio we went into our garage and got the hose out to hook up once we turned it on we noticed that water was leakingThere are other people in the area that are having issues with their plumbing and also we are having other plumbing people to come out to look at itAfter talking with others if I had of known about journey homes I would of never bought a house from them cause the quality is not good and then dont want to be responsible for getting the work doneReading all the reviews I have read more bad stuff than good stuff!! This is the same complaint.I have spoken to the homeowner and indicated that lot is graded to the [redacted] County approved grading and drainage plan The lot grade was certified by an independent surveyor at the time of closing The grading of the lot cannot be changed.We committed to replacing the tree no later than July 24, 2015.The homeowner also indicated that he has other warranty issues I advised him to submit his claims through the warranty process and we would evaluate and correct the issues quickly.We consider this matter resolved.Larry S B [redacted] General Counsel

Contractor and homeowner met onsite to discuss repair and scheduling on 8/10/

We will review the file, contact the homeowner and respond accordingly

To date, all of the homeowner’s warranty claims have been addressed The last of which was a painting claim which was addressed and completed last week In regards to the concrete claim, and as previously stated, concrete does not fall under warranty The homeowner has been called to discuss her discontent with the concrete, however direct contact has yet been made Nonetheless, since all warranty items have been addressed, we respectfully request that this complaint be closed

Complaint: [redacted] I am rejecting this response because it was stated at the city council meeting that the remainder of the houses that had concrete problems would be replacedWe have all the addresses of the houses already repaired, which I would call basically call patchworkMost of these houses that were repaired were past their warranty date, they were built long before our house was builtWe have also driven to [redacted] which has been completed for a year or so and observed concrete problems starting to pop upWe have the addresses of about twenty houses where we seen visible cracking and sinking concreteWe seen a couple of houses where the driveway slabs have been repouredWe will be in our house years in August and we have driven every street in [redacted] and the only houses we see with concrete problems are the Journey ***We watched the last five [redacted] built on our block right across the street form our house built by [redacted] and [redacted] ***I noticed on each of these [redacted] they would spend one full day compacting the soil all the way around the entire house driveway includedMaybe there is a little message there soil compaction works! : Regards, [redacted] *** and [redacted] ***

We have been in contact with the homeowner and reached an agreement

The homeowner submitted the Warranty Claim Form on 2/25/ The meeting the homeowner is referring to was held in November The WCF was submitted months after the warranty period expired Additionally, concrete flatwork is explicitly excluded in the Limited Warranty Agreement and Agreement for Purchase and Sale, both of which were signed by the homeowner Concrete replacement on other [redacted] and in other subdivisions is irrelevant to this particular situation We have diligently and fairly investigated the claim It is difficult to understand why the homeowner expects warranty coverage after review of the above facts The homeowner's expectations are unreasonable The claim in not covered under the warranty program the terms of which were clearly and unambiguously disclosed and described to the homeowner prior to the homeowner purchasing the home

Please see attached letter sent to Mr***[redacted] *** [redacted] [redacted] *** RE: Concrete Pad Replacement Dear Mr***: I am receipt of your Revdex.com complaintAs outlined in our response via email dated November 12, 2015, we had attempted to contact you by telephone during the weeks in which you claim we did not respond to your emailsEnclosed please find a copy of that message as well as with the original Warranty letter dated May 26, We advised you to submit your claims through the warranty process; however, you chose to contact me directly, by emailAs a point of clarification, you did not cc my boss, but instead our General Sales ManagerFurthermore, you received returned calls and communications from us stating that your concrete pad would be replaced in the spring of I would like to remind you that flatwork is NOT covered under the Limited Warranty Agreement that came with your homeIn specific instances such as this, we do review concrete claims when the service pad fails and attempt to determine the cause of the failureThis pad failed in late spring of following several large storm eventsThe failure could have been prevented had landscaping surrounding the pad been installed within the first six months of ownershipNonetheless, we agreed in good faith to repair the garage service padAs previously explained, the time of completion is NOT guaranteed, as many factors can cause delaysWe will remove and replace your concrete service pad as soon as weather permitsThat will likely be spring of Pouring concrete in the winter is available but is not advisableIf you want the pad poured in the next sixty days we can attempt to get that done, however the conditions make it more difficult to have perfection in the pourI will await your decision on when you would like to proceedcc: Revdex.com
