to contact you by telephone during the weeks in which you claim we did not respond to your emails. Enclosed please find a copy of that message as well as with the original Warranty letter dated May 26, 2015. We advised you to submit your claims through the normal warranty process; however, you chose to contact me directly, by email. As a point of clarification, you did not cc my boss, but instead our General Sales Manager. Furthermore, you received returned calls and communications from us stating that your concrete pad would be replaced in the spring of 2016. I would like to remind you that flatwork is NOT covered under the Limited Warranty Agreement that came with your home. In specific instances such as this, we do review concrete claims when the service pad fails and attempt to determine the cause of the failure. This pad failed in late spring of 2015 following several large storm events. The failure could have been prevented had landscaping surrounding the pad been installed within the first six months of ownership. Nonetheless, we agreed in good faith to repair the garage service pad. As previously explained, the time of completion is NOT guaranteed, as many factors can cause delays. We will remove and replace your concrete service pad as soon as weather permits. That will likely be spring of 2016. Pouring concrete in the winter is available but is not advisable. If you want the pad poured in the next sixty days we can attempt to get that done, however the conditions make it more difficult to have perfection in the pour. I will await your decision on when you would like to proceed. cc: Revdex.com

In response to Mrs. [redacted]’s claim, Journey Homes LLC (“Journey”) respectfully disagrees with her position.  Journey acknowledges Mrs. [redacted]’s concerns, however, Mrs. [redacted] and Journey are bound by the terms of the Agreement for Purchase and Sale and the Limited Warranty Agreement entered into...

by the parties on 1/28/2015.  Both of those legal documents dictate that flatwork is not covered under warranty.  Specifically, paragraph 14(c) of the Agreement for Purchase and Sale and paragraph F(2) of the Limited Warranty Agreement.  The parties to these agreements are bound to and must honor the obligations created under said agreements.
